Thank you for arranging today's meeting at the Department of Public
Works. With regard to the phased construction of the project which
is now underway, the Developer proposes to construct approximately
500 lineal feet of water line to service the first 15 or 30 units,
depending upon market conditions. In that the Special Permit and
Site Plan Approvals both mandated the installation of a "looped"
water system for the project, the following represent my understand-
ings after today's meeting.
1. Prior to the issuance of Certificates of Occupancy for the
first or any subsequent units, the Planning Board must re-
ceive an adequate Performance Guarantee to complete the
looped main to Spring Street. Such Guarantee may be in the
form of a bond, deposit, letter of credit or other instrument
satisfactory to the Board.
2. The amount of the Performance Guarantee will be determined
by the Northampton D. P. W. based upon estimated cost of
construction for the incompleted portion of the main at the
completion of the first 15 units now under construction.
This amount will use current construction costs and will be
escalated by 10% annually for a period thru 6 months after
the expiration of the Special Permit's Condition #8. That
date would be October 9, 1988, the Permit having been granted
on April 9, 1981 with "Substantial Construction and Use" voted
on November 23, 1982, thereby satisfying Condition #23 of same.
3. Conversely, the amount of the Performance Guarantee may be
reduced as continued construction results in a greater per-
centage of completion of the main loop.
4. Any temporary termination of the main during the construction
process must be provided with appropriate fittings to the sat-
isfaction of the Water Department.

I trust that the foregoing correctly .summarize the conclusions of
our meeting today, and that we may proceed with the installation
of the tapping sleeve at Spring Street. Additionally, I look for-
ward to reviewing the D. P. W.'s cost estimates in the near future
so that we can make suitable arrangements as outlined above. In
the event that you are not in agreement with my summary, please
let me know at once.

Thank you for taking the time to meet with me yesterday to review the
Fairway Village Special Permit requirements for pending Phase I occu-
pany. I understand that you have advised the Planning Board at last
night's meeting of the need for a site inspection by the Board so as
to be in a position to act on a request for the necessary releases and
Certificates at the January 10, 1985 meeting. Accordingly, it will be
necessary to address the following items as extracted from the Permit:
1. The Board must approve the temporary turn - around provisions
as required by Condition #5,
2. The developer must provide a performance guarantee for the
incomplete portion of the water system and for the top course
of paving for the otherwise completed road and parking courts
servicing the Phase I units. The monetary amount of this
guarantee will be computed by the D.P.W. and agreed upon by
the Board and the Developer, as discussed in Condition #7,
3. The Covenant described in Condition #7 will be recorded prior
to the sale of any units and the appropriate releases then
obtained as described in said Condition,
4. The landscaping for each unit to -be- released must be completed
as required by Condition 415,
5. The easements to the City, as approved by the City Solicitor,
must be recorded as required by Condition # 16,
6. The screen planting at the entrance on Spring Street must be
completed as required by Condition X617,
7. "As Built" plans for the water and sewer systems must be submitted
and approved by the D.P.W. and Planning Board before the completed
portions of those systems may be placed in service, and certificates
of compliance must be furnished by the project's engineer, both as
described and required by Condition #20,
8. All Certificates of Occupancy must be signed by the Chairman or
authorized representative of the Planning Board as required by
condition # 9.

I trust that this summary accurately reflects our discussions and sug-
gest that you advise me of any oversight or disparity if this is not the
case. I will endeavor to provide all required materials to the Board at
the earliest possible moment so as to facilitate this review process.
Additionally, I would be most pleased to guide or attend a site inspection
by the Board or its representatives.
