Dear Members of the Commission:
Tighe & Bond is pleased to provide two (2) copies of a Notice of Intent (NOI) for Northwood
Development, LLC’s Notice of Intent for continued work at 15 Atwood Drive, Northampton,
Massachusetts, for the Commission’s review. The Project includes the phased redevelopment
of the former Clarion Hotel property, which falls within the Commission’s jurisdiction under
both the Massachusetts Wetlands Protection Act (MAWPA) and the City of Northampton’s
Wetlands Protection Ordinance (Chapter 337).
The Project was previously reviewed by the Commission and Department of Environmental
Protection (MassDEP) under File No #246-0674. An Order of Conditions (OOC) was issued
by the Commission for File No. 246-0674 on November 14, 2013. A one-year extension to
the OOC was granted in 2016, and an Amended OOC was issued on August 4, 2017. The
Project also received a Stormwater Management Permit from the Northampton Department
of Public Works. Construction started in fall of 2017 and is on-going as of the date of this
application. The OOC expired in August 2019. As such, this new Notice of Intent is being
submitted to the Commission for authorization to continue work within regulatory wetland
buffer zones.
Work associated with the Project will occur within the limits of Bordering Land Subject to
Flooding (BLSF), as well as the 100-foot Buffer Zone to Bordering Vegetated Wetlands (BVW)
and the City’s 40-foot Buffer Zone to BLSF. As described in the NOI and supporting
documents, the proposed Project meets all applicable stormwater management and general
performance standards.

Introduction
This Notice of Intent (NOI) is being submitted on behalf of Northwood Development, LLC
for the Northwood Development II Project located at 15 Atwood Drive in Northampton,
Hampshire County, Massachusetts. The project will result in the alteration of Areas
Subject to Protection and Jurisdiction under the Massachusetts Wetlands Protection Act
(MAWPA; MGL c. 131 § 40) and the City of Northampton Wetlands Protection Bylaw
(Chapter 337) including Bordering Land Subject to Flooding (BLSF) and the 100-foot
Buffer Zone to Bordering Vegetated Wetlands (BVW).
1.1 Project Background and Purpose
This NOI was developed to permit the construction of a multi-story office building, parking
areas and project appurtenances of the Northwood Development II Project. The
Northwood Development II Project was previously authorized under the Order of
Conditions (OOC; MassDEP File #: 246-0674) issued on November 14, 2013. The
Northampton Conservation Commission granted a one-year extension in 2016 and issued
an Amended OOC on August 4, 2017. The Amended OOC lapsed in August 2019;
therefore, we are submitting this NOI to complete the remaining proposed activities,
including the construction of the second office building, expansion of the parking lot and
portions of the stormwater management systems to support the development.

Existing Conditions
2.1 General
The project area is located at 15 Atwood Drive in Northampton, Hampshire County,
Massachusetts. The property is bordered by Mount Tom Road/Route 5 to the east, the
Interstate 91 ramps for Exit 18 to the north, the northbound travel lanes of Interstate 91
to the west, and the Northwood Development (MassDEP File #246-645) to the south. The
parcel, as summarized in Table 2-1, occupies 2.78 acres of land. The parcel is also
identified by the municipal identification number on the project drawings.

The project area consists of land that was historically occupied by the Clarion Hotel and
Conference Center, considered the pre-existing condition. As shown in the
orthophotograph (see Figure 3 in Appendix A), site work has commenced as of the date
of the image (2018) and includes development of the Hampshire County District
Courthouse and associated parking, which is considered the existing condition. Under
pre-existing conditions, approximately 6.89 acres, or 88%, of the 7.79 acre project area
was previously developed and/or disturbed. Photographs of the project area are provided
in Appendix B.
2.2 Methodology of Resource Area Investigations
Wetland scientists from Tighe & Bond conducted an updated evaluation of wetland
resource areas on September 8, 2019. Jurisdictional wetland resource areas in the vicinity
of the proposed activities were delineated in accordance with local, state, and federal
guidelines including the MAWPA, Delineating Bordering Vegetated Wetlands under the MA
Wetlands Protection Act (1995), the 1987 Corps of Engineers Wetlands Delineation
Manual, the Regional Supplement to the Corps of Engineers Wetlands Delineation Manual:
Northcentral and Northeast Region (January 2012). Wetland flags were located in the
field with a Global Positioning System (GPS) unit with sub-meter accuracy. Available
mapping was also reviewed during this phase of the project. A description of jurisdictional
wetland resource areas follows.
2.3 Description of MAWPA Wetland Resource Areas
A review of the site and available mapping results in the conclusion that two types of
wetland resource areas are present in the general area. These include Bordering
Vegetated Wetland (BVW) and Bordering Land Subject to Flooding (BLSF). More detailed
descriptions are provided in the following sections.

