Pursuant to the authority of G.L. c. 131, s. 40, the Northampton Conservation

identified above, and has determined that the area,on which the proposed work is to be
done is significant to one or more of the interests listed in G.L. c. 131, s. 40.
The Conservation CanTnission hereby orders that the following conditions are
nacessary to protect said interests and all work shall be performed in strict accordance
with them and With the Notice of Intent and plans identified above except where such
plans are modified by said conditions.
CONDITIONS
!. Failure to comply with all conditions stated herein, and with all related statutes
gad other regulatory measures, shall be deemed cause to revoke or modify this order.
2. This order does not grant any property rights or any exclusive privileges; it does
mot authorize any injury to private property or invasion of private rights.
3. This order does not relieve the permittee or any other person of the necessity of
complying with all other applicable federal, state or local statutes, ordinances,
by -laws and /or regulations.
1. The work authorised hereunder shall be completed within one (1) year from the date
of this order unless it is for a maintenance dredging project subject to Section

5. Any fill used in connection with this project shall be clean fill, containing no
trash, refuse, rubbish or debris,.including, without limiting the generality of the
foregoing, lumber, bricks, plaster, wire, lath, paper, cardboard, pipe, tires, ashes,
refrigerators, motor vehicles or parts of any of the foregoing.
6. No work may be commenced until all appeal periods have elapsed from the order of the
Conservation Commission or from a final order by the Department of Environmental
Quality Engineering.
7. No work shall be undertaken until the'final order, with respect to the proposed
project, has been recorded in the Registry of Deeds for the district in which the
land is located within the chain of title of the affected property. The Document
number indicating such recording shall be submitted on the form at the end of this
order to the issuer of this order prior to coamencement of work.
Further, if the Order of Conditions is not recorded within 7 days
after the end of the ten day appeal period, the Conservation
Commission will impose a twenty- five dollar ($ 25.00 ) service
charge for recording by an agent of the Commission..
8. A sign shall be displayed at the site not less that two square feet or more than
three square feet bearing the words, "Massachusetts Department of Environmental
Quality Engineering. Number eciL- 7(,
!. Where the Department of Environmental Ouality Engineering is requested to make a
determination and to issue a superseding order, the Conservation Commission shall
be a party to all agency proceedings and hearings before the Department.
10. Upon completion of the work described herein, the applicant shall forthwith request,
in writing, that a Certificate of Compliance be issued stating that the work has
been satisfactorily completed.
11. The work shall conform to the following described plans and additional conditions:

12. The applicant shall submit a detailed engineering plan of the access
roadway, bridge and culvert where it crosses the brook to the Conser-
vation Commission for their approval prior to the start of construction.
13. The applicant shall submit plans to show how the temporary foot /golf
cart bridges, spanning the brooks, will be secured in place when in
use during the golfing season, and where they will be stored during
the off- season, for the annroval of the Conservation Co=mission prior
to the start of construction.

15. Adequate erosion and siltation control measures shall be implemented
as necessary conforming to methods of the iJSDA Soil Conservation Ser-

this Order of Conditions.
20. Prior to the transfer of land nresently owned by the applicant

by, the Conservation Commission prior to the start of construction.

the Village of Leeds, City of Northampton, Massachusetts in
accordance with the terms of said REAL ESTATE OPTION AGREEMENT

I understand that Mr. Jackson and Mr. Monsein or their
corporation known as Fairway Associates, Inc. will be making
application to the Planning Board of the City of Northampton
pursuant to Section 11.5 of the City Zoning Ordinance for a
Planned Unit Development which may be partially located on my
said real estate. I further understand that an application will
be submitted to the Conservation Commission of the City of North-

Dear Commissioners:
This letter is in response to your concerns as expressed
in Condition #17 of the Orders of Condition voted for
Fairway Village. In attempting to address these concerns,
we have conducted further investigations of the following
nature, designed to determine an adequate setback from
the 290 foot contour line as shown on the plans.

