The six-month time period in the proposed ordinance has been our practice, but the ordinance should spell this out. The ordinance would also clarify that a home office (an office within a home which is invisible to neighbors and which is allowed by -right under our current zoning) does NOT require a zoning permit. It is not clear if this is required under the current zoning or not. That section of the Code of Ordinances of the City of Northampton, Massachusetts, be amended so that such section shall read as follows: "Section {Purpose: Streamlining Zoning Permits, especially for Home Offices Zoning permits are the single point of review for all incoming land use permits. Generally, this process is critical to ensure that applicants are given clear, consistent and accurate advice about what permits are required. We would like to amend this section to reduce the frequency of people being required to obtain zoning permits when they are not necessary. This streamlining will be most dramatic in dropping the requirement that Home Offices (simple home offices that are invisible to the neighborhood, such as an intei net web designer or a plumbers billing office) register with the Building Commissioner.} Section 4.4 Permit Required. It shall be unlawful for any owner or person to erect, construct, reconstruct, or alter a structure or change the use or lot coverage, increase the intensity of use, or extend or displace the use of any building or other structure or lot without applying for and receiving from the Building Commissioner a zoning permit therefore. For purposes of administration, such permit and application procedure involving a structure may be made at the same time and combined with the permit required under the Building Code. Zoning permits shall be valid for six (6) months after their issuance, but shall not provide any vesting in the event of zoning or other regulatory changes. Notwithstanding this section, a zoning permit shall not be required for a home office (as defined in the zoning) that does not involve construction, nor for the renewal of a home occupation permit. Banquets, weddings, and similar events have routinely taken place in Northampton parks, especially Look Park, and parks around the country for many many years. Many parks, especially large parks, have built banquet facilities to create an all-weather extension of this historical use. This zoning change would specifically allow this use as a park use, and therefore as a municipal facility. The Planning Board views this change as a city-wide zoning change, not a "Look Park" zoning change. Although much of the public discussion was in the context of Look Park, as the only facility in the city that currently wants to develop a banquet facility or is likely to have one in the near future, the zoning issue is much broader than that. The Planning Board discussed the issue from a regional perspective of what facilities benefit large parks, and found that banquet facilities are appropriate to these uses. The Ordinance Committee also discussed the zoning change from a city-wide perspective, including some discussion of other areas in Northampton where a new park with a banquet facility could potentially be appropriate. This change cam in response to a request from Van Cort Instruments to be allowed to have retail sales of goods produced in their facilities in the Industrial Park. The Planning Board carefully studied Van Cort Instrument's request and the broader issues such a change would involve before voting to sponsor the ordinance. Benefits: Allowing limited retail sales allows manufacturing facilities some flexibility and opportunities in a competitive market place. It also increases the availability of locally manufactured goods. Risks: If not properly limited, retail sales can increase traffic flows, create signage problems, reduce available manufacturing area, and encourage strip retail commercial activities at the expense of core commercial corridors. In all Environmental Reviews the alternative of not carrying out the project shall be considered as the "No Build" alternative in order to provide a baseline for ccn parison with those po- tential impacts which are required to be considered in the Environmental Review. The depth and level of analysis throughout the Environmental Review shall be com ensurate with the magnitude of the project, the availability of reasonable alternatives and methods to reduce-impact and the extent to which detailed analysis would help to resolve uncertainty about significant environmental impacts. An'Envirom ental Review shall contain the following parts: a. Vart 1 Suranary sheet,or sheets. There shall be a summary sheet or sheets, . written in clear and nontechnl al language, which shall contain: 1) the name of the project and a brief description of it, 2) any applicable federal or state identification number, 3) the name and address of the applicant, 4) a brief description of the project indicating which counties and munici- palities are particularly affected, and 5) a summary of the major benefits, costs and environmental impacts of the project and its alternatives. b. Part II - Description of'the project. This part should discuss the nature and extent of the proposed work. It shall include: 1) the type of the project, 2) the objectives of the project, and a specific discussion of the benefits of the project, 3) a general description of the project's characteristics (e.g., size, dollar cost, location, etc.) with the location and boundaries of a proposed pro- ject indicated on an 82" x 11" portion of a 7z minute U.S.G.S. topographic quadrangle map, 4) an approximate timetable for the project, c. 5) the method of construction, Part III - to be affected ronmental sur- roundings as they exist before the project is commenced. The economic, physical, and social characteristics, both of the immediate area of the pro- ject and the surrounding region, should be described. Characteristics dis- cussed shall include: 11 6) an audited financial statement, for the most current year available, de- monstrating the financial capability and commitment of the applicant to undertake and see such a project through to cm pletion. 