PROPOSED SCHOOL ACCESS The access to the school will be modified by means of adding another driveway off of Bridge Road about 270 feet west of the existing main school driveway. This new driveway will provide access to new staff and visitor parking lots which will be constructed to the west of the existing school building. Much of the staff /employee �-- traffic which currently uses the Spring Grove Avenue access will be shifted to this rent drop -off and pick -up traffic will also use this new driveway. Almost all of the pa driveway, since a special parent drop- off /pick -up turn around is part of the parking lot design for the westerly site area. 1 t �- t 2 CA TRAFFIC IMPACT STATEMENT JFK MIDDLE SCHOOL EXPANSION NORTHAMPTON, MA OVERVIEW This traffic impact report discusses the traffic changes and impacts of renovations and additions to the JFK Middle School located on Bridge Road in Florence. It has been prepared in accordance with the Northampton Zoning Ordinance requirements for a traffic impact statement as part of the site plan review and approval process. The proposed project is for an expansion of the school building area to accommodate 900 students compared to the present enrollment of 540 students. The proposed building program is to accommodate three grades, grades 6, 7, and 8 city wide. The present facilities accommodate grades 7 and 8 city wide. The traffic analysis herein includes a discussion of the existing traffic conditions at the site and the traffic conditions after the proposed expansion, analysis of peak hour traffic operations at the school driveway intersections with Bridge Road, and comments on the on -site traffic circulation and parking. EXISTING SCHOOL ACCESS Presently, there are two driveways which serve the school site. The main driveway to the site is on Bridge Road opposite Beech Street. The secondary driveway to the school is located off of Spring Grove Avenue which is a neighborhood street located just east of the school. Buses currently enter the school via the Spring Grove Avenue driveway and exit the school by means of the main driveway on Bridge Road. Although there is currently a bus loop around the front of the school at the main entrance, buses have difficulty negotiating the loop when entering from Bridge Road due to the interference of cars parked along the outside curb of this loop. Accordingly, the predominant circulation pattern for buses that now takes place is to enter off of Spring Grove Avenue and exit the site onto Bridge Road. Figure A -1 shows the location of the school building and driveways in relation to the surrounding street system. EXISTING TRAFFIC VOLUMES The JFK Middle School starts at 7:55 AM and ends at 2:25 PM. Accordingly, traffic counts were conducted at both driveways to the school between the hours of 7:30 to 8:30 AM and 2:00 to 3:00 PM. These counts were conducted at the school driveway intersections with Bridge Road and Spring Grove Avenue. They consisted of manually School buses will no longer access the school property via Spring Grove Avenue. They will enter and exit the main driveway located off Bridge Road. A new large bus loading /drop -off loop will be constructed in front of the school to the west of the present main driveway. The site plan (submitted separately) shows more details of this bus loop design. The driveway access to Spring Grove Avenue will remain open but its traffic use should significantly be reduced during school times. This driveway will primarily serve employee parking that will be retained at marked spaces on the southeast and east of the building. It will also serve occasional deliveries made to the existing service area at the east side of the existing school building. PROJECTED SCHOOL TRAFFIC VOLUMES Estimates were made of the driveway traffic with the school renovations and expansion based on the student population increase from 540 students to 900 students. School buses, vans, and student drop -offs and pick -ups by the parent vehicles were projected on the basis of the student increase. Staff and employee traffic for the school was increased in proportion to the estimate of increased staff. Table 2 indicates the estimated driveway traffic for the projected build condition at the school. As indicated, it estimates a total traffic volume between 7:30 to 8:30 AM of 457 vehicles. The total traffic volume for the school between 2:00 and 3:00 PM is estimated at 214 vehicles. It has been estimated based on the counts that the traffic is approximately equally split in terms of its orientation east and west coming into the site. Currently, that driveway handles about 40 percent (117 vehicles) of the total school traffic counted between 7:30 and 8:30 AM. With the renovation and relocation of access and parking areas for the expanded middle school site, there is expected to be A significant reduction in school traffic use on this driveway off of Spring Grove Avenue. It is expected to decrease to about 5 percent of the total site traffic during the morning peak hour. In the afternoon between 2:00 and 3:00 PM, there will also be a proportional decrease in traffic using this driveway. Overall, the proposed access plan and parking lot relocations will have a beneficial impact on the Spring Grove Avenue access to the site. The fact that a large new parking facility will be constructed to the west of the building area and close to the playing fields will also have a beneficial impact on reducing the traffic that is using the Spring Grove Avenue driveway now during non - school times, particularly on weekends and weeknights during baseball, softball, and soccer playing times. Although access to the site will still be allowed via the Spring Grove Avenue driveway, the availability of much more additional on -site parking in close proximity to the playing fields will have a positive impact on improving the parking situation as it presently occurs during weekend recreational events at the site. ON -SITE TRAFFIC CIRCULATION The proposed site plan includes a revised bus circulation loop. The plan provides a separate one -way loop for bus unloading and loading of students. The proposed design will provide a safe and efficient access for buses and will separate bus traffic from other vehicular traffic during bus utilization times. The bus loop in front of the building will provide adequate storage for at least 11 buses along the outside curbside plus additional curbside loading adjacent to the loop on the existing site driveway if needed for special occasions. The loop road is proposed to be 32 feet in width which will provide adequate width for bus circulation. Traffic circulation to and from the parent drop -off area on the west side of the proposed building addition will be efficient for private vehicle drop-off of students. This area is separated from any bus traffic and will be used in conjunction with visitor and staff parking. A drop -off loop is proposed whereby parents will be able to easily recirculate to exit the site driveway. 5 IN Driveway widths appear adequate for safe and efficient vehicular movement. It is recommended that the driveway to the new westerly parking lot (new site access) be widened in order to allow for two exit lanes at Bridge Road in order to separate left turn and right turn vehicles. A minimum of 20 feet is suggested at the exit to this driveway, if possible. Truck access for receiving and maintenance at the easterly service area of the building Will be improved over existing conditions. Present curbside parking interferes with the ability of trucks such as garbage trucks to easily maneuver through the parking lot school hours areas. Elimination of curbside improved circulation area for larger provision vehicles at the east `- parking spaces will allow p end of the site. PARKING Typical parking rates were reviewed based on Institute of Transportation Engineers standards and other parking guidelines in an effort to independently assess the adequacy of the parkin provided for the expanded site. Based on typical parking rates for middle school?unior high facilities, it is estimated that around 126 parking spaces should be provided for staff /employee, parent pick -up, and visitor parking during school times. In addition, the use of the cafetorium with 417 seats as proposed suggests providing about 139 parking spaces for that use. It should be noted that curbside parking is possible around the bus loop and the adjacent east side of the main driveway if required for special evening events. More