Section 5.3 -Accessory Uses. Any use which is accessory to a principal use allowed by right-shall
be allowed only in connection with such allowed principal use. Any use which is accessory to a
ri� cipal use lowed,-.by:sRecial.pexUi'�and which is not specifically ing ed;inAlic.odgina
permit. shall be allowed only after issuance of a new special permit. Cessation of a principal use
shall require cessation of any accessory use which is not otherwise allowed as a principal use. The
Building Commissioner shall be responsible for determining what uses are principal, and what uses
are accessory. The following shall be limitations on certain specific accessory uses:
1. The keeping of farm animals, to include all farm animals and exotics, and a related private
stable, for personal use, is permitted as an accessory use in accordance with the following
conditions:
A. The minimum acreage required for keeping any farm or exotic animal, except as
described below, shall be 30,000 square feet for the first animal and 15,000 square feet
for each additional such animal. Animals under six (6) months not to be counted for
acreage requirements.
B. The minimum acreage required for keeping sheep, goats, llama, rabbits, or poultry,
except as allowed under household pets, shall be 30,000 square feet for up to three
animals and 10,000 square feet for each additional such animal. Animals under six (6)
months not to be counted for acreage requirements. (The requirements for these animals
are less stringent then other farm animals because these animals have less environmental
impacts.)
C. The location of any stable shall be not less that one hundred(100) feet from any-street
lot line, and not less than thirty(30) feet from any other lot line.
D. There must be adequate fencing to contain all farm animals at least twenty(20) feet from
all property boundaries at all times, except when animals are being directly supervised
by and under control of a person.
E. Stables, corrals and yards shall be properly drained and reasonably free from excessive
odor, dust, and mud, so as not to create a nuisance or health hazard to the community or
to surrounding property owners, from an air or drainage pollution standpoint.
Maintenance of the stable and property used in the keeping of animals shall conform to
all health and wetland regulations.
F. Horses,ponies, llamas and sheep may be kept for personal use without being accessory
to any other use, otherwise in accordance with this section and section 5.2.
2. The keeping of the household pets, for personal use, is permitted as an accessory use for
animals commonly considered household pets including dogs,cats, fish, and birds(parrots,
parakeets, doves, pigeons, etc.), six or fewer rabbits, and three or fewer ducks or hens.

Apveals of the City of '_)rthamptori voted unanimously to grant,
_with conditi-ns , tiie srie _-ial permit request of Thomas and Peggy
Pease, 3:95 Sprin,7 Street , to operate a car repair and refinishing
business at their home. Pre•nent and votina were Chairman Robert
C. Buscher, William Brari It and Peter inarac.
The findings were a-3 follows :
• Mr. Buscher, referring to the requirements for a special
permit according to the Zoning Ordinance, found that the
use is listed in the Table of Use Regulations; that it
bears a positive relationship to the public convenience
in that good, inexpensive car repairs would be beneficial
to the community, and the shop is located in an area
where neighbors appeared to have no objections; that the
use would not add appreciably to the existing traffic ,
nor would it impair pedestrian safety; and that this type
of use is unlikely to have an adverse impace on municipal
systems. On the effect of such a use on this particular
district, he found that , while the -character of the
neighborhood was residential , it is zoned for general
industrial use, and a car repair shop is allowed by spe-
cial permit.
• Air. Brandt found that the use is listed in the Table of
Use Regulations; that it bears a positive relationship to
the public good because there are no other repair shops
in the surrounding area; that the proposed use would
neither increase traffic congestion, impair pedestrian
safety, nor place a burden on public water or sewer sys-
tems ; and that, with certain restrictions to Protect the
residents of the area, the proposed use would not be
detrimental to the neiahborhood.
• Mr. Sharac concur.-red with the findings of the Chairman
and Mr. Brandt.
The following conditions were imposed:
1. sixty evergreen trees , eight feet on center, shall be
planted along t_ie front boundary.
2. A stockade fenc(, shall be erected around the work area
and shall be properly maintained until such time as the
evergreen trees have grown to a height and circumference
sufficient to s'rield the operation from the view of
Ipassers-by.

3. If a sign is erected , it shall be limited to one that

repair shop, bu..- shall be tastefully designed and un-
lighted.