2.3.1 Bordering Vegetated Wetland
Tighe & Bond placed alpha-numeric flags 1A-1 through 1A-26 and 1B-1 through 1B-6 to
demarcate the boundary of a Bordering Vegetated Wetland (BVW) to the west and north,
respectively of the proposed activities.
The boundary of this BVW was mostly defined by a discrete change in topography, as well
as changes in the plant community and other indicators of hydrology. Typical dominant
vegetation observed included false nettle (Boehmeria cylindrica; OBL), silver maple (Acer
saccharinum; FACW), jewelweed (Impatiens capensis; FACW), narrowleaf goldenrod
(Euthamia graminifolia; FAC) and sensitive fern (Onoclea sensibilis; FACW). Other species
observed included silky dogwood (Cornus amomum; FACW), honeysuckle (Lonicera spp),
Oriental bittersweet (Celastrus orbiculatus), ash (Fraxinus spp), and poison ivy
(Toxicodendron radicans; FAC).
The 100-foot Buffer Zone associated with this area is shown on the project drawings. It
consists mainly of paved parking lots, maintained lawn, and vegetated areas that were
previously disturbed. Typical vegetation observed included eastern cottonwood (Populus
deltoides), black locust (Robinia pseudoacacia), stinging nettle (Urtica dioica), grape vines
(Vitis spp), night shade (Solanum spp), Virgina creeper (Parthenocissus quinquefolia),
pokeweed (Phytolacca americana), and jewelweed.
2.3.2 Bordering Land Subject to Flooding
The project area is situated within the limits of 100-year flooding, which is identified as
elevation 123 feet National Geodetic Vertical Datum (NGVD) 1929 in the flood profiles
prepared by the Federal Emergency Management Act (FEMA) and presented in the Flood
Insurance Study (FIS) for the City of Northampton dated November 1976. This elevation
was converted to the NGVD 1988 coordinate system to match the survey used to develop
the Site Plans. This elevation is 122.33 feet, and is highlighted on the project plans.
Within the project area, the limits of BLSF extend across the entire site from west to east,
and north to south up to just outside the exterior walls of the existing building on its south,
west and north faces. The 122.33-foot contour then extends to the north property line
and trails off to the south toward Atwood Drive.
The areas of BLSF within the project area primarily consist of areas previously developed
as the Clarion Hotel, as well as the Courthouse and associated parking areas currently
constructed.
2.4 Rare Species
According to the Massachusetts Natural Heritage and Endangered Species Program
(NHESP) Atlas (14th edition, dated February 1, 2017) and MassGIS data (October 2008),
the project area is not within the limits of mapped Estimated Habitats of Rare Wildlife and
Priority Habitats for Rare Species. The limits of mapped rare species habitat are shown
on Figure 2 in Appendix A.