than 40 additional vehicles can be accommodated in this manner. Parking .signage and pavement markings relative to parking restrictions in the bus loop area are indicated in figures appended to this report. PEDESTRIAN ACCESS Access to the school for walkers will remain essentially as it is with the present facilities. There will be a marked crosswalk on Bridge Road at Beech Street which will serve those walkers using the existing sidewalk that runs along the south side of Bridge Road. The existing sidewalks along the east and west sides of the main school driveway will be F y retained and provide good pedestrian access to the existing school entry and the new sidewalk area connecting to the new lobby area to the west. Crosswalk lines should be painted across the bus driveway (loop) entrance and exit connecting the sidewalks on the west edge of the main driveway. Consideration should be given to adding a sidewalk in the northeast corner of the service area along the edge of the curb in that section between the driveway from Spring Grove Avenue and the existing bike storage area. This could provide a safer path for children walking to/from the recreation fields and tennis courts from the Spring Grove Avenue neighborhood. CONCLUSIONS Based on the analysis of projected traffic conditions and review of the proposed site plan, it is concluded that the proposed school expansion can be accommodated with a minimal impact to traffic on the adjacent street system. Traffic access and on -site vehicular circulation will be improved by the separation of bus traffic and parent pick -up and drop -off areas. There will be a safe and efficient bus loading and unloading area provided by the bus loop to be constructed in the front of the new building addition. The new driveway on Bridge Road to be located approximately 270 feet west of the existing main driveway will have excellent sight distance and serve to reduce traffic on Spring Grove Avenue by providing improved access and parking for the school staff, parent drop -off and pick -ups, and activities associated with the outdoor recreational area behind the school. The arrangement and supply of parking spaces is more than adequate for the proposed school building facilities and staff. Recommendations for traffic control signage and parking restriction signs are contained in the appendix to this report. In reviewing the site Plan, submitted with the Special Permit the Planning Board: 1. Voted 7 -0 to recommend approval of the Special Permits, since no waivers had been requested. -2- Conditions imposed upon the project are as follows: 1. All construction, landscaping and drainage work shall conform to all plans submitted with the application and referenced below, except as amended by the conditions within this permit. All trash and shall be picked up - and disposed of properly. -3- U ATTACSMENT A BITE PLAN APPROVAL - SPECIAL PERMIT CRITERIA for an: Addition to the J.F. Kennedy Middle School In Granting the Special Permit for SITE PLAN APPROVAL, the Zoning Board of Appeals found that the requested use meets all special regulations set forth in the Zoning Ordinance in Sections 10.11 (6) and 10.11 (7). In conducting the Site Plan - Special Permit review, the Zoning Board of Appeals found plans and supporting information submitted with the application under Section 10.6 demonstrated that: A. Adjoining premises were protected against seriously detrimental uses by providing the following: * surface water drainage with updated drainage structures; * sound and sight buffers through landscaping; and * preservation of views, light and air, through the design and layout of the proposed project. B. Convenience and safety of vehicular and pedestrian movement within the site and on adjacent streets has been accomplished. Traffic impacts on the streets, roads and highways in the area have been minimized. The location of driveways openings, in relation to traffic and access by emergency vehicles to adjacent streets has been accomplished, with the redesign of the parking areas and bus circulation pattern and the substantial increase of parking spaces provided on the site. C. The arrangement of parking and loading spaces, in relation to the proposed use of the premises, is adequate and has been upgraded with the proposed plans. D. As shown on plans and information submitted, the relationship of structures and open spaces to the natural landscape, existing buildings, and other community* assets in the area, are acceptable. Additionally, the plans and information were found to be in compliance with other requirements of the ordinance. E. Adverse impacts on the City's resources including the City's water supply and distribution system, sewage collection and treatment systems, fire protection, and streets have been minimized with the re- design of the traffic patterns, update of the drainage system and improved water system. -4- F. The project has demonstrated compliance with the technical performance standards listed in Section 10.11(7). In conducting the Site Plan - Special Permit review of Technical Performance Standards under Section 10.7, the Zoning Board of Appeals found that the plans and supporting information submitted with the application demonstrated that the following Technical Performance Standards were met: A. Curb cuts onto streets have been minimized. B. Pedestrian, bicycle and vehicular traffic movement have been separated to the best extent possible. C. There will be no increase in peak flows from the one (1) or two (2) and ten (10) year Soil Conservation Service design storm from pre - development conditions. Runoff from a 4/10 inch rain storm (the first flush) is detained on site for an average of six hours. Additionally,. catch basins have incorporated sumps of a minimum of three feet. -5- ATTACHMENT B WATERSHED PROTECTION DISTRICT for an: Addition to the J.F. Kennedy SPECIAL PERMIT Middle School In Granting the WATERSHED PROTECTION DISTRICT SPECIAL PERMIT, the Zoning Board of Appeals found that the requested use meets all special regulations set forth in the Zoning Ordinance, specifically Section 14.5. In making this decision, the Zoning Board of found: 1. The plan submitted: * Does show the elevation above mean sea level of the basement, first floor, ground elevation and the 100 year flood level; * documents how the project complies with all of the criteria of Section 14.6 of the Zoning Ordinance. 2. That neither certification from a registered professional engineer or architect stating the building is designed, constructed and anchored to prevent flotation, collapse or lateral movement during flooding, nor documentation that the building will be wet flood proofed as per requirements of the state Building code, is required since the site is not located within the 100 year flood zone. 3. That the applicant was not required to submit a site plan at the required scale of 1" =40', because the entire project is located outside of the 100 year floodplain. 4. That the applicant has submitted a statement that lists other permits or approvals which are required and /or have been obtained from State and Federal Agencies. 5. That the applicant has submitted data from the Federal Flood Insurance Maps and /or alternate sources in order to determine the base flood elevations of the site. This information indicated that the site and proposed work is not. located within the 100 year floodplain. -6- ATTACHMENT C WATERSHED PROTECTION DISTRICT SPECIAL PERMIT Additional Requirements for an: Addition to the J.F. Kennedy Middle School In Granting the WATERSHED PROTECTION DISTRICT SPECIAL PERMIT, the Zoning Board of Appeals found that the requested use meets all special regulations set forth in the Zoning Ordinance, specifically section 14.6. 1. That the lot is served by an existing public water system that was designed to minimize or eliminate infiltration of flood waters into the system. 2: That the lot is served by an existing public sewerage system that is designed to minimize or eliminate infiltration of floodwaters into the system. 3. The lot is not serviced by an existing on -lot septic system. Therefore, the construction as proposed will not affect any septic system because it is to be connected to the existing sanitary sewer system. 4. That the applicant has demonstrated that the lowest floor elevation is located above the 100 year flood elevation. 