2) plant and animal species and ecosystems, 3) water, (surface and subsurface) 4) open space, 5) scenic qualities, 6) air and water quality, 7) manmade features, including historical features, 8) current nature of roan's use of the area, and 9) current use of land abutting routes which vehicles, carrying hazardous or radioactive materials to and from the facility, will take within the city of Northampton. Any rare or unique aspects of the area that might or might not be cmimn to other similar areas within the Cmmnwealth shall be specifically itemized. All applicable environmental regulatory requirements shall be described. This list of factors is meant to be used as a guide, rather than as a limit to the analysis. Other topics shall be included where significant. d. Part IV - Alternatives to the proposed project. Alternatives to the proposed. project must be listed, and the major benefits and costs of each described. The alternatives shall be evaluated giving primary consideration to the applicant's and any participating agency's mission or pertinent leg- islative mandate, including the mandate of M.G.L. Ch. 30 § 61 that agencies use all practicable means and measures to minimize damage to the environ- ment, and the protection of the public interest. Alternatives not discussed because of their presumed inferiority must be noted. Applicants are urged to make use of the resources of appropriate federal, state and local agencies, private groups and educational institutions in evaluating alternatives to their proposed projects. e. Part V - The probable impact of the project and its alternatives on the environment. Both damage and benefits to tlie environment arising from the project and its alternatives must be discussed in this section. 1) Both primary and secondary consequences shall be included. For in- stance, analyze a recreation project in terms of land area taken and used for the project and structures erected (primary) and expected impacts on neighboring areas, increased automotive pollution and other off-site impacts resulting from the project (secondary). All phases of the project must be considered when evaluating the impact of a project on thEe environment. 2) Trace th e.impacts through to their ultimate effect on man. Those im- pacts on the natural environment affecting man should be emphasized, but impact on ecological systems such as wildlife, vegetation and marine life must also be included. Quantify the impacts and their economic value where possible. 3) If there is uncertainty about potential impacts and their probabilities, these uncertainties should be expressed. If disagreements exist, -4- they should be indicated. If the information obtained by the project would be of value in assessing the environmental impact of future projects, this should be noted. Applicants should be careful to state all areas in which they feel data concerning impacts are unreliable or inadequate. 4) The time frame of environmental impacts must be specified. Short-term and long-term envi.ranmental consequences which cannot be avoided, should the work be performed., must be described. The degree of reversibility of impacts should be treated ex- plicitly. 5) Effects which depend on the actions or projects of other appli- cants or on other actions by the applicant should be identified as such. For such cumulative or otherwise interdependent effects, the possible impacts of the project should be estimated both under the assumption that the other action(s) or project(s) is (are) undertaken, and under the assumption that it is (they are) not. f. Part VI - All measures being utilized to minimize environmental damage. Any measures during design, construction or operation that are currently included in the proposed project to reduce adverse environmental impact or to produce beneficial impact shall be described. An Environmental Monitoring Plan (a plan of how the facility's impact upon the environ- ment will be measured and monitored). must be suh-nitted covering all periods, including during construction, commissioning, operation, de- ccnrdssioning and closeout, including how the implementation of said plan will be financed. An additional plan must be submitted explaining, with supportive doc- u-nentation, what form of performance guarantee and liability insurance the applicant will arrange which will provide for adequate (in the opinion of the City Council) financial coverage of the expense of: a) cleaning up any accidents involving hazardous or radioactive materials, whether on-site or off-site in Northampton; and b) the costs for decom- missioning, closeout and post monitoring.of,.the facility, including a built-in inflation factor.. Alternative measures which might.feasibly'be considered for use in the proposed project to reduce damage to levels equal to or below those achieved by the proposed project shall.also--be listed. In addition, al- ternative measures which might feasibly result in an environmental benefit shall be listed. g.
