Review of 521 CMR – Supplement to July 25, 2018 Building Code Review
Dear Mr. Hasbrouck,
The following is a summary of the 521 CMR code review for the above referenced
project. This review is in addition to the Boston Bay Architects, Inc. (BBA) July 25, 2018
general Code Review. BBA offers the following assessment and recommendation to
proceed with the project for permitting.
Executive Summary
- Beyond normal building permitting, a MAAB variance will not be required. After review
of the Old Courthouse building accessibility , the Old Courthouse building is “publicly”
accessible through the New District Courthouse connector. The only public entrance for
both buildings is the Security Entrance in the New District Courthouse at Gothic Street.
- The New Courthouse doors at the street are fully accessible from the exterior and
interior. Once inside the building, there is unimpeded route from the Gothic Street
entrance doors, through the Security Station along the corridor to accessible elevator.
The Old Courthouse south Main Street entrance is kept locked and the side Gothic

Street entrance is for employees only. The Law Library (public use space) is accessible
and has accessible toilet available to library users.
- The Old Courthouse building is in public access compliance with 521 CMR.

- Window replacement

- Window wood trim and wood refinishing
- Minor Stair Wall Repairs

Review of 521 CMR Building Accessibility
1. Section 26.1 Doors and Doorways, 26.4 Double Leaf Doorways. The new Courthouse
Security entrance has two independently operated door leaves that meet the
requirements of 521 CMR 26.5, Width and 521 CMR 26.6 Maneuvering clearances. The
Gothic Street concrete sidewalk curb cut meets 521 CMR 21.7 Flared Sides, as the sole
approach to the buildings Security Entrance.
2. Section 20.00 Accessible Route, 520 CMR. Once inside the Gothic Street entrance the
security doors, and the corridor route through the Security Station and immediate
corridor is directly accessible to the elevator.

3. There is accessible 2nd and 3rd floor bridge connector from the New Courthouse elevator
to the Old Courthouse passage through accessible door 521 CMR Section 26.5 Width
and passage hardware Section 26.11.1 and 26.11.4. The accessible bridge connector
allows passage via elevator to Old Courthouse second and third floors.
4. The Old Courthouse third floor courtroom is fully accessible from the elevator through
accessible corridor passage 521 CMR Section 26.5 Width and passage hardware Section
26.11.1 and 26.11.4.
5. Public Toilets rooms (Men/ Women) are accessible, and accessible from the Old
Courthouse to the New Courthouse. Section 30.1, Location,30.2, Clear Floor
Space,30.5,Grab Bars, 30.8, Sink, 30.9.1,Mirror 30.11, Dispensers,30.12.
6. The ground floor Law Library is considered commercial space and is accessible, Section
20.00 Accessible Route, 520 CMR, from street to ground floor, with accessible toilet
room. Section 30.1, Location,30.2, Clear Floor Space,30.5,Grab Bars, 30.8, Sink,
30.9.1,Mirror 30.11, Dispensers, 30.12.

Evaluation
Evaluation of the existing building in accordance with the 9th Edition of the
Massachusetts State Building Code CMR780 3401.1 for existing structures was made
previously. See Boston Bay Architects Code Review dated July 25, 2018.
With the above 521 CMR information addressed for public accessibility in the Old
Hampshire Courthouse being true and accurate, I recommend the Building Permit be
issued for this project. If there are any questions or corrections, please do not hesitate to
