APPLICABLE ZONING APPROVAL CRITERIA /BOARD FINDINGS
350 8.8P No portion of individual, private driveways shall exceed a slope of 10% with switchbacks
and turns reasonable for emergency vehicle access. However, driveways between 10% and a
maximum of 12% on south-facing slopes with no curves may be approved by the Office of
Planning and Development in consultation with the Fire Department when it is determined
that no public safety issues will be created with such driveways. However, the Planning
Board may allow steeper grades by special permit, when it is determined that no public
safety issues will be created with such driveways.
The existing driveway will be regraded from a maximum of 16% to just under 14%. The
applicant has agreed to install fire suppression system within the home to meet safety
standards for the fire department given the grades.
A total of 10 significant trees as defined in 350-12.3 are slated for removal that have been
cataloged by a certified arborist as diseased or dying and are exempt from replacement.
There are 5 additional trees for which replacement is intended to be met. The total
replacement required is 54” either on site or through payment into the tree fund.
CONDITIONS
Prior to Site Work Prior to Issuance of a Certificate of Occupancy
1. At least 15 days prior to site work final plans with relevant
conditions herein shall be submitted for review. Plans shall
include:
a. A call out for the public shade tree on LC121 03.09.2021 with
added language that states 'air spading is required prior to any
excavation done by hand or mechanical means.
b. The tree planting detail #6 should indicate that any wire basket
from rootballs, including burlap & twine shall be removed and
Soil Saucer watering - to remain after surface finishing.
c. details of outlet control structure materials and rim elevations.
2. Certification by the arborist must be submitted indicating that all
tree protection measures recommended have been installed for the
trees that are to remain on site.
3. The applicant shall install a fire suppression system for the home
as indicated in the application materials.

5. The applicant shall show that 54” new trees
have been planted on site or a payment has
been made to the city if such trees cannot be
planted onsite.
6. The applicant shall submit photo verification of
finished grades that show a slope level reading
indicating that the driveway does not exceed
14% over 100’ length.
