Deed 4.2.18Affected Premises: Earle Street Northampton, Massachusetts RELEASE DEED THE CITY OF NORTHAMPTON, a municipal corporation whose address is 210 Main Street, Room 11, Northampton, Massachusetts, 01060 for consideration paid and in full consideration of SEVEN THOUSAND and 00/100 DOLLARS ($7,000.00) does hereby release and convey all its right, title and interest, to ALLOY, LLC, a Massachusetts limited liability company with a principal place of business at 209 Earle Street, Northampton, Massachusetts 01060, in and to a parcel of land in Northampton, Massachusetts on Earle Street, containing 0.694+/- acres, and shown as "Lot 4," on the plan of land entitled "Plan of Land in Northampton, MA, Prepared for Hospital Hill Development, LLC (Owners)", dated August 12, 2009 and revised August 28, 2009, by Sherman & Frydryk Land Surveying and Engineering, and recorded in the Hampshire Registry of Deeds in Plan Book 221, Page 81. Hereby reserving to the Grantor the permanent easement described in an Order of Taking dated November 18, 2007, and recorded in Book 9035, Page 304. The land hereby conveyed shall be subject to the following restrictions hereby reserved for the benefit of the Grantor: 1. The Premises shall be combined with the existing land of Grantee on Earle Street into a single lot. 2. Any driveway constructed for the benefit of said existing land shall come off of the existing Grantee owned property's frontage and not the frontage of the Premises 3. The driveway shall comply with zoning requirements and not be wider than 24' wide at the front property boundary 4. The driveway shall cross the sidewalk so that the entire sidewalk is the same as its current width and that entire width complies with the Americans with Disabilities Act (ADA) maximum side slope requirements. For Grantor's authority to convey, see Order of City Council dated February 15, 2018, a copy of which is attached hereto as Exhibit "A" and made a part hereof. Being the same premises described in a Release Deed to the City of Northampton dated October 4, 2017, recorded in the Hampshire Registry of Deeds in Book 12771, Page 225.
