32 Masonic St - Immerman Sign Carson Poe 32 Masonic St., #4 Northampton, MA 01060 Re: Immerman sign October 3, 2019 Dear Mr. Poe, I received your complaint about the old Immerman and Assoc sign at 32 Masonic St. You are correct, there is a provision in the zoning ordinance (350 - 7.2) calling for the removal of all old signs... 350-7.2 Q.  All signs, except for those authorized under § 350-7.2D, shall be removed within 30 days of the date from which they no longer serve their intended function (i.e., no longer provide the service, establishment or product being advertised) The responsibility for removing the sign falls upon the owner of the building defined as such (350 - 2.1)... OWNER The duly authorized agent, attorney, purchaser, devisee, trustee, lessee, or any person having vested or equitable interest in the use, structure or lot in question. However, after consulting with Louis Hasbrouck, Building Commissioner, we have determined that this ordinance has traditionally not been enforced in the city and we will not selectively enforce this complaint. You are welcome to appeal this decision though as follows. Massachusetts G.L. 40A, §§ 8 and 15 provide for appeals. The appeal must be taken within 30 days of this decision. An appeal under § 8 is made to the permit granting authority; in Northampton, the Zoning Board of Appeals.