located on soils which have been typed by the USDA, SCS as
being Hinckley series. The Hinckley series consists of deep,
excessively drained soils on terraces, outwash ;Mains and
deltas, that formed in deep deposits of stratified sand and
gravel. They are underlain with cobbles and found on slopes
of moderate to severe grade. The Massachusetts Building
Code classifies them as "satisfactory foundation Materials"
and assigns a "presumptive bearing value" of from 6 to 10
tons per square foot. The four unit building referred to
in Condition x;17 is located on soils which have been typed
as Sudbury series, also developed in thick deposits of sand
and gravel, but having fewer cobbles than Hinckley series.
Also considered by the Building Code as "satisfactory found-
ation materials, the Sudbury series have a "presumptive bear-
ing value" of from 4 to 6 tons per square foot. In that the
design department of Acorn Structures requires a minimum
bearing capacity of 3/4 ton per square foot for satisfactory
foundation construction, the buildings proposed for Fairway

Village will not be constrained by any consideration of
soil bearing capacities or types.
With regard to the threat of erosion from Mill River flood
waters, we have examined the site in the presence of many
interested parties inclucing members of the Conservation
Commission and the "Northampton Planning Board. I do not
believe that anyone has observed evidence of even moderate
erosion at the base of the slope. Regardless, Mr. Nylen
has conducted a further investigation, the results of which
you will find appended hereto as Exhibit "A ", and which con-
tains Corps of Engineers flood data and plan overlay sections
for your inspection and consideration.
Probably the single best method for evaluating the performance
of the slope over the past several _years involves the analysis
of plant materials in evidence today. In that regard, we have
engaged the services of Frost � Higgins of Northampton. The
results of their study are appended hereto as Exhibit "B" and
clearly establish that both the top and base of the slope have
been stable enough to allow for sustained tree growth for at
least 1--58- years.

Although the foregoing areas of investigation seem to estab-
lish the stability of the slope for -the past several years,
we feel that the adequacy of the 290 foot setback line is
vital to the protection of those trees which are well estab-
lished at the top of the slope. With that goal in mind, we
suggest that the eventual site plans submitted for approvals
will show revisions to allow for a setback distance of 20
feet from the 290 foot contour line to all building founda-
tions. It should be understood by the Commission that the
small decks and /or terraces shown will not involve excava-
tions for anything larger than an occasional 8" concrete tube
or wood post, and that most terraces will be paving stones
set in sand or gravel. I trust that these proposed revisions
will meet and address the concerns of the Commission and that
we will have an opportunity to discuss this issue on March 12.

In response to your phone call of 2110181 In
which we discussed concern with the stability of the slope
southeasterly of the existing 4th green; I take this to be
a concern with the p o s s i b i l i t y that a major storm may
undermine the slope and create unstable bearing for dwelling
units at the top of slope.
As 1 suggested by phone, a first level of inquiry
might logically be a summary of observable cond it Tons, in
relation to historical flood data. That is, what can be
seen on the site which might Indicate erosion of the slope
and what frequency of high water Right be the cause?
The most severe known flood occurred 43 years
ago in 1936 and the most severe recorded flood 26 years ago
In 1955. The control grades indicated on project drawing
N5 were taken from the flood study done by the Corps of
Engineers for the Federal Insurance Administration "Flood
Insurance Study" dated November, 1976. Flood data is avaJl-
able for the Kill River from the U. S. G.S, gouging Station
Installed Immediately after the 1938 flood. The Study plotted
a profile, control sections and plan view of high water
potential from floods of 10, 50, 100, A 500 year fregdeneles.
Using the 2 control grade locations shown on
Dwg. M5 (266 6 270) we can extrapolate the likely high water
at these points as follows#

The actual toe of slope, as surveyed by Almer
Huntley A Associates, Is the 265 contour for most of the
distance between Points A A B, with a rise to 270 at Point B

approximate. The flood data Indicates then, that a 10 year
Frequency flood does not quite reach the toe of slopel a
50 year flood reaches approximately to the tool and a 100
year and 500 year flood reaches approximately 1 ft. and 2
ft. up the slope; respectively.
The flood data attempts to predict height of
flood water but does not consider scouring action, turbu-
lence, etc..
In any event, If erosion of the base of slope
has occurred, I would think that the evidence would be
v isible on the ground. If serious base erosion occurred,
I would think this would have led to slumping of the aid -
sl ope, with possible undercutting of trees, etc.. If tree
cover is relatively mature (we only go back 26 years to
the worst recorded flood) and tree cover Is stable, and
there Is no evidence that scouring or undercutt of slope
base has occurred, 1 would think this Is reasonabl evidence
that the slope Is secure- If this Is the case, there would
certainly be good reason for a project condition to be
devised to prevent development activity to alter this
condition In any respect.
If observat Ind icates anyth to the contrary
of the above, more precise analysis may be employed.

