Gervais, called the meeting to order at 7:35 PM. Also present were Raymond Capers! and Robert Buscher, Associates, The Chairman noted that a public hearing had been held o'' September 12, 1979, on the request of Richard Kresconko, 267 forth Main Street, for a special permit to construct an addition tohis home to accommodate a photography studio. He read a letter from the applicant requesting permission to withdraw his petition. After discussion, the Board voted unanimously to allow tYe applicant to withdraw without prejudice. The meeting was adjourned at 7:40 PM. Allardice, Senior Planner SUBJECT: Special Permit - Richard Kresconko DATE: September 19, 1979 FILE: N334 At the regularly scheduled meeting of the Planning Board on September 13, 1979, the Board voted not to recommend approval of the application to allow the construction of a photography studio under a home service occupation % In reviewing the petition, the Board felt that the parki g Provided for this proposed studio is too extreme for the inte ded number of employees and the amount of anticipated customers, and the design will require backing onto a public way, which is Prohibited for all off - street parking. In addition, the conc for parking on a public street was also expressed, which would, be very hazardous to the public good. i Finally, in the definition of "home service occupation" i h is stated that a "studio or occupational room .... such use shall be conducted entirely within the dwelling, which is a bonafide resi- dence of the principal practitioner." As is shown in the plan attached to the petition, the studio will be built upon approv of the request, and will be attached to the dwelling. Therefo e, because of the off - street parking and design, and because this use cannot be considered a "home service occupation, the Board vot disapproval. Allardice, Senior Planner SUBJECT: Special Permit on Request of Richarc DATE: September 5, 1979 FILE: N344 The petitioner, Richard Kresconko, 267 North Main Stre 9t, is, applying for a special permit under Home Service Occupatior to allow him to have his photography studi6 at his home. Presently, the studio is located on Old South Street, and the petitioner wishes to build a studio attached to his house, because of increasing cost in renting. The petitioner is located in the URB district, in which Home Service Occu ati n is allowed by special permit from the Zoning Board of Appea s. In reviewing the applicable sections in the Zoning Ord - nance (Table of Use Regulations and Table of Off- Street Par ing Regulations) governing this petition, I cannot find negativ impact with respect to the following: 1. The studio which will be added to the existing hou e, as shown on the plan, conforms to minimum lot area frontage, and width, and front, side, and rear set acks. 2. Home Service Occupation which this type of use is considered to be by definition, is allowed in the cis - trict by special permit. 3. Paved parking will be provided, although there will be no employee increase if the petition is granted. Also, i there will be no increase in traffic, or density n population, as stated in item 9(5) of the petition.'. 4. The lot will be properly screened from the adjoinin residential lot by suitable planting, as shown on t e enclosed sketch. 5. Off - street lighting will not be required because the hours of operation will be between 9:00 AM and 5:00 Pm. 6. All other requirements for off - street parking areas have been met. Set forth reasons upon which application is based; 1. I would like to apply for approval to build a 22'x35' buildin; to the existing house at 267 North Main Street Florence. To house our present studio on Old South Street Northampton. To reduce over -head expences. 2. Rising cost of rent. We were notified that there will be a rent increase as of September 1, 19 79. Rising cost of heat. With the increase in oil prices it will cost us double to heat the present studio, because it is not well insulated. Electricity has already increased because the studio is not well insulated. It is costing more for air - conditioning needed to keep the studio cool for graphing. The operating cost continue to increase. hoto- de can not these costs on to our customers. If we do we will price ourse right out pass ves of business. 3. The general public has cut back on their non - necessities, which include photography. The would general public is saving to put gas in their cars and oil for their homes. 4. At the time of forming Kresconko Studio 12 years ago there were 5 other studios in operation in Northampton. Presently Kresconko'Studio is the only remaining. Others have closed completelyt, are operating out of their homes or have merged with larger studios in nearby cities. 5. Operation of studio in home would add very little traffic as the majority of photographs are taken now at other locations. Thec of in studio photographs are becoming a thing of the past being ncept replaced by on -site photos. such as in school yearbook work. All customers are handled by appointment only thereby limiting traffic arking to one car at a time on most occasions. Studio are 9: dT to 5 :00.
