The Board voted to approve a waiver of the lighting standards based on the plans submitted. (1) The requested use protects adjoining premises against seriously detrimental uses. Gasoline sales are allowed in the HB district. More pervious area is being created by expanding the tree belt. (2) The requested use will promote the convenience and safety of vehicular and pedestrian movement within the site and on adjacent streets, minimize traffic impacts on the streets and roads in the area. Additional striping will be added to the site to clarify traffic flow. The applicant has offered to install a bike share station pad connected to electricity as a mitigation value of $48,000 to offset the increase in trip generated by this use over the previous use. (3) The requested use will promote a harmonious relationship of structures and open spaces to the natural landscape, existing buildings and other community assets in the area; and (4) The requested use will not overload, and will mitigate adverse impacts on, the City's resources including the effect on the City's water supply and distribution system, sanitary and storm sewage collection and treatment systems, fire protection, streets and schools; and (5) The requested use meets any special regulations set forth in this chapter; (6) Compliance with the following technical performance standards: (1) Curb cuts onto streets shall be minimized. Access to this site will be from the existing entry off of North King St. A connection to the abutting parcel is provided. (2) Pedestrian, bicycle and vehicular traffic movement on site is separated, to the extent possible, the treebelt along King Street is being brought nearly completely into compliance with the design standards projects shall include sidewalks and tree belts abutting the street, except where site topography or other limitations make them infeasible. 7) The applicant has met the stormwater standards. 8) The Planning Board waived the requirement for showing onsite PV compatibility because Big Y provided evidence that it has a regional array off site that provide a significant percentage of electricity for this store. 350-11.6 HB Table of Use/Design Guidelines CITY OF NORTHAMPTON PERMIT DECISION pg. 3 CONDITIONS Prior to the Issuance of a Building Permit 1. At least 15 days prior to site work plans shall be submitted that incorporate modifications based on conditions including: location and materials for erosion control, protection of inlet grate just beyond work limit lines. Plans shall also show a. consistent arrow striping between detail and site plan, b. Compliance with sewer connection requirements, c. new extended striping treatment at loading dock d. Replacement of asphalt polymer in the ‘brick paver” areas with a contrasting color. 2. The applicant must record an executed Stormwater Operation, Maintenance and Inspection Agreement that includes the long-term operation and maintenance schedule of the proposed stormwater system to the satisfaction of the DPW. The Stormwater Management System Long-Term Operation & Maintenance (O&M) Plan that was included in the Stormwater Management Report must be revised to the satisfaction of the DPW as Attachment A to the Agreement described above. 3. The results of the test pits must be submitted to the DPW for review and approval to show that the leaching catch basins will meet the stormwater standards as presumed. Additional TSS removal to meet the 80% removal standard must be shown to have been met. 4. The applicant shall sign an easement or license agreement with the City for a Bike Share Station pad located onsite. Such agreement shall be approved by the City upon determining that it meets the standards of being publicly accessible for a 50 year term. If such agreement cannot be met, the applicant shall agree to make a payment of $48,000 to meet the mitigation requirement for increased trip generation to the site. Prior to final completion/sign- off of permits General Conditions 5. The applicant shall install the bike share station pad as identified in the agreement to that it is ready for dock, rail and kiosk or alternatively make a payment of $48,000 to meet the mitigation requirement for increased trip generation to the site. 6. The applicant shall submit a stamped as-built showing light levels no greater than as shown on the plans approved. 7. An additional EV charger shall be installed on the property. 8. All pavement markings shown on the plan shall be striped as needed but at intervals of no greater than every 2 years.