Dear Mr. Jackson:
The following is an appraisal of the plant material located
along the eastern perimeter of the Northampton Country Club. This
area consists of a level plain and small saddle atop a steep slope.
It runs adjacent to the Mill River from the N side of the 4th green
around to the SE side of the 5th tee.
Observations and conclusions regarding this site will be drawn
from an analysis of the appraisal.
Guidelines as set forth by the International Society of
Arboriculture and adopted by the American Society of Consulting
Arborists will be used throughout.
A random sampling of major trees, (native species located in
varying locations) was taken.
This was done to insure an accurate indicator regarding the
average age of the plant material present.
Trees selected were appraised with regard to their species,
location, age and condition.
Location is indicated by approximate contour line numbers and
compass orientation to existing landmarks. Contour line number
265 is approximate the level of the floodplain with 290 being the
approximate height of the top of the slope. Compass orientations
start from the N end of the slope proceeding to the south side of
the 4th fairway.
Age was determined by measurement of the trees DBH (dameter at
breast height) and multiplied by the species specific growth factor,
with consideration given to individual conditions.
These growth factor figures have been determined as a result of
data, compiled by the International Society of Arboriculture and
accepted by -the industry as the standard for age
Condition was rated on a percent basis with regard to the trees
foliage (size and color), twigs (annual growth and buds,) trunk
(splits, loose bark and injury) and the prevalence of insects or
disease.

Fairway Associates, Inc.
The appraised site consists of well drained medium textured
gravel. The only compacted areas are in the heavily trafficed
sections near greens and tees. Organic matter build up in the
A horizon (first level below non - decomposed material) is relatively
heavy but little exists in the lower horizons. All plants have a
moderate layer of natural mulch covering their root systems. The
overall condition of the plant material is quite vigorous with many
under story and ground cover plants becoming established.
It would seem that this site is relatively young in a geological
sense. Thereis little old organic matter present.
Because of the relatively old age of the white pine population
this area seems to be establishing itself much the same way geologically
as untouched areas of the northeast have in the past. After being
stripped of its virgin timber many areas re- established themselves
with white pine forests.
As a result of native species and well drained soil being present
one could anticipate an excellent stand of timber to develop.
The organic matter has already built up to a point where under -
story and ground cover plants are becoming well established. There
is adequate moisture and natural mulch present to insure this pro-
gression.
The lower areas are well stablilzed as evidenced by the many mature
species located on the flood plain.
All these conditions working together should further stabilize
this lower area as has already happened on the slope and upper plateau.
The above appriasal was concluded in a professional manner within
the guidelines established by the International Society of Arboricul-
ture.

start of construction. Among those items which we should consider are the
following:

memorandum to the Planning Board dated January 12, 1982,
2. The easements to be submitted in accordance with Condition #16
of the Special Permit as pertaining to water and sewer systems,
3. The Performance Covenant as described in Condition # 7 of the
Special Permit,
4. The notice by the Planning Board to the Building Inspector con-
cerning compliance with the conditions of the Special Permit, as
dessribed in Condition #22 of same,
5. The distinction between "Golf Common Area" and "Unit Common Area"
as described in the application materials and the Covenants to be
created in dedicating the "common
land" as "open space ".

special permit issued to Fairway Associates, Tnc., for their Fair-
way Village PUD have been met by the applicant and, as in conformance
with Condition #22 of said special permit, you are hereby authorized
to issue building permits for unit construction.
At their meeting on May 13, 1982, the Planning Board voted unani-
mously that whereas the applicant, Fairway Associates, has fulfilled
the pertinent conditions of the Order of Conditions set by the Plan-
ning Board in their special permit issued on April 9, 1981, the
Planning Hoard informs the Building Inspector that a building permit
may be issued, in accordance with the Covenant as submitted to and
approved by the City's Legal Department, and as recorded in the Hamp-
shire County Registry of Deeds.
Attached you will find copies of letters of approval from the
Department of Public Works, City Legal Department, and the Fire Chief,
as well as letters of confirmation from me and Fairway Associates, Inc.
Please keep in mind that Condition #9, which requires that the
Planning Board must sign all occupancy permits to insure compliance
with the conditions of the special permit, is still in effect.