Section 5.3 -Accessory Uses. Any use which is accessory to a principal use allowed by right-shall
be allowed only in connection with such allowed principal use. An use hich is accessory to a

shall require cessation of any accessory use which is not otherwise allowed as a principal use. The
Building Commissioner shall be responsible for determining what uses are principal, and what uses
are accessory. The following shall be limitations on certain specific accessory uses:
1. The keeping of farm animals, to include all farm animals and exotics, and a related private
stable, for personal use, is permitted as an accessory use in accordance with the following
conditions:
A. The minimum acreage required for keeping any farm or exotic animal, except as
described below, shall be 30,000 square feet for the first animal and 15,000 square feet
for each additional such animal. Animals under six (6) months not to be counted for
acreage requirements.
B. The minimum acreage required for keeping sheep, goats, llama, rabbits, or poultry,
except as allowed under household pets, shall be 30,000 square feet for up to three
animals and 10,000 square feet for each additional such animal. Animals under six (6)
months not to be counted for acreage requirements. (The requirements for these animals
are less stringent then other farm animals because these animals have less environmental
impacts.)
C. The location of any stable shall be not less that one hundred (100) feet from any street
lot line, and not less than thirty(30) feet from any other lot line.
D. There must be adequate fencing to contain all farm animals at least twenty(20) feet from
all property boundaries at all times, except when animals are being directly supervised
by and under control of a person.
E. Stables, corrals and yards shall be properly drained and reasonably free from excessive
odor, dust, and mud, so as not to create a nuisance or health hazard to the community or
to surrounding property owners, from an air or drainage pollution standpoint.
Maintenance of the stable and property used in the keeping of animals shall conform to
all health and wetland regulations.
F. Horses, ponies, llamas and sheep may be kept for personal use without being accessory
to any other use, otherwise in accordance with this section and section 5.2.
2. The keeping of the household pets, for personal use, is permitted as an accessory use for
animals commonly considered household pets including dogs, cats, fish, and birds (parrots,
parakeets, doves, pigeons, etc.), six or fewer rabbits, and three or fewer ducks or hens.

At a meeting conducted on January 4 , 1995, the Northampton Zoning
Board of Appeals unanimously voted 3 : 0 to GRANT the request of
THOMAS R. AND PEGGY PEASE for a FINDING under the provisions of
Section 9 . 3 in the Northampton Zoning Ordinance, to allow an
expansion of a pre-existing non-conforming use with the
construction of a 26' X 28' addition at 130 Spring Street,
Florence.
Zoning Board Members present and voting were: Vice Chair M.
Sanford Weil, Jr. , Member Alex Ghiselin, and Associate Member
William Brandt.
The Findings of the Board under Section 9 .3 for an expansion of a
pre-existing non-conforming use were as follows:
1. The Board found that the expansion will not be substantially
more detrimental to the neighborhood than the existing non-
conforming use because the expansion consists of squaring
off the building and will not create .,any new violations of
the existing setbacks, and will move the sandblasting
portion of the business into an enclosed structure, instead
of in the outdoors.
Conditions imposed with this Finding are as follows:
1. The conditions imposed on the original Special Permit to
construct the building and have the use, use will remain in
effect with this Finding permit.

Vice-Chair Weil opened the Public Hearing on the request of the
Thomas and Peggy Pease for a Finding under §9 . 3 of the Zoning
Ordinance to construct a 26' X 28' addition to a pre-existing non-
conforming structure in a residential district at 130 Spring
Street, Florence. Present and sitting on the case were: Vice
Chair M. Sanford Weil, Jr. , Associate Member William R. Brandt, and
Member Alex Ghiselin. A Legal Notice of this public hearing was
published in the Daily Hampshire Gazette on December 21, 1994 and
December 28, 1994 . Vice Chair Weil reviewed procedures for
conducting public hearings. Paulette Kuzdeba said that the DPW had
responded with no concerns on the proposal.
Peggy Pease was present to discuss the application. She said that
she and her husband had built the building 10 years ago and had
never finished it due to budget constraints. The request is now to
finish the building which will square off the structure. The
addition will be used for body shop work and sand-blasting work
which needs to be done in an enclosed area.
Paulette Kuzdeba informed the Board that the use was originally
permitted with a Special Permit and that this portion had been
approved, but never constructed.
Bill Brandt moved to close the Public Hearing. Alex Ghiselin
seconded the motion which passed unanimously 3 : 0.
Bill Brandt moved to approve the requested Finding since the
addition to the pre-existing, nonconforming structure will not be
substantially more detrimental to the neighborhood than the
existing structure with the following condition:
1. The conditions imposed on the original Special Permit to
construct the building will remain in effect with this Finding
permit.
Alex Ghiselin seconded the motion which passed unanimously 3 : 0.
