LOCATED OFF CHESTERFIELD ROAD, LEEDS (INCLUDING
WAIVER REQUEST OF SUBDIVISION CONTROL LAWS SECTION
7.01)

Gentlepeople:
We, the undersigned property owners abutting the property off Chesterfield Road
(Locus) proposed for subdivision by Sovereign Builders, Inc., are very concerned about
the proposal and are opposed to the same. Among the reasons for our opposition as a
group we offer the following thoughts. Since this Letter is from a group there may be
other additional concerns. We ask that you consider the following:
I. ENVIRONMENTAL CONCERNS:
The Locus is located in a Rural Residential Zoning District, with a portion of the
of the property located in a Water Supply Protection Overlay District. Serious
consideration must be given to the adverse impacts on the water supply, wetlands, and
environment such a proposal could have if, as, or when any residences are constructed not
only from a short term view but over the decades as well.
1. In considering the same it would seem to be appropriate to confirm whether the
Wetlands Determination shown on the plans prepared by a Russo (with that
Determination being issued on October 29, 2003), are consistent with those shown
on work performed for the Applicant by Charles Dauchy.
2. We believe that there are certain vernal pools on the Locus, though they have not
yet been officially identified and certified by the Conservation Commission. Based
on the neighborhood knowledge of the water drainage and underground streams
flowing year round (in and around many abutters' properties), the neighbors believe

that vernal pools do exist and should be identified and certified during the proper
time of year, and respectfully request that proper analysis be given to this area.
3. We strongly believe that not all existing underground streams and water supply
areas have been identified and shown on the proposed plans. Given the reality of
our collective experiences with water and run -off, this issue demands substantial
further review and analysis. A number of our properties already have drains and
pipes which are intended to direct water away from our homes, and yet almost all
of us have year -round wet basements. We fear that more logging and roadway
construction can only lead to a situation directing even more water through/to /on
our properties.
4. We believe any development at all will have a significant adverse impact on the
wildlife (including deer, bear, fisher weasels, moose, wild turkeys, and bobcats,
etc.) and amphibians (including frogs, toads, salamanders, etc.) in the area,
potentially eroding an already challenging existence.
a. In the Spring there is a significant migration of salamanders, frogs, toads and
other amphibians crossing over Chesterfield Road, which population and
occurrence has substantially increased in the past few years and are in need
of the proper protection. We can provide photographic evidence of the
same, upon request.
II. SAFETY CONCERNS:
1. The impact of tree cutting, construction of roads, driveways (with tar and asphalt)
and structures; the rearranging soil and changes to topography of the land may have
substantial adverse impact (both immediate and future) to all of the existing
abutters' homes from the standpoint of run -off. These same drainage issues on and
around our properties threaten the very safety of our drinking water and wells

(approximately 25 feet in depth) and the proximity of the road and Detention
Ponds and septic system leach fields pose terrifying risk to their continued
usefulness and our safety.

b. During Winter snow and /or ice storms, salt and treatment chemicals on the
road and the potentially very steep driveways could also impact the abutters'
wells and water supplies. The snow removal and its placement could also
be a serious concern with the proposed road and driveways in the Locus as
the Plans show with no allowance for placement of the snow on Chesterfield
Road itself.
C. Drainage for Locus and the proposed installation of a Detention pond could
have significant impact on those abutters closest to this Detention Pond if as
and when there are overflow problems. There is also the prospect for
substantially increased mosquito and pest issues from this Project's handling
of water on site.
d. It should be noted that the road salt issue is going to be further exacerbated
by virtue of the fact that the slope of this topography faces Northerly, which
will mean very little help with melting from the sun.
e. Overall safety of our wells is a major concern. We are very concerned that
they will be compromised with the introduction of septic systems located
above grade level to these existing wells causing contaminations in the
future.
At present all of us have wells which are above the septic tanks.
With the new construction, septic tanks would be caused to be located
above -grade from the neighbors' wells. This is the course of our
serious concern about adverse impact to our well water. We question
whether the perk tests on certain specific locations adequately take
into consideration the complete Hydrology of the site.
2. Vehicular traffic flow on Chesterfield Road itself is already heavy for a country
road as it is utilized by many neighboring towns as an access route to Northampton.
It currently has traffic speed issues causing many safety concerns for the children,
residents and essential services in the area. We believe it would be appropriate for
part of any Development Plans, traffic studies to be made to address these concerns.
a. Furthermore, there is concern that given the present design and flow of
Chesterfield Road (in particular its bends and turns), that any increase in

