16A-020 Fairway Village Release & Discharge of Covenant-- RELEASE AND DISCHARGE OF C ENANT We, the undersigned, being a majority of the members of the Planning Board of the City of Northampton, herewith acknowledge the satisfactory completion of the obligations of Fairway Village, Inc. (the "Developer ") as set forth in that certain Covenant dated January 24, 1985, recorded in the Hampshire County Registry of Deeds in Book 2539, Page 216, and do hereby RELEASE ALL AND ANY RIGHTS of the Planning Board AND DISCHARGE the Developer from any further obligations for the project known as Fairway Village Condominium (the "Condominium "), a Massachusetts condominium created by a Master Deed dated February 21, 1985 and recorded in the aforesaid Registry in Book 2539, Page 220, as amended in Book 2631, Page 324, (Phase 1B), Book 2746, Page 210 (Phase 2), Book 2876, Page 49 (Phase 3A) and Book 2959, Page 140 (Phase 3B), Book 3098, Page 1 (Phase 4), Book 3258, Page 186 (Phase 5) and Book 3625 Page 60 (Phase 6). The foregoing includes without limitation a RELEASE OF ALL AND ANY RIGHTS, specifically, in Unit E -2 of the Condominium, which Unit was resubmitted to the provisions of the Covenant by an instrument recorded in the aforesaid Registry in Book 3652, Page 152. Could you please indicate if your department has any objection to the release of covenants and a final sign -off on the project? The approved water and sewer easement and the easement plan have been recorded in the Registry of Deeds. I have sent you a copy of that easement and mylars of the plans under separate cover (I will send you the original easement when it is returned from the registry). Thank you for your assistance. The Fair�ay Village Condominium Association, hereinafter referred to as the "Association ", shall be the organi2ation of unit owners governed according to the terms of the Fairway Village Condominium Trust , which Association will manage and regulate the Condominium pursuant to the By -laws of the Association (included in the Fairway Village Condominium Trust), this instriment, and Chapter 183A of the General Laws of Massachusetts.