Section 3
Project Description
3.1 Proposed Activities
The proposed project consists of the redevelopment of parcel# 39-043-001 for the
construction of a four-story office building, associated parking lot, utility and stormwater
management infrastructure and site appurtenances. Construction of the Hampshire
County Probate and Family Courthouse was completed in late 2018. The proposed 18,000
square foot office building will lie directly west of the courthouse and will expand upon the
parking and stormwater infrastructure currently in place. The proposed parking lot will
follow the landscape design of the existing parking lot and seeks to add 128 new parking
spaces, including 2 van-accessible handicapped spaces. The existing cul-de-sac in the
southwest portion of the site will be repaved and extended to allow for a driveway leading
behind the proposed building for access to loading docks and additional parking.
Since the majority of the site is within the 100-year floodplain (i.e. Bordering Land Subject
to Flooding; BLSF), compensatory flood storage has been incorporated into the design. To
date, two infiltration basins and two bioretention basins have been installed to receive the
conveyance of stormwater from the grassed channels, catch basins, manholes and piping.
The project will require additional stormwater infrastructure to adequately support the
runoff associated with increased impervious surfaces. The proposed stormwater
infrastructure includes installing additional grassed channels, catch basins, manholes and
piping to the currently existing bioretention and infiltration basins.
The site will be graded to create the storage capacity needed at each elevation to replace
any filled volume within land subject to flooding at the same elevations. Therefore, there
will be no increase in the horizontal extent and level of flood waters during peak flows and
no decrease in the site’s flood storage capacity. The proposed compensatory flood storage
is achieved within the footprint of proposed Northwood Development II project, including
both what has been constructed and what is proposed under this application. The provided
storage will have an unrestricted hydraulic connection to the source of floodwaters. The
buildings will be constructed with the finished floor above the 100-year flood elevation of
122.33 feet. Refer to Table 4-1 for a detailed description of compensatory storage
calculations.
In order to meet the originally permitted design of the stormwater management system,
modifications to the currently constructed stormwater management system are required.
Modifications include additional excavation of the infiltration basin and bioretention basins
to provide the required storage and treatment volumes, the installation of sediment
indicator posts in all stormwater management basins and adjustments to the storm
drainage pipe network to correct pipe diameter and invert inconsistencies. All proposed
work is indicated on the Permit Drawings provided in Appendix A.
The stormwater Management has been designed in accordance with the Massachusetts
Stormwater Management regulations set forth at 310 CMR 10.05(6)(k). Refer to Section
4.2 of this NOI and the Stormwater Report for a more detailed discussion of stormwater
management. In general terms, the mitigation of stormwater impacts includes the use of
deep-sump, hooded catch basins and drainage manholes within the impervious area,
proprietary water quality units, vegetated bioretention areas (i.e. rain gardens) and an

infiltration basin. A Stormwater Checklist and Report have been prepared and provided
under separate cover.
3.2 Construction BMPs
The following Best Management Practices (BMPs) will be implemented during construction
to minimize the potential for erosion and sedimentation of wetland resource areas. The
locations of BMPs are shown on the project drawings. Further, since the proposed
activities involve the cumulative disturbance of more than one (1) acre of land, the project
is required to prepare a Storm Water Pollution Prevention Plan (SWPPP) and obtain
coverage under the National Pollution Discharge Elimination Program (NPDES) 2017
Construction General Permit (CGP). The SWPPP and CGP coverage are discussed in further
detail in the Stormwater Report, which has been provided under separate cover.
3.2.1 Erosion and Sedimentation Controls
Hay bale and siltation fence and/or straw wattle barriers will be installed at the proposed
limits of work and placed in a fashion that restricts the contractor(s) to the areas necessary
to conduct the work. The locations of these barriers are shown on the project drawings.
Typical details are also provided on the project drawings. In addition:
• The contractor(s) will be required to maintain a reserve supply of hay bales on-site
to make repairs, as necessary.
• On-site protective measures will be inspected after significant precipitation events.
Maintenance and repairs will be conducted, as necessary.
3.2.2 Temporary Stormwater Controls
Since only minor earth disturbing activities are proposed, it is not anticipated that any
temporary stormwater controls will be necessary throughout construction.
3.2.3 Site Stabilization
Upon completion of construction activities, disturbed unpaved areas will be loamed and
seeded with an appropriate seed mix. Seeded areas will be mulched with a light layer of
hay or straw that will not exceed one inch in thickness.