a. Furthermore, there is concern that given the present design and flow of
Chesterfield Road (in particular its bends and turns), that any increase in
vehicular traffic attributable to the number of vehicular trips to /from the
Locus generated by the intensity of the proposed use, will have an adverse
effect and further compromise the safety of our Chesterfield Road
neighborhood; and
b. We wonder whether there has there been an adequate analysis of the impact
on essential safety services, including access to and responsiveness by
ambulances, fire and police from the proposal, not only as to the Right of
Way, but also as to the various common driveways.
3. The immediate abutters to the proposed access roadway are very concerned about
the proximity of the road to their properties, with the result of having traffic so
close to their homes.

The attached Request for Determination of Applicability is filed on behalf of Robert F. Sproull
seeking review of proposed work in the context of a Determination of Applicability issued by the
Northampton Conservation Commission confirming the locations and character of resource areas
within the subject parcel. The property is a large piece of land with wetlands and their buffer
zones located generally toward the middle areas. Some of the wetlands are Bordering Vegetated
Wetlands subject to protection under both the Massachusetts Wetlands Protection Act and the
Northampton Wetlands Protection Ordinance; some of the wetlands are Isolated Vegetated
Wetlands subject to jurisdiction under the Ordinance and, under certain circumstances, the
federal Clean Water Act.
The proposed project has been designed to entirely avoid resource areas and buffer zones.

PROJECT NARRATIVE
Reaulatory Context
-- This project is proposed in the context of a Determination of Applicability issued by the
Northampton conservation Commission on October 29, 2003. The Determination confirmed
resource area boundaries within the property as flagged in the field and shown on the referenced
site plan. Resource areas included Bordering Vegetated Wetland jurisdictional under the
- Massachusetts Wetlands Protection Act (the Act) and the Northampton Wetlands Protection
Ordinance (the Ordinance), and Isolated Vegetated Wetlands jurisdictional under the Ordinance
and perhaps the federal Clean Water Act, given certain circumstances. However, the
Commission noted in its Determination that areas outside the property boundaries may include
- resource areas and that the presence or absence of any potential resource areas was not
confirmed.
In response to the Conservation Commission's comment, and to conduct the design and
presentation of this project with due diligence, the area within 100 feet of the property
-- boundaries was examined for the presence of areas subject to jurisdiction under the Act and/or
the Ordinance. Other than the natural topographical extension of the already delineated,
reviewed and approved Bordering Vegetated Wetland, no additional resource areas were found.
- - Site Description
The site is almost 30 acres in area and is almost entirely forested with a relatively open and dry
-- woods dominated by hardwoods and interspersed with Pines and Hemlock toward the lower
- elevations. Soils are the moderately well- drained Woodbridge series in lower areas and the deep
and well- drained Paxton series on higher elevations and steeper slopes. Fairly large rock
outcrops occur in several locations, particularly toward the rear of the parcel. At the time of the
recent site review, there was little evidence of surface water flow and soils in the wetland areas
-- were barely moist. Given the good soil drainage and the proposed retention of most of the forest
cover, the potential for sediment entrainment and transport by surface flows to resource areas is
low.
Project Description
Although several project designs have been created on behalf of former owners and prospective
developers creating many house lots and a complexity of access paths, this project proposes one
- - single family house, together with a driveway, on -site septic system, and a barn and garden area.
The project has been designed to stay entirely outside of all buffer zones and resource areas.
Further, the driveway, where it approaches a 100 -foot buffer zone boundary, will be separated
from the buffer zone by a sediment and erosion control barrier to be located outside the buffer

zone (versus right on the outer boundary of the buffer). Three culverts will be installed at
appropriate locations along the driveway to assure proper cross drainage.
Conclusion
The project proposes to utilize the approximately 30 acre site to a minimal degree. One single
family house is proposed, together with a driveway, a barn, and a garden area. The design stays
entirely out of areas jurisdictional under federal, state and local wetlands protection regulations.
However, it does incorporate site controls to prevent impacts to jurisdictional areas present
within the parcel.

At their meeting on September 25, 1986, the Northampton Planning Board
reviewed the request of Andrew M. Kowal for a Special Permit for the purpose

After discussing the matter with the applicant, the Planning Board voted
