APPLICATION TO THE CITY OF NORTHAM
ZONING BOARD OF APPEALS
FOR VARIANCE OR SPECIAL PERMIT

This application folder includes an application form, addressed to the City of Northampton Zoning
Board of Appeals, requesting the granting of a VARIANCE or a SPECIAL PERMIT and information
intended to assist the applicant in properly completing the application.
The application must be completed using a typewriter or hand printed block -type letters. All numbered
items on the application must be completed. When completed and signed by the applicant, the application
should be submitted to the Building Inspector for filing. Even though received, the application will not be
considered "filed" with the Building Inspector until it has been-reviewed to insure proper completion.
A review of the application will be made within two business days from the date received by the Building
Inspector. The applicant will be notified of any additional information required.
Applicants seeking a VARIANCE should note that the Zoning Board of Appeals has the power to
authorize a variance from the terms of the applicable zoning ordinance where the Board determines that
the applicant has met all requirements set forth in Massachusetts General Laws, Chapter 40 A, Section 15.
Reference should be made to applicable Massachusetts Law and to Chapter 44 of the Revised Ordinances
of the City of Northampton, Massachusetts, 1959, as amended.
Applicants seeking a SPECIAL PERMIT should refer to the Table of Use Regulations contained in
Chapter 44 of the Revised Ordinances of the City of Northampton, Massachusetts, 1959, as amended,
which indicates uses which require special permits in particular zones. The general and specific condi-
tions which must be met to obtain a special permit are set forth in Section 10.9 (3) of the above referred to
Zoning Ordinances.
The Zoning Board of Appeals is required to hold a public hearing to consider the merits of each
application. A notice of the public hearing will be published in the appropriate newspaper and written
notice thereof given to those legally entitled thereto. A copy of the rules adopted by the Zoning Board of
Appeals for the conduct of its public hearing is filed in the Office of the City Clerk. The applicant should
familiarize himself with these rules prior to attending the public hearing.
THE BURDEN IS UPON THE APPLICANT TO PROVE THROUGH THE WRITTEN APPLICATION
AND ORAL PRESENTATION AT THE PUBLIC HEARING THAT ALL OF THE LEGAL REQUIREMENTS
CONTAINED IN THE APPLICABLE STATUTES AND ORDINANCES ABOVE REFERRED TO HAVE
BEEN SATISFIED. FAILURE TO SUSTAIN THIS BURDEN MAY PREVENT THE APPLICANT FROM
REAPPLYING FOR TWO YEARS.
APPLICATION INSTRUCTIONS
1. State name and address of applicant.
2. State name and address of the owner of property.
3. Indicate applicant's standing to apply.
Indicate whether this is an application for a variance or for a special permit. If you are making
application for both, use a separate form for each (only one fee will be required). You may apply for
more than one variance or more than one special permit on the same form. If other, so indicate and
explain.

5. Location of property should be indicated by street address; where the property is situated i.e. south
w siQ� t5f South Street.; and with reference to the sheet numbers and parcel numbers as designated on
the assessors' tax maps.
6. Indicate the zone in which the property is located.
7. State as concisely as possible the work you propose to undertake and /or your proposed use of the
property should your application be approved.
8. SITE PLAN / PLOT PLAN: The applicant is required as part of this application to submit a site/ plot
plan drawn AS NEAR TO SCALE as possible showing the lot boundaries, dimensions of existing
and /or proposed buildings and the distances from said buildings to said lot boundaries and all in-
formation relevant to the consideration of the application. A copy of the site /plot plan should ac-
company each copy of the application required to be filed. When the applicant is required under
Section 10.11 of the Zoning Ordinance to file a site plan, a plot plan is not required.
9. Applicant shou!d state sufficient reasons upon which the Board of Appeals can base a finding that
the applicant has met the requirements as set forth in either the General Laws of Massachusetts or
the Zoning Ordinance of the City of Northampton, Massachusetts. Applicant should review these
requirements prior to completing this item. (Attach additional sheets, if necessary)
10. Notice of the public hearing is required to be mailed, postage prepaid, to
all "parties in interest" as defined in Massachusetts General Laws, Chapter
40A, Se;tion 11. "Parties in interest ", as used in this chapter, shall mean
the petitioner, abutters, owners of land directly opposite on any public or
private street or way, and abutters to the abutters within three hundred feet
of the property line of the petitioner as they appear on the most recent app-
licable tax list, notwithstanding that the land of any such owner is located
in another city or town, the planning board of the -city or town, and the
planning board of every abutting city or town."
11. Read and sign the application. If the applicant is a corporation, partnership, trust or other business
entity, a duly authorized officer should sign. An attorney or other duly authorized representative of
the applicant may sign on behalf of the applicant.
ADDITIONAL COPIES: In addition to the original application form eleven copies of the complete
application are required. It is the responsibility of the applicant to provide these copies.
FILING FEE: A filing fee of $75.00 for a variance, $50.00 for a special permit, plus $2.00 per abut-
ter listed, is required to be paid upon the filing of the application with the Building Inspector.
The applicant should be aware that if the application is approved, the Board of Appeals may, in its
discretion, and in addition to any applicable conditions specified in the zoning ordinances, impose
such additional conditions as it finds reasonably appropriate to safeguard the neighborhood or
serve the purposes of the zoning ordinances. Such conditions will be imposed in writing and the
applicant may be further required to post bond or other security for compliance with said conditions
in an amount satisfactory to the Board.