Regulatory Compliance
This section summarizes the Project’s relationship to, and compliance with the MAWPA
and regulations and the City of Northampton Wetlands Protection Ordinance and
regulations, as well as other pertinent state and federal regulations.
4.1 MA Wetlands Protection Act
4.1.1 Summary of Jurisdictional Activities
Activities associated with the proposed Project are situated within the limits of Bordering
Land Subject to Flooding (BLSF). The proposed Project will result in the cumulative
disturbance of approximately 175,838 square feet (approximately 4.0 acres) of BLSF. A
discussion of the proposed activities relative to the BLSF General Performance Standards
is presented in Section 4.1.2 of this NOI.
In addition to work within BLSF, approximately 79,930 square feet of work at the west
end of the project area will also occur within the 100-foot Buffer Zone of BVW. The Buffer
Zone at this location is situated entirely within the limits of BLSF. As such, the footprint
of work in the Buffer Zone is not in addition to the footprint of work in BLSF.
4.1.2 MAWPA Performance Standards Compliance
4.1.2.1 Bordering Land Subject to Flooding
The Performance Standards for Bordering Land Subject to Flooding are set forth at 310
CMR 10.57(4)(a). The MAWPA performance standards are provided below in Italics, while
a discussion of the project’s compliance with each of the performance standards follows
in plain font.
1. Compensatory flood storage shall be provided for all flood storage volume that will be
lost as the result of a proposed project within Bordering Land Subject to Flooding,
when in the judgment of the issuing authority said loss will cause an increase or will
contribute incrementally to an increase in the horizontal extent and level of flood water
during peak flows.
Compensatory flood storage shall mean a volume not previously used for flood storage
and shall be incrementally equal to the theoretical volume of flood water at each
elevation, up to and including the 100-year flood elevation, which would be displaced
by the proposed project. Such compensatory volume shall have an unrestricted
hydraulic connection to the same waterway or water body. Further, with respect to
waterways, such compensatory volume shall be provided within the same reach of the
river, stream or creek.
As noted above, the proposed project will result in approximately 175,838 square feet of
work in BLSF due to the construction of the 18,000 square foot building, associated parking
areas and stormwater management infrastructure. Compensatory flood storage will be
provided through strategic grading (i.e. cut and fill) within the footprint of proposed work
associated with the construction of the buildings and parking areas.

Compensatory flood storage volumes were determined using the average-end method for
each elevation within the proposed limits of work as indicated on the project plans. The
volume of fill (e.g. earth, solid structures) above each elevation within the entire site is
shown in Table 4-1 for both existing and proposed conditions, and is cumulative. The
values shown in the Net Difference column are incremental on a foot-by-foot basis as
required per the regulations.
As shown in Table 4-1, the proposed project will result in an approximately 191,535 cubic
foot (7,094 cubic yard) increase in flood storage capacity, which exceeds the minimum
requirements of the performance standard. Further, there is a net increase at each
incremental elevation. The proposed compensatory flood storage is achieved within the
footprint of proposed development and, as such, will have an unrestricted hydraulic
connection to the source of floodwaters. Based on the proposed design, this performance
standard has been satisfied.

2. Work within Bordering Land Subject to Flooding, including work required to provide
the above-specified compensatory flood storage, shall not restrict flows so as to cause
an increase in flood stage or velocity.

As shown on the project plans, neither the proposed buildings, stormwater management
facilities nor the proposed compensatory flood storage will restrict flows or otherwise
cause in increase in flood stage or velocity. As such, this performance standard has been
satisfied.
3. Work in those portions of bordering land subject to flooding found to be significant to
the protection of wildlife habitat shall not impair its capacity to provide important
wildlife habitat functions. Except for work which would adversely affect vernal pool
habitat, a project or projects on a single lot, for which Notice(s) of Intent is filed on or
after November 1, 1987, that (cumulatively) alter(s) up to 10% or 5,000 square feet
(whichever is less) of land in this resource area found to be significant to the protection
of wildlife habitat, shall not be deemed to impair its capacity to provide important
wildlife habitat functions. Additional alterations beyond the threshold, or altering
vernal pool habitat, may be permitted if they will have no adverse effects on wildlife
habitat, as determined by procedures contained in 310 CMR 10.60.
As previously noted, the proposed project will result in approximately 175,838 square feet
of alteration of BLSF. Of this 175,838 square feet, approximately 204,627 square feet
consists of land that has been altered by human activity that their important wildlife
habitat functions have been effectively eliminated. Per 310 CMR 10.57(1)(a)3, these
areas include paved and graveled areas, buildings, lawns, gardens and roadways.
Approximately 3,166 square feet of work is proposed within areas of BLSF that have not
been recently altered by human activity. These areas are located at the west end of the
project, between the existing tree line and proposed limits of work. Because the proposed
alteration of “undisturbed” floodplain that has retained its wildlife habitat functions and
value is less than the Wildlife Habitat Evaluation threshold of 5,000 square feet, an
evaluation is not required.
4.1.3 Abutter Notification
Abutters were notified in accordance with the MAWPA. A copy of the list of abutters
provided by Mr. James Thompson of the Northampton GIS Department and the abutter
notification form are provided in Appendix C. The USPS Certificates of Mailing log book
pages will be submitted to the Northampton Conservation Commission. An Affidavit of
Service under the MAWPA is provided in Appendix C.
4.1.4 Stormwater Management
The stormwater impact resulting from an increase of impervious surface area has been
mitigated by design and use of Best Management Practices (BMPs) in accordance with the
Massachusetts Stormwater Management regulations and the Northampton Stormwater
Management Ordinance. The mitigation of stormwater impacts includes the use of deep
sump hooded catch basins, grassed channels, proprietary water quality units, vegetated
bioretention areas, and an infiltration basin with outlet control structure.
A Stormwater Checklist and detailed Stormwater Report have been prepared and are
provided under separate cover with this NOI.
4.2 Northampton Wetlands Protection Ordinance
In addition to areas subject to jurisdiction under the MAWPA and regulations, the proposed
project is also subject to the provisions of Northampton’s Wetlands Protection Ordinance
(Chapter 337).