5. a. Since the proposed work is not located within a f loodplain, there is no need to demonstrate that all utilities other than water and sewerage would be located and constructed to minimize or eliminate flood damage. b. That adequate methods to provide for the periodic disposal of sewerage, refuse and other wastes resulting from the uses permitted on the site have been provided by the applicant, through plans and information submitted with the Special Permit applications. That provisions for adequate drainage plans, which minimize flood damage, have been complied with by obtaining an Order of Conditions from the Conservation Commission for work in and around wetland resource areas and the approval of the engineered design of the detention basin. -7- c. That the applicant has obtained approval from the Fire Department and the Department of Public Works which insures that the gas, electricity, fuel and other utilities are protected from breakage, leakage, short circuiting, or other malfunctions. That the applicant has submitted engineered plans and calculations which shown that the project will not: obstruct or divert flood flow; substantially reduce the natural floodwater storage capacity or increase stormwater runoff velocity so that water levels on other land are substantially raised or the danger of flooding increased. The applicant has also obtained approval for work in and around wetland resource areas, from the Conservation Commission. 6. That because the site is not located within the 100 year flood plain, the applicant did not need to demonstrate that safe vehicular and pedestrian movement to, over and from the premises has been provided and that all roads and driveways have been proposed to be at or near grade. -8- - %1__ ATTACMCUM D WATER SUPPLY PROTECTION DISTRICT SPECIAL PERMIT for an: Addition to the J.F. Kennedy Middle School In Granting the WATER SUPPLY PROTECTION DISTRICT SPECIAL PERMIT, the Zoning Board of Appeals found that the requested use meets all special regulations set forth in the Zoning ordinance, specifically Section 16.7 (C) (1) (a -e) - Uses by special Permit. In making this decision, the Zoning Board of Appeals found: a. use is in harmony with the purpose and intent of this ordinance and will promote the purposes of the Water Supply Protection District. The plans and information submitted have received approval from the Conservation Commission for the construction of the detention area and the rebuilding of the stormwater outfall into wetland resource areas. b. The use is appropriate to the natural topography, soils and other characteristics of the site. Information submitted .indicates that the soils are appropriate for the construction of a detention basin. The existing drainage systemis catchbasins_ will be upgraded with gas and oil traps In-order to prevent contamination of groundwater. C. The use has adequate public sewerage and water facilities, as demonstrated in the extensive engineering information submitted with the application. The proposed project has received approval from the Department of Public Works and the Fire Department as to sewer and water systems. d. The use will not, during construction or thereafter, have an adverse environmental impact on groundwater resources in the district. The applicant has demonstrated that groundwater resources will be protected by obtaining an Order of Conditions from the Conservation Commission. e. The use will not adversely affect the existing or the potential quality or quantity of water in the Water Supply Protection District because the existing drainage system's catchbasins will be upgraded with gas and oil traps in order to prevent contamination of groundwater. The applicant has obtained approval from the Conservation Commission. 10 Pursuant to Massachusetts General Laws (MGL), Chapter 40A, Section 11, no Special Permit, or any extension, modification or renewal thereof, shall take effect until a copy of the decision bearing the certification of the City Clerk that twenty days..have elapsed after the decision has been filed, or if such an appeal has been filed that it has been dismissed or denied, is recorded in the Hampshire County registry of Deeds or Land Court, as applicable and indexed under the name of the owner of record or is recorded and noted on the owner's certificate of title. The fee for such recording or registering shall be paid by the owner or applicant. It is the owner or applicant's responsibility to pick up the certified decision from the City'Clerk and record it at the Registry of Deeds. Sanfor eil, Jr. -1?- Zoning Board of Appeals Minutes of Meeting - May 11, 1994 Chairman Laband opened the Public Hearing on the request of Tessier Associates, Inc. for the JFR Building Committee for 3 Special Permits to construct a 73,243 square foot addition with related parking and drainage structure improvements to the existing JFK Middle School at 100 Bridge Road under 510.11(3), page 10 -7 Site Plan Approval - Special Permit, 514.3 page 14 -1 Watershed Protection District, and $16.7, page 16 -4 Water Supply Protection District of the Zoning Ordinance. Chairman Laband reviewed formalities for Public Hearing procedures. Laband noted that a legal notice of this hearing had been published in the Daily Hampshire-Gazette on April 27, 1994 and May 4, 1994. Present and sitting on the case were Chairman Peter Laband, Members Alex Ghiselin and M. Sanford Weil, Jr. (Associate Member Elaine Reall was observing the Zoning Board of Approvals meeting and Public Hearing procedures but was not participating in voting). Laband noted that a memo had been received from the Northampton Planning Board dated May 5, 1994 which stated that the Planning Board had reviewed the request at its April 28, 1994 meeting and had voted 7:0:1 (Kenneth Jodrie abstained from participating in or voting on this case since he is employed by Tessier Associates, Inc.) to recommend that the ZBA grant the Special permits with the following conditions: 1. The School's *Design Team should review all signage recommendations included within the traffic study report, and incorporate into the plan all additional signs which they deem appropriate. A final signal plan shall be submitted to the Zoning Board of Appeals. 2. Striping recommendations contained within the Traffic Study, for the bus loop area, shall be incorporated into and made part of the final site plan to be approved. 3. An 8' chain -link fence shall be erected around the detention area with appropriate "warning" signage attached, in order to protect and prevent unauthorized entrance into the detention area. The Planning Board voted 7:0:1 to approve the Site Plan because all criteria had been met in the application. Laband also noted that a memo had been received from Sam Brindis of the DPW which stated that he had reviewed the application and plans and had no concerns regarding the project. Kenneth Jodrie of Tessier Associates said that they had been before the Conservation Commission and the Planning Board and have received favorable review of the project. Tessier said they had presented the project to the Western Valley Water Protection -11- "I- LW-A Zoning Board of Appeals Minutes of Meeting - May 11, 1994 Committee, to the Building Inspector, Chief Larry Jones of the Fire Department, and to the Department of Public Works. He said they had had evening meetings for the neighborhood and think they have arrived at a project which meets the needs of all parties concerned. Jodrie wanted to clarify information contained on the first page of the application which indicated that the existing parking spaces were 40 and the proposed parking spaces were 246 f or total parking spaces which meets the requirements. Appendix C, which was provided under separate cover, has drainage calculations, and a traffic study report was conducted and provided to the Board for review. A'plan showing signage on the site has also been provided. Jodrie reviewed the site plan. John Walker, landscape architect, Tom Jenkins, engineer from Bay State Environmental, and John Dietrich from Champagne Associates, were also present to discuss the case. John Walker explained the site, parking, bus loops, terraced areas with landscaping, the new interior court, the new entrance on the west wing and the new evening entrances in the back of the building. Walker said there will be six new tennis courts and a basketball court built. There will be a detention infiltration center to take care of all the drainage on site. Tom Jenkins discussed the design drainage, erosion controls, sanitary sewer and explained the new systems. He said that the existing fire hydrant will be