In fact, when I spoke with both Robert Kozash of the Water Department and Fire
Chief Driscoll on 6/3/82 to confirm this point, they both related that the "steamer"
connections really weren't necessary on the other hydrants in the project either since
they were for residential fire protection.

Dear Commissioners:
I have been informed by Larry Smith of the Planning
Department that the Commission is considering a condition
which involves the 12 units shown on the site plan in a
location to the east and south of the existing fourth green.
In that the site plan and all of the other application ma-
terial before the Commission represents the product of over
fifteen months of landscape planning effort, we feel confi-
dent that we can address the Commission's concerns without
tampering with the present site plan. Specifically, we feel
that the present plan includes consideration of the following
areas:
1. On -site drainage and protection of existing slopes
and vegetative stabilization of same,
2. Soil types and bearing capacities regarding pro-
posed construction of buildings and utilities and
all appurtenances thereof,
3. Viewsheds, existing tree - lines, buffer zones and
the integration of new plant materials with the
indigenous materials,
4. Functional circulation of vehicles and pedestrians,
5. Protection from golf -ball hazards. etc.
Of course it is our understanding that work in this area as
in all areas of the site, would be governed by earth -work
standards and erosion - control measures as set forth in the
the SCS manual for construction techniques. I understand
that the Commission will be meeting on February 9 for further
discussion of this issue and I look forward to addressing the
Commission's concerns at that time.

Dear Commissioners:
This letter and the accompanying form will advise you that the Order of
Condition for the above - referenced project was recorded at the Hampshire
County Registry of Deeds on March 11, 1981.in Book 2213, Page 53. In
accordance with Condition #8, an appropriate sign is being prepared and
will be displayed at the site in the near future. Plans for the modifi-
cations to the golf course have just been completed by Geoffrey Cornish,
Golf Course Architect, and it is our intention to complete this work by
October of this year in order to go ahead with the construction or roads,
utilities and residential units in 1982. A copy of Mr. Cornish's plan is
included herewith for the review of the Commission. Additionally, the
following comments are in response to the various Conditions which con-
cern work to the golf course and solicit additional information.
Condition #13 Interviews with the greenskeeper and further design
work suggest that the proposed temporary foot /golf cart bridges re-
ferred to in this condition should, for simplicity, be replaced by
the installation of 2 asphalt -paved culverts of appropriate size and
minimal length (20 feet plus inlet and outlet aprons). Drainage
studies and resultant calculations and conclusions are included here-
with for the review of the Commission. It is our opinion that the
initially proposed wood bridges would require minimal footing con-
struction for proper anchoring and that such construction would make
seasonal removal difficult. Furthermore, such removal and relocation
for winter storage could impart "traffic damage" to the stabilized turf.
I hope that the Commission agrees with this re- thinking of the two small
crossings and the the data submitted is adequate for conclusive analysis.
Condition X621 Interviews with the greenskeeper reveal that the course
does not regularly use any herbicides and that none has been used since
1972, when "2,4 -D + Mecoprop (MCPP)" was used in accordance with published
standards. The source for such standards is an annual publication by the
"New England Weed Control Specialists" entitled NEW ENGLAND CHEMICAL WEED
CONTROL FOR TURFGRASS. The 1981 issue has been furnished to us by Dr. Joe
Troll, Department of Plant and Soil Sciences, U. of Mass., and is enclosed

herewith. In response to this Condition's request, I suggest that no
herbicide will be used unless it has been approved by appropriate
federal and state authorities and appears on the previously mentioned
publication as current during the year of proposed application.
Condition #22 The applicant regrets that it was not possible to
coordinate golf course construction with sewer line construction but
recognizes the intention of this Condition and shall endeavor to min-
imize or eliminate any disturbance to the wetlands and abutting areas.
I trust that the foregoing information will prove to be adequate for discus-
sion at your meeting on July 27 and look forward to the opportunity for dialogue
with the Commission.