4.2.1 40-foot Buffer Zone to BLSF
In addition to work within the limits of Bordering Land Subject to Flooding (BLSF), the
proposed project will also result in approximately 430 square feet of work within the locally
established 40-foot Buffer Zone to BLSF. The limits of the 40-foot Buffer Zone are shown
on the project drawings.
4.2.2 No Encroachment Zone
As noted on Sheet 2 of the project plans, the subject site is zoned General Business. As
such, per Section 337-10 there is a 10-foot No Encroachment Zone associated with the
BVW at the west end of the proposed project area. This area is shown on the project
plans. No work is proposed in the No Encroachment Zone.
4.2.3 Abutter Notification
Abutters were notified in accordance with the MAWPA (see Section 4.1.3) and Section
337-6(A) of the City’s Wetlands Protection Ordinance. A copy of the list of abutters from
Mr. James Thompson of the Northampton GIS Department, the City’s abutter notification
form, and the City’s Affidavit of Service are provided in Appendix C. The USPS Certificates
of Mailing log book pages will be submitted to the Northampton Conservation Commission.
4.3 Other Pertinent Local, State and Federal Approvals
4.3.1 Northampton Planning Board
The proposed project is subject to a Stormwater Management Permit through the
Northampton Department of Public Works. No modifications to previously issued land use
approvals through the Northampton Planning Board are anticipated as the decision on the
previous Site Plan Review approval is valid as of the date of this application.
4.3.2 Northampton Department of Public Works
The proposed project is also subject to Stormwater Permit review by the Northampton
Department of Public Works (DPW). A Stormwater Report has been prepared and
submitted with the appropriate applications and fees.
4.3.3 MEPA
The Project underwent review by the Massachusetts Environmental Policy Act (MEPA) in
October 2013 due to the anticipated increase in traffic on Atwood Drive (i.e. the roadway
providing access to a single location). On November 8, 2013, the Secretary of Energy and
Environmental Affairs issued a Certificate on the Environmental Notification Form stating
that no further MEPA review was required for the Project. The modifications outlined in
the 2016 Request for Amended OOC did not require further review through a MEPA Notice
of Project Change (NPC) as no thresholds at 301 CMR 11.10 were met. The Project also
does not require a NPC for lapse of time per 301 CMR 11.10(2) as construction has
commenced.
4.3.4 NPDES Construction General Permit
Construction activities will result in the cumulative disturbance of one (1) or more acres
of land. Work at the site is currently being conducted in accordance with a Stormwater
Pollution Prevention Plan (SWPPP) approved by the EPA under the NPDES Construction
General Permit (CGP) for Construction Period Discharge. An updated eNOI will be

submitted in accordance with the 2017 CGP for ongoing activities; the revised SWPPP will
be prepared and kept at the site during construction.