relocated and three new fire hydrants will be installed on the site. The existing erosion problems will be corrected. Bill Rowan, who owns property on Spring Grove Avenue, expressed concern about sanitary sewer system on Spring Grove Avenue. He said they had sewer problems there in the past. The applicants discussed the plans with the DPW and are confident that the system will accommodate the school. Tom Coogan, 185 Spring Grove Avenue, said that when Spring Grove Avenue was re -built 35 years ago, the City put three dips in the road which now fill up with water. Coogan said that the winter was terrible with overflowing catch basins on the street. He said he is concerned about water collecting in the dips in the road since the neighborhood already has flooding problems every time it rains. Alex Ghiselin asked whether the pool will be connected to the sewer. Ken Jodrie said it would be but that the City required that they build a large detention tank for the pool so that large amounts of water will not be let out into the system. Mr. Coogan said that tonight was the first time he had heard that the pool was a certainty. Jodrie said the pool was part of the design. Sandy Weil said that they money had yet to be provided for the plan to be completed. -12- Zoning Board of Appeals Minutes of Meeting - May 11, 1994 John Dietrich, traffic engineer with Champagne Associates, said he had submitted a traffic impact report which he would briefly review. He said recommendations for signage on the site were made to better direct traffic. Dr. Laband said that site plan review criteria had already been sufficiently covered. Kuzdeba said that the applicant needed to meet the Special Permit criteria plus criteria under $10.11 for Site Plan Approval Special Permit. Alex Ghiselin asked about the lighting and would there be a need to increase the lighting off -site. He was told that there would be an increase in lighting on site but will not have the light coming off site. The lighting will be on a'series of circuitry and timers. Mr. Rowan expressed concern about lighting. Mr. Coogan asked about whether the six tennis courts would be lit at night. The tennis courts will not be lit. Paulette Kuzdeba said you could put a condition on the permit that a plan be submitted showing the foot candles around the property. Convenience and safety of vehicular and pedestrian movement within the site and on adjacent streets, minimizing traffic impacts on the streets, roads and highways in the area, the location of driveways openings in relation to traffic, access by emergency vehicles, and to adjacent streets and, when necessary, compliance with other regulations for the handicapped, minors and the elderly; The proposed design will change the on -site traffic patterns to minimize exit and access through the adjacent Spring Grove neighborhood. Internal pedestrian and vehicular circulation will be improved by the separation of staff /visitor access, bus drop -off areas and delivery truck routes. A new bridge Road curb cut which is a key component of the improved on -site circulation has been located to minimize congestion with existing intersection on Bridge Road. All site work, renovation of the existing building and new construction will be done in compliance with standards that assure full accessibility for the disabled, as well as all other members -of the community. See Appendix B - Traffic Impact Statement C. Adequacy of the arrangement of parking and loading spaces in relation to the proposed uses of the premises; Two hundred + additional parking spaces have been located to allow convenient access to the building, while isolating pedestrian routes from service delivery areas. Relationship of structures and open spaces to the natural landscape, existing buildings and other community assets in the area and compliance with other requirements of the ordinance; The orientation of the new additions will maximize views from the school toward open fields to the west. Site design and landscaping will enhance interior courtyard spaces, and define sitting and gathering areas at the exterior of the building. New Construction will compliment the masonry character of the existing building. E. Mitigation of adverse impacts on the City's resources including the effect on the City's water supply and distribution system, sewage collection and treatment systems, fire protection, and streets. A SITE UTILITIES The requested use will require modifications to the existing storm water drainage systems, sanitary sewer systems, and fire and domestic water supply systems. The design team has made contact with the Department of Public Works, and has been assured by the Assistant City Engineer that both water and sewer are available for the school expansion, and that the anticipated increased usage will not overload these municipal systems. Furthermore, storm drainage needs will be accommodated by an existing drainage system which discharges to a perennial stream immediately upgradient of Broad Brook. 1 WATER The school is currently served by a 6 water service main which branches off the 8 municipal water main located in Spring Grove Avenue. The existing service main then branches to a 4" domestic service into the building, with the main branch continuing to a single fire hydrant located near the maintenance entrance to the school. The proposed water system will follow the recommendations received from the Assistant City Engineer, and will include a new 8" tap into the 8" main in Spring Grove Avenue. The new service main will loop around the existing building and proposed additions, eventually tieing into the existing 12" municipal main located under Bridge .Road. All materials and construction will meet City standards. All connections to existing municipal mains shall be as directed by the Water Department. The proposed service main loop will be constructed of a ll Class 52 ductile iron pipe, and will feed several new fire hydrants located throughout the project site. The final location and number of these hydrants will be as approved by Fire Chief Lawrence Jones. The existing 4" domestic service will be reused, and any new domestic services specified by the mechanical designer will be provided for as well. 2 SEWER The existing building sewer exits the northerly side of the school and ties into an 8" asbestos- cement sanitary sewer at an adjacent manhole. This existing sewer system appears adequate to accept the additional sewage flows, and will be utilized by the requested use. The existing system will be extended by 400 to accept additional building sewers from proposed additions to the school. No industrial wastes will be discharged to the sewers by the requested use. Kennedy Middle School - Planning /Zoning Applications March ,24, I994 Page 2 of 4. 6 DRAINAGE The requested use will result in the increase of impervious areas at the school site, and a corresponding increase in storm water runoff. In order to satisfy the various requirements of the Zoning and the Wetlands Ordinances, we propose a design solution comprised.of several mitigative components. We have presented this preliminary design to the Assistant City Engineer, and he has indicated acceptance of the concept. Final design is .currently underway, and it is anticipated that all storm water requirements of the various City Ordinances will be met. The major components of the water design are as follows: 1. Storm water runoff will be collected in a system of catch basins, manholes, and drainage culverts designed to reduce overland velocities and to remove harmful pollutants at the source. All catch basins will have 3' -deep sumps and an oil /grease hood over the outlet. 2. Due to the existing and proposed use of the site as a middle school, it is impractical to establish an open retention or detention storm water basin in close proximity to the paved surfaces and building areas. Therefore, an area has been reserved for these facilities northerly of the ball fields, adjacent to the Spring Grove Cemetery. Due to the outlying location of this facility, for some of the proposed paved areas it is necessary to provide for the infiltration of storm water near the source. This will be accomplished through the use of underground storm water infiltration chambers . These types of infiltration facilities have proven effective at removing the first flush of storm water runoff and can also be effective at reducing the peak flow rate for low to moderate storm events. Additional sumps located within adjacent manholes will further serve to cleanse the runoff prior to entering the chambers, and high -level overflows from the chambers to the existing storm drain system will ensure positive drainage during extreme runoff events. 