corporation duly formed in accordance with the laws of the
Commonwealth of Massachusetts, and having its principal office in
Southbridge, Worcester County, Massachuseatts, in consideration of
$1.00 and other good and valuable consideration hereby
grants to THE CITY OF NORTHAMPTON, a municipal corporation with
offices located at City Hall, Main Street, Northampton, Hampshire
County, Massachusetts,
with QUITCLAIM COVENANTS,
an easement for the maintenance and repair of water and sanitary
sewer lines, on, over and under that portion of the grantor's
land in (Leeds) Northampton, Hampshire County, Massachusetts,
which easement area is more particularly described in Exhibit A
hereof.
Said easement is granted to the grantee to be used in common
with the grantor and third parties who will use the same for the
installation of underground utility lines, cable TV lines, gas
lines, as well as the grantor and third parties who will use the
roadways located within the area of said easement, both on foot
and with vehicles for egress and ingress onto other land now or
formerly of the grantor.
By the acceptance of this easement, the grantee acknowledges
and agrees that in the course of any maintenance or repairs to
said water and sanitary sewer lines, it will replace the land to
the condition that it enjoyed prior to any such repairs and
maintenance by the grantee.
The grantor has completed installation of said water and
sanitary sewer lines within the easement and does herewith
dedicate said water and sanitary sewer lines to the use and
ownership of the City of Northampton, and the City, by acceptance
of this easement does hereby accept said ownership.
Said easement is more particularly shown on a plan of land
entitled: "Plan of Water & Sanitary Sewer Easement in
Northampton, Massachusetts, for Fairway Village, Inc." dated
November 9, 1990, prepared by Para Land Surveying Inc.,
Southbridge, Massachusetts, recorded with the Hampshire County
Registry of Deeds, Plan Book /FO, Pages and /G .
This easement is intended to replace and supersede and
easement from the grantor to the grantee dated February 21, 1985
and recorded in said Registry in Book 2539, Page 201 and the City
of Northampton, by acceptance of this easement, does hereby
release and abandon the aforementioned prior easement.
For title see deed of Richard C. Caparso to Fairway Village,
Inc., dated August 1, 1984 and recorded with the Hampshire County
Registry of Deeds in Book 2480, Pages 55 -60.
Subject to the provisions of the Master Deed for Fairway
Village Condominium dated February 21, 1985 and recorded with the
Hampshire County Registry of Deeds, in Book 2539, Page 220 and
amended by a "Master Deed Amendment adding Phase 1B to Fairway
Village Condominium" recorded in the aforesaid Registry in Book
2631, Page 324, a "Master Deed Amendment Adding Phase 2 to
Fairway Village Condominium" recorded in the aforesaid Registry
in Book 2746, Page 210, a "Master Deed Amendment adding Phase 3A
to Fairway Village Condominium" recorded in the aforesaid
Registry in Book 2876, Page 49, a "Master Deed Amendment adding
