The Natural Heritage Endangered Species Program (NHESP) of the Massachusetts Division of
Fisheries Wildlife received a Request for Determination of Applicability with site plans (not dated) in
compliance with the rare wildlife species section of the Massachusetts Wetlands Protection Act
Regulations (310 CMR 10.59). The NHESP also received supporting documentation for review pursuant
to the MA Endangered Species Act Regulations (321 CMR 10.18).
WETLANDS PROTECTION ACT (WPA)
Based on a review of the information that was provided and the information that is currently contained in
our database, the NHESP has determined that this project, as currently proposed, will not adversely
affect the actual Resource Area Habitat of state protected rare wildlife species. Please note that this
determination addresses only the matter of rare wildlife habitat and does not pertain to other wildlife
habitat issues that may be pertinent to the proposed project.
MASSACHUSETTS ENDANGERED SPECIES ACT (MESA
Based on a review of the information that was provided and the information that is currently contained in
our database, the NHESP has determined that this project, as currently proposed, will not result in a
prohibited "take" of state listed rare species. Any changes to the proposed project or any additional
work beyond that shown on the site plans may require an additional filing with the NHESP pursuant to
the MESA. This project may be subject to further review if no physical work is commenced within three
years from the date of issuance of this determination, or if there is a change to the project.

Request for Determination of Applicability
Enclosed is a Request for Determination of Applicability (RDA) and accompanying materials for the
Northampton Department of Public Works' (DPW) Chlorination and Flow Monitoring Improvement Project.
The DPW is requesting a negative determination of applicability to maintain and improve existing public
drinking water wells through the installation of chlorination and flow monitoring devices at the existing Spring
Street and Clark Street well pumping stations located in the Florence section of the City (see enclosed Site
Locus). The installation of chlorination facilities will allow compliance with the new DEP Ground Water Rule,
Immediate Long Term Response to Fecal Contamination.
Both existing well sites consist of upland areas with existing gravel access roads and individual well buildings
with associated underground utilities surrounded by a 6 -foot chain link fence. Both sites are located at the end
of existing gravel access roads and are within the 100 -foot Buffer Zone of Bordering Vegetated Wetlands and
Bank Resource Areas associated with tributaries of the Mill River. The streams /tributaries at both sites were
flowing on July 29, 2009 (most likely due to the high amount of precipitation in June and July of this year);
however USGS maps of the area indicate that the Clark Street Well Site is located within 100 feet of an
intermittent stream and the Spring Street Well Site is within 200 feet of a perennial stream. Wetlands
adjacent to both sites are forested systems dominanted by red maple (Acer rubrum). These systems have
standing water with organic soils and are dominated by the following wetland indicator species: skunk
cabbage (Symplocarpus foetiidus), cinnamon fern (Osmunda cinnamomea), sensitive fern (Onoc /ea
sensibilis) and gold thread (Coptis trifolia). Both sites are located within estimated and priority habitat areas
as mapped by NHESP (see enclosed figures and photos for additional information) and a copy of this RDA
has been sent to NHESP for a Streamlined Review.
The project consists of the installation of a flow meter vault with associated 12" and 8" underground ductile
iron piping and the installation of a discharge manhole and drywell. Sample discharge lines are being
installed to discharge sample water that runs through chlorine residual analyzers to dry wells for disposal.
These structures will be installed at both the existing Spring Street and Clark Street Well Sites (see attached
site plans). Approximately 200 LF of existing 12" water main will be replaced with 20" ductile iron water main
at the Clark Street Well Site.
The majority of work will occur in front of the existing pumping stations within the existing fenced area (see
attached photos). The only work that will occur outside of the existing fenced areas near the pump stations is
the installation of the proposed drywells. The drywells need to be located a minimum of 100 feet from the
existing drinking water wells and these structures will be located approximately 100 feet northwest of the
existing Clark Street Well and approximately 100 feet northeast of the existing Spring Street Well. As shown
on plans, all work will occur further from resource areas than existing conditions and should result in no more
than 450 SF of temporary disturbance to the 100 -foot buffer zone at the Clark Street Well Site and no more
than 450 SF of temporary disturbance to previously developed riverfront area at the Spring Street Well Site.

Request for Determination of Applicability
The installation of the replacement water main at the Clark Street Well Site will not occur within the 100 -foot
buffer zone. The water main will be installed within the existing gravel access road beginning at the fire
hydrant and ending west at Clark Street. Project staging and storage will be located near the existing buidling
on the access road. Following installation of the necessary structures and underground utility lines, the area
will be restored to original grade and will be seeded with a contractor's seed mix. The majority of the impacts
to the 100 -foot buffer zone and previously developed riverfront area at the Clark Street Well Site will be
temporary as the sites will be returned to preexisting conditions.
As the proposed project activities occur "in the course of maintaining, repairing or replacing, but not
substantially changing or enlarging, an existing and lawfully located structure or facility used in the service of
the public and used to provide electric, gas, water, telephone, telegraph and other telecommunication
services..." (Wetlands Protection Act, MGL Chapter 131 Section 40), the DPW expects the project o be
exempt from the requirement to file a Notice of Intent both under the Massachusetts Wetlands Protection Act
and the City of Northampton's Wetlands Ordinance.
Enclosed are 9 copies of a Request for Determination of Applicability (RDA); and a copy of the highlighted
section of the Massachusetts Wetlands Protection Act and the City of Northampton Wetlands Ordinance
which state that this project is exempt. Also enclosed with this Request are 9 copies of the plans, a Site
Locus map, a Natural Heritage and Endangered Species Program (NHESP) map, a FEMA Flood map,
photographs, proof of mailing of RDA to NHESP for a Simple Review, and an abutter's map of the project
site.

The only work that will occur outside of the existing fenced areas near the pump stations is construction
associated with the proposed drywells. The drywells need to be located a minimum of 100 feet from the
existing drinking water wells and these structures will be located approximately 100 feet northwest of the
existing Clark Street Well and approximately 100 feet northeast of the existing Spring Street Well. As
shown on plans, all work will occur further from resource areas than existing conditions and should result
in no more than 450 SF of temporary disturbance to the 100 -foot buffer zone at the Clark Street Well Site
and no more than 450 SF of temporary disturbance to previously developed riverfront area at the Spring
Street Well Site. Project staging and storage will be located near the existing buidling on the access
road. Following installation of the necessary structures and utility lines, the area will be restored to
oriainal arade and will be seeded with a contractor's seed mix.

The City of Northampton DPW proposes to maintain and improve existing public drinking water wells
through the installation of chlorination and flow monitoring devices. There will be no increase to the
current permitted withdrawal rate associated with the existing wells. The applicant expects this project
to be exempt from the requirement to file a Notice of Intent as all proposed project activities are "in
the course of maintaining, repairing or replacing, but not substantially changing or enlarging, an
existing and lawfully located structure or facility used in the service of the public and used to provide
electric, gas, water, telephone, telegraph and other telelcommunnication services..." (Wetlands
Protection Act, MGL Chapter 131 Section 40).