3. In all respects the drainage design will attempt to alleviate the current runoff loadings to the existing storm drain system. Areas contributing runoff to the existing system will be reduced whenever possible and will be redirected to the new facilities. Any new connections to the existing system will be made only in cases where alternative measures are not practical or in the case of high -level overflows from the infiltration chambers. 4. This structure, designed to normally be devoid of open water between runoff events, will include a sufficient volume of storage below its outlet to ensure capture and infiltration of the first flush of storm water runoff. As the level of storm water builds within the basin during extreme runoff events, an outlet structure located in the basin's southeasterly corner will limit peak discharge rates which enter the existing drainage system. 5. By intercepting the runoff generated on the till ridge adjacent to the ball fields and running this storm water through the detention basin, runoff loadings to the existing drainage system can be effectively mitigated with the added benefit of drying of the ball fields. 6. The retention /detention basin will discharge into the existing drainage system which originates at an existing catch basin located in the northeasterly corner of the ball fields. This system flows to Spring Grove Avenue, turns at a manhole located in that street, and flows northerly through the facilities of the Spring Grove Cemetery, which is owned and operated by the City of Northampton. This system was the subject of an investigation by the design team, and appears viable as a receptor for the additional volume of storm water from the requested use. The last 300 of storm drain pipe and the large headwall at the pipe's end, both of which are antiquated and in need of significant rebuilding, will be replaced as a part of the construction of the requested use. Also, a properly- designed riprap stilling basin will be provided for at the pipe outlet., mitigating the erosive impacts which currently result from the pipe's discharge. It appears as if there has never been an adequately protected outlet, and current erosion problems appear moderate and localized near the headwall. The design of the piping section to be replaced will include increasing the diameter- of the pipe and reducing its slope, both of which will reduce the velocity of runoff emanating at the headwall. In conjunction with the stilling basin mentioned above, these alterations to the existing drainage system will improve its performance and will provide for the protection of downstream resource areas. Through the use of the detention basin, peak runoff rates emanating from the headwall will be throttled to existing levels for all required storm events. 1. The above - mentioned storm drain rehabilitations at the cemetery will require these portions of the proposed work be presented before the Northampton Conservation Commission. We have been in contact with the Commission's Administrator, and are currently scheduling Sub - Committee meetings with this regulatory.authority. 1 1_�" J.F. Kennedy Middle School - Planning/zaning Applications March 24„ 1994 Page 4 of 4.j C EROSION CONTROL Erosion control at the site will include "best management" structural and non- structural practices including silt fencing erosion control barriers around the perimeter of all active areas, the establishment of protected soil stockpiling and Contractor staging areas, strict contract requirements involving the temporary and permanent stabilisation of all disturbed areas, and the use of the retention /detention basin as a temporary sedimentation basin during the project's construction period. The Contractor will be required to clean all sediment sumps prior to final acceptance of the project. Work in close proximity to wetland areas (i.e. the replacement of the drain and headwall at the cemetery) will require structural measures for erosion control such as sediment traps in the area of the stilling basin, and the control of work such that the performance of all activities is limited to periods of low flow and that adequate precautions are taken to ensure the protection of the adjacent resource areas. All areas disturbed by these activities will receive immediate stabilization measures such as loaming, seeding , and mulching or more structural measures such as riprap or erosion control netting as applicable. Silt fencing and /or staked haybales will be specified wherever appropriate. Currently in progress are the preparations and appropriate filings and notifications related to a General Permit to Discharge Storm Water From Construction-Sites (a;..5 acres disturbance) as required by the U.S. Environmental Protection Agency (EPA)-under the National Pollutant Discharge Elimination System (NPDES) of the Federal Clean Water Act. This procedure includes the preparation and submittal of a Notice of Intent to be covered under the General Permit and a Storm Water Pollution 'Prevention Plan (including erosion control procedures as detailed in the Contract Documents) for use during the construction of this project. Also included are all other notification procedures and requirements as outlined in the Federal Register Vol. 57, No. 187, September 25, 1992. This Notice of Intent and the Storm Water Pollution Prevention Plan will be included in the Contract Documents for the project, along with explicit instructions that the low bidder will be required to implement and maintain the conditions of the General Permit. APPENDIY Traffic Impact Statement TRAFFIC IMPACT STATEMENT JFK MIDDLE SCHOOL EXPANSION NORTHAMPTON, MA OVERVIEW This traffic impact report discusses the traffic changes and impacts of renovations and additions to the JFK Middle School located on Bridge Road in Florence. It has been prepared in accordance with the Northampton Zoning Ordinance requirements for a traffic impact statement as part of the site plan review and approval process. The proposed project is for an expansion of the school building area to accommodate 900 students compared to the present enrollment of 540 students. The proposed building program is to accommodate three grades, grades 6, 7, and 8 city wide. The present facilities accommodate grades 7 and 8 city wide. The traffic analysis herein includes a discussion of the existing traffic conditions at the site and the traffic conditions after the proposed expansion, analysis of peak hour traffic operations at the school driveway intersections with Bridge Road, and comments on the on -site traffic circulation and parking. EXISTING SCHOOL ACCESS Presently, there are two driveways which serve the school site. The main driveway to the site is on Bridge Road opposite Beech Street. The secondary driveway to the school is located off of Spring Grove Avenue which is a neighborhood street located just east of the school. Buses currently enter the school via the Spring Grove Avenue driveway and exit the school by means of the main driveway on Bridge Road. Although there is currently a bus loop around the front of the school at the main entrance, buses have difficulty negotiating the loop when entering from Bridge Road due to the interference of cars parked along the outside curb of this loop. Accordingly, the predominant circulation pattern for buses that now takes place is to enter off of Spring Grove Avenue and exit the site onto Bridge Road. Figure A -1 shows the location of the school building and'driveways in relation to the surrounding street system. EXISTING TRAFFIC VOLUMES The JFK Middle School starts at 7:55 AM and ends at 2:25 PM. Accordingly, traffic counts were conducted at both driveways to the school between the hours of 7:30 to 8:30 AM and 2:00 to 3:00 PM. These counts were conducted at the school driveway intersections with Bridge Road and Spring Grove Avenue. They consisted of manually counting all traffic turning in and out of the school as well as through traffic on the main streets. A summary of the intersection traffic at these two locations is presented in Figure A -2 and Tables A -1 to A -4 in the Appendix. The school start time in the morning is the peak traffic time for the school on a typical weekday. The traffic in and out of the school driveways between 7:30 to 8:30 AM is about double the traffic counted at the end of school between 2:00 and 3:00 PM. A comparison of the existing school driveway traffic is summarized in Table 1. It is estimated that about 60 to 70 percent of the morning traffic between 7:30 to 8:30 AM is drop -off traffic. In the afternoon, it is estimated that about 50 percent of the driveway traffic relates to student pick -ups by passenger cars. PROPOSED SCHOOL ACCESS The access to the school will be modified by means of adding another driveway off of Bridge Road about 270 feet west of the existing main school driveway. This new driveway will provide access to new staff and visitor parking lots which will be constructed to the west of the existing school building. Much of the staff /employee traffic which currently uses the Spring Grove Avenue access will be shifted to this driveway. Almost all of the parent drop -off and pick -up traffic will also use this new driveway, since a special parent drop- off /pick -up turn around is part of the parking lot design for the westerly site area. 2 School buses will no longer access the school property via Spring Grove Avenue. They will enter and exit the main driveway located off Bridge Road. A new large bus loading /drop -off loop will be constructed in front of the school to the west of the present main driveway. The site plan (submitted separately) shows more details of this bus loop design. The driveway access to Spring Grove Avenue will remain open but its traffic use should significantly be reduced during school times. This driveway will primarily serve employee parking that will be retained at marked spaces on the southeast and east of the building. jt will also serve occasional deliveries made to the existing service area at the east side of the existing school building. PROJECTED SCHOOL TRAFFIC VOLUMES Estimates were made of the driveway traffic with the school renovations and expansion based on the student population increase from 540 students to 900 students. School buses, vans, and student drop -offs and pick -ups by the parent vehicles were projected on the basis of the student increase. Staff and employee traffic for the school was increased in proportion to the estimate of increased staff. Table 2 indicates the estimated driveway traffic for the projected build condition at the school. As indicated, it estimates a total traffic volume between 7:30 to 8:30 AM of 457 vehicles. The total traffic volume for the school between 2:00 and 3:00 PM is estimated at 214 vehicles. It has been estimated based on the counts that the traffic is approximately equally split in terms of its orientation east and west coming into the site. Accordingly, .this distribution was utilized in terms of vehicles entering the school property. 3 L1 � Traffic was assigned to the proposed school driveways based on the type of traffic and the function that will be provided by each driveway relative to bus drop -off, staff and employee parking, and parent drop -off and pick -up of students. Figure A -3 indicates the morning peak hour traffic projections with the expansion. The volumes represent a three -year projection, for the year 1997. This is the traffic volume estimated for each of the driveways off of Bridge Road that will occur within the 7:30 to 8:30 AM time period. Figure A -3 also indicates the. so- called "No Build" condition with the existing school building and only one driveway on Bridge Road based on the present 540 student enrollment. Figure A -4 indicates the afternoon traffic volume estimated for the 2:00 to 3:00 PM period for the site driveways at Bridge Road. It shows the 1997 projected traffic with and without the school expansion. TRAFFIC IMPACTS AT DRIVEWAY INTERSECTIONS ON BRIDGE ROAD A capacity analysis was performed which analyzes the degree to which turning movements will be able to be made safely and efficiently in and out of the driveway areas on Bridge Road. The capacity analysis methodology used was that of the 1985 Highway Capacity Manual (Special Report 209). The relative quality of peak hour traffic operations is expressed in terms of "level of service ". This level of service is rated in letter grades of A, B. C. D, E, and F. The letter grades signify the degree to which the traffic is below capacity and will experience delay.. A letter grade of "A" signifies unconstrained traffic operation well below capacity. Level of service "F" signifies a congested operation with typically long delays to traffic making various turning movements during the peak hour period, and the volume exceeding its capacity. Turning movements into the site driveways for the highest traffic period for the school (the morning peak hour) indicates a good level of service for traffic turning left into the school driveways after the expansion. Level of Service "A" was calculated. This implies that there are adequate gaps in the on- coming traffic stream to handle the turning traffic efficiently. Turning movements out of the driveways are below their capacity. Level of service for traffic coming out of the main JFK driveway (i.e. predominantly bus traffic) in the morning will be at level of service "E" with or without the expansion. Left turning traffic coming out the new driveway west of the existing driveway will be at level of service "E" for the morning peak hour and level of service "D" for the afternoon hour. A summary of the level of service for turning movements at the intersections evaluated is appended in Table A -6. The proposed two driveways to the JFK property off of Bridge Road will have a beneficial impact of separating school bus traffic from other staff and parent passenger vehicle traffic. z TRAFFIC IMPACTS ON SPRING GROVE DRIVE The morning period between 7:30 and 8:30 AM was the time period with the highest traffic activity on the school driveway off of Spring Grove Avenue for a typical school day. Currently, that driveway handles about 40 percent (117 vehicles) of the total school traffic counted between 7:30 and 8:30 AM. With the renovation and relocation of access and parking areas for the expanded middle school site, there is expected to be a significant reduction in school traffic use on this driveway off of Spring Grove Avenue. It is expected to decrease to about 5 percent of the total site traffic during the morning peak hour. In the afternoon between 2:00 and 3:00 PM, there will also be a proportional decrease in traffic using this driveway. Overall, the proposed access plan and parking lot relocations will have a beneficial impact on the Spring Grove Avenue access to the site. The fact that a large new parking facility will be constructed to the west of the building area and close to the playing fields will also have a beneficial impact on reducing the traffic that is using the Spring Grove Avenue driveway now during non - school times, particularly on weekends and weeknights during baseball, softball; and soccer playing times. Although access to the site will still be allowed via the Spring Grove Avenue driveway, the availability of much more additional on -site parking in close proximity to the playing fields will have a positive impact on improving the parking situation as it presently occurs during weekend recreational events at the site. ON -SITE TRAFFIC CIRCULATION The proposed site plan includes a revised bus circulation loop. The plan provides a separate one -way loop for bus unloading and loading of students. The proposed design will provide a safe and efficient access for buses and will separate bus traffic from other vehicular traffic during bus utilization times. The bus loop in front of the building will provide adeate storage for at least 11 buses along the outside curbside plus additional curbside loading adjacent to the loop on the existing site driveway if needed for special .occasions. The loop road is proposed to be 32 feet in width which will provide adequate width for bus circulation. Traffic circulation to and from the parent drop -off area on the west side of the proposed building addition will be efficient for private vehicle drop -off of students. This area is separated from any bus traffic and will be used in conjunction with visitor and staff parking. A drop -off loop is proposed whereby parents will be able to easily recirculate to exit the site driveway. A Driveway widths appear adequate for safe and efficient vehicular movement. It is recommended that the driveway to the new westerly parking lot (new site access) be widened in order to allow for two exit lanes at Bridge Road in order to separate left turn and right turn vehicles. A minimum of 20 feet is suggested at the exit to this driveway, if possible. Truck access for receiving and maintenance at the easterly service area of the building will be improved over existing conditions. Present curbside parking interferes with the ability of trucks such as garbage trucks to easily maneuver through the parking lot areas. Elimination of curbside parking during school hours and provision of marked parking spaces will allow for an improved circulation area for larger vehicles at the east end of the site. PARKING Typical parking rates were reviewed based on Institute of Transportation Engineers standards and other parking guidelines in an effort to independently assess the adequacy of the parking provided for the expanded site. Based on typical parking rates for middle school junior high facilities, it is estimated that around 126 parking spaces should be provided for staff /employee, parent pick -up, and visitor parking during school times. In addition, the use of the cafetorium with 417 seats as proposed suggests providing about 139 parking spaces for that use. In total, the parking which will be provided on -site by means of marked parking stalls at approximately 286 in number, is more than sufficient for the school building program proposed. Estimates were also made by Champagne Associates of typical parking space demand during weekend or non - school time sport events at the facility. It is estimated that in the order of 85 to 100 spaces would be used for activities at the recreation fields for weekend or other recreation time events. The derivation of these parking requirements is indicated in Table A -8 in the Appendix. It should be noted that curbside parking is possible around the bus loop and the adjacent east side of the main driveway if required for special evening events. More than 40 additional vehicles can be accommodated in this manner. Parking .signage and pavement markings relative to parking restrictions in the bus loop area are indicated in figures appended to this report. PEDESTRIAN ACCESS Access to the school for walkers will remain essentially as it is with the present facilities. There will be a marked crosswalk on Bridge Road at Beech Street which will serve those walkers using the existing sidewalk that runs along the south side of Bridge Road. The existing sidewalks along the east and west sides of the main school driveway will be 0 u retained and provide good pedestrian access to the existing school entry and the new sidewalk area connecting to the new lobby area to the west. Crosswalk lines should be painted across the bus driveway (loop) entrance and exit connecting the sidewalks on the west edge of the main driveway. Consideration should be given to adding a sidewalk in the northeast corner of the service area along the edge of the curb in that section between the driveway from Spring Grove Avenue and the existing bike storage area. This could provide a safer path for children walking to /from the recreation fields and tennis courts from the Spring Grove Avenue neighborhood. CONCLUSIONS Based on the analysis of projected traffic conditions and review of the proposed site plan, it is concluded that the proposed school expansion can be accommodated with a minimal impact to traffic on the adjacent street system. Traffic access and on -site vehicular circulation will be improved by the separation of bus traffic and parent pick -up and drop -off areas. There will be a safe and efficient bus loading and unloading area provided by the bus loop to be constructed in the front of the new building addition. The new driveway on Bridge Road to be located approximately 270 feet west of the existing main driveway will have excellent sight distance and serve to reduce traffic on Spring Grove Avenue by providing improved access and parking for the school staff, parent drop -off and pick -ups, and activities associated with the outdoor recreational area behind the school. The arrangement and supply of parking spaces is more than adequate, for the proposed school building facilities and staff. Recommendations for traffic control signage and parking restriction signs are contained in the appendix to this report. In order to satisfy the various requirements of the Zoning and the Wetlands Ordinances, we propose a design solution comprised of several mitigative components. We have presented this preliminary design to the Assistant City Engineer, and he has indicated acceptance of the concept. Final design is currently underway, and it is anticipated that all storm water requirements of the various City Ordinances wily be met. The major components of the storm water design are as follows: 1. Storm water runoff will be collected in a system of catch basins, manholes, and drainage culverts designed to reduce overland velocities and to remove harmful pollutants at the source. All catch basins will have 3' -deep sums and an oil /grease hood -over the outlet. 2. Due to the existing and proposed use of the site as a middle school, it is impractical to establish an open retention or detention storm water basin in close proximity to the paved surfaces and building areas. 'Therefore, an area has been reserved for these facilities northerly of the ball fields, adjacent to the Spring Grove Cemetery. Due to the outlying location of this facility, for some of the proposed paved areas it is necessary to provide for the infiltration of storm water near -the source. This will be accomplished through the use of underground storm water infiltration chambers. These types of infiltration facilities have proven effective at removing the- first flush of storm water runoff and can also be effective at reducing the peak flow rate for low to moderate storm events. Additional sumps located within adjacent manholes will further serve to cleanse the runoff prior to entering the chambers, and.high -level overflows from the chambers to the existing storm drain system will ensure positive drainage during extreme runoff events. 3. In all respects the drainage design will attempt to alleviate the current runoff loadings to the existing storm drain system. Areas contributing runoff to the existing system will be reduced whenever possible and will be redirected to the new facilities. Any new connections to the existing system will be made only in cases where alternative measures are not practical or in the case of high -level overflows from the infiltration chambers. 4. After passing through the drainage structures containing sediment sums and oil /grease hoods, the collected storm water from the new impervious surfaces which does not pass through infiltration chambers will be transported by underground culvert to the above - mentioned reten- tion /detention basin. This structure, designed to normally be devoid of open water between runoff events, will include a sufficient volume of storage below its outlet to ensure capture and infiltration of the first flush of storm water runoff. As the level of storm water builds within the basin during extreme runoff events, an outlet structure located in the basin's southeasterly corner will limit peak discharge rates which enter the existing drainage system. 5. By intercepting the runoff generated on the till ridge adjacent to the ball fields and running this storm water through the detention basin, runoff loadings to the existing drainage system can be effectively mitigated with the added benefit of drying of the ball fields. 6. The retention /detention basin will discharge into the existing drainage system which originates at an existing catch basin located in the northeasterly corner of the ball fields. This system flows to Spring Grove Avenue, turns at a manhole located in that street, and flows northerly through the facilities of the Spring Grove Cemetery, which is owned and operated by the City of Northampton. This system was the subject of an investigation by the design team, and appears viable as a receptor for the additional volume of storm water from the requested use. The last 300 of storm drain pipe and the large headwall at the pipe's end, both of which are antiquated and-in need of significant rebuilding, will be replaced..as a part of the construction of the. requested use. Also, a properly - designed riprap stilling basin will be provided for at the pipe outlet,,. mitigating the erosive impacts which currently result from the . .pipe's discharge.. It appears as if there has never been an adequately protected outlet, and current erosion problems appear moderate and localized near the headwall. The design of the piping section to be replaced will include increasing the diameter of the pipe and reducing its slope, both of which will reduce the velocity of runoff emanating at the headwall. In conjunction with the stilling basin mentioned above, these alterations to the existing drainage system will improve its performance and will provide for the. protection of downstream resource areas. Through the use of the detention basin, peak runoff rates emanating from the headwall will be throttled to existing levels for all required storm events. 7. The above - mentioned storm drain rehabilitations at the cemetery will require these portions of the proposed work be presented before the Northampton Conservation Commission. we have been in contact with the Commission's Administrator, and are currently scheduling Sub - Committee meetings with this regulatory authority. 5) Sewer The existing building exits the northerly side of the school and ties into an 8" asbestos - cement sanitary sewer at an adjacent manhole. This existing sewer system appears adequate to accept the additional sewage flows, and will be utilized by the requested use. The existing system will be extended by 400 to accept additional building sewers from proposed additions to the school. No industrial wastes will be discharged to the sewers by the requested use. Additionally, two other markers shall be placed in the basin with marks to denote elevations when debris needs to be removed and be consistent with the maintenance plan proposed within the Notice of Intent. *34) Woody vegetation shall be removed from the detention basin annually. *35) The Conservation Commission shall be notified in writing prior to the cleaning of the detention basin. The Conservation Commission orders that all work shall be performed in accordance with said conditions and with the Notice of Intent referenced above. To the extent that the following conditions modify or differ from the plans, specifications or other proposals submitted with the Notice of Intent, the conditions shall control. General Conditions 1. Failure to comply with all conditions stated herein, and with all related statutes and other regulatory measures, shall be deemed cause to revoke or modify this Order. 2. The Order does not grant any property rights or any exclusive privileges; it does not authorize any injury to private property or invasion of private rights. 3. This Order does not relieve the permitter or any other person of the necessity of complying with all other applicable federal, state or local statutes, ordinances, by -laws or regulations. 4. The work authorized hereunder shall be completed within three years from the date of this Order unless either of the following apply: (a) the work is a maintenance dredging project as provided for in the Act; or (b) the time for completion has been extended to a specified date more than three years, but less than five years, from the date of issuance and both that date and the special circumstances warranting the extended time period are set forth in this Order. 5. This Order may be extended by the issuing authority for one or more periods of up to three years each upon application to the issuing authority at least 30 days prior to the expiration date of the Order. 6. Any fill used in connection with this project shall be clean fill, containing no trash, refuse, rubbish or debris, including but not limited to lumber, bricks, plaster, wire, lath, paper, cardboard, pipe, tires, ashes, refrigerators, motor vehicles or parts of any of the foregoing. The applicant is prohibited from using demolition materials, asphalt, large chunks of concrete, tree stumps and limbs, and general refuse; 7. No work shall be undertaken until all administrative appeal periods from this Order have elapsed or, if such an appeal has been filed, until all proceedings, before the Department have been completed. 8. No work shall be undertaken until the Final order has been recorded in the Registry of Deeds or the Land Court for the district in which the land is located, within the chain of title of the affected property. In the case of recorded land, the Final Order shall also be noted in the Registry's Grantor Index under the name of the owner of the land upon which the proposed work is to be done. In the case of registered land, the Final Order shall also be noted on the Land Court Certificate of Title of the owner of the land upon which the proposed work is to be done. The recording information shall be proposed work is to be done. The recording information shall be submitted to the Commission on the form at the end of this Order prior to commencement of the work. The Commission usually will record the order in the Registry of Deeds. It is the applicant's responsibility to insure the Order is properly recorded. 9. Where the Department of Environmental Protection is requested to make a determination and to issue a Superseding Order, the Conservation Commission shall be a party to all agency proceedings and hearings before the Department. 11. Upon completion of the work described herein, the applicant shall forthwith request in writing that a Certificate of Compliance be issued stating that the work has been satisfactorily completed. 12. Sedimentation and erosion control devices shall be placed according to standards set in the U.S.D.A. Soil Conservation Service, "Guidelines for Soil and Water Conservation in Urbanizing Areas of Massachusetts ". Placement shall be directed at the site by the project engineer in order to accomplish maximum control of erosion and ensure than no eroded materials will reach wetland resource areas. Hay bales must be staked. Silt fencing must be placed in a dug trench with sufficient porosity to allow detained water to pass while trapping suspended sediments; 17) The areas of construction shall remain in a stable condition at the close of each construction day. Erosion controls shall be inspected at this time, and maintained or reinforced to meet specifications in the plans and this order; 18) This Order of Conditions shall apply to any successor in interest or successor in control; 19) Members and agents of the Conservation Commission shall have the right to enter and inspect the premises to evaluate compliance with the Conditions and to require the submittal of any data deemed necessary for that evaluation; page 5 -3 (memorex \wp \conscom \order.cc) 6wY 116 OR /4490/OM 06 06! JM Mjz 20) The Applicantshall notify the Commission, in writing, as to the date that work will be commencing on the project. Said notification must be received by the Commission no sooner than ten (10) days and no later than five (5) days prior to the commencement of the approved activity; 21) The owner of the property described in this Order must advise any potential buyer of the property that any construction upon or alteration to said property, including brush clearance, may require action by the Northampton Conservation Commission and any instrument conveying any or all of the owner's interest in said property or any portion thereof shall contain language substantially as follows: "This property may be subject to the Northampton Wetlands Protection Ordinance, the Wetlands Protection Act, an Order of Conditions, and /or a Determination of Applicability from the Northampton Conservation Commission "; 22) The contractor is responsible with the applicant and property owner for any violation and the penalties under the law for such violation. While all activities regulated by this Order are being performed and during the construction phase for this project, an on -site foreman, or project engineer, shall have a copy of this permit at the site, be familiar with the conditions of this permit, and adhere to such conditions. A copy of the plans and Order must always be on -site and in all excavating machinery when work is being performed; 23) All required permits must be obtained from the Planning Board, Zoning Board, Department of Public Works, & Building Inspector prior to the start of this project and all permits must be complied with. Army 404 permits and Water Quality Certifications must be obtained prior to the start of projects involving fill within wetlands; 24) Upon completion of the project, the Applicant shall submit a statement that all work has been done in conformance with the provisions of the approved Order of Conditions and request a Certificate of Compliance.