7. Description of proposed work and / or use: The applicant has
conducted, prior to the rezoning in 1975, an auto body
shop, repair shop and towing garage where the applicant
has repaired vehicles and has done body work and to which
garage vehicles were towed. The applicant wishes to extend
the garage by adding an addition of approximately 2720 sq.
ft. in order to have an additional 2600 sq. ft. of area for
repair and autobody work. The remaining portion will be
used for offices.
The applicant, therefore,.is requesting a finding under
§9.3 to extend his nonconforming use.
9. Set forth reasons upon which applicat is based German
Automotive 's work load has increased considerably over the
years due in part, probably to the large increase of auto-
mobiles on the highways and the desire of people to retain
their vehicles longer, thereby repairing and fixing them up
more than in the past. The high price of vehicles also con-
tributes to this. As a result, German Automotive needs to
add additional space to its existing garage to accommodate
the increased volume of its business. The present use as
an autobody and repair station was a permitted use when the
structure was built. This use is now a nonconforming use.
Even though the extension is for the specific nonconforming
use, the applicant needs a permit from the Board of Appeals
to extend its nonconforming use. See Zoning Ordinance,
City of Northampton, Section 9.34.
There has been no appreciable change in the neighbor-
hood since the business was started in 1974. There are
several other businesses along this road which have expanded
in recent years and the. development has continued. The shop-
ping centers immediately to the south are now fully developed
and there is increasing pressue for business in this part of
town. This proposed extension will not be substantially more
detrimental to the neighborhood than the existing noncon-
forming use.

At a meeting held on May 14, 1986, the Zoning Board of Appeals of
the City of Northampton voted unanimously to grant the Finding request
of German Automotive, Inc. for the purpose of enlarging a pre- existing
nonconforming structure located at 605 North King Street, Northampton
(SR Zone). Present and voting were: Chairman Robert C. Buscher, William
Brandt and Peter Laband.
The findings were as follows:
W. Brandt found that the applicant operates a pre- existing
nonconforming use in a pre- existing nonconforming structure
on a pre- existing nonconforming lot, and that the Board can
grant a•permit to alter the structure if they find that such
change or alteration will not be substantially more detrimental than
the existing structure, as set forth in Section 9.3 of the Northampton
Zoning Ordinance. He found that the addition will not be substantially
more detrimental to the neighborhood, but rather will enhance the
community and area by beautifying the lot.
P. Laband concurred that the addition will not be more detrimental
than the existing situation.
R. Buscher also concurred that the addition will not be more
detrimental than the existing structure.
The following condition shall apply:
That the applicant shall surround the storage of any
"junk" vehicles with fencing and live screening at any

Decision on Application of German Automotive, Inc.
May 14, 1986
The Zoning Board of Appeals of the City of Northampton met on Wednesday, May 14,
1986 in Council Chambers, Wallace J. Puchalski Municipal Building at 8:25 p.m. to
render their decision on the request of German Automotive, Inc. for a Finding under
the provisions of Section 9.3 (B), Page 9.2 of the Zoning Ordinance of the City of
Northampton for the purpose of enlarging a pre- existing nonconforming structure located
at 605 North King Street, Northampton (SR Zone). Present and voting were:
Chairman Robert C. Buscher, William Brandt and Peter Laband.
It was moved, seconded and voted unanimously to approve the minutes of the
4/2/86 public hearing without a public reading.
W. Brandt found that the building is currently a pre- existing nonconforming
structure, as the rear setback is less than 40 ft.;on a pre- existing nonconforming
lot, as the average lot depth is 115 ft. in a zone which requires 160 ft.; with a
pre- existing nonconforming use, and as such, the applicant operates a pre- existing
nonconforming use in a pre- existing nonconforming structure on a pre- existing non-
conforming lot. He also found that the Board can grant a permit to alter the
structure if they find that such change or alteration will not be substantially more
detrimental than the existing structure, as set forth in Section 9.3 of the Northampton
Zoning Ordinance.
Mr. Brandt found that the addition will not be substantially more detrimental
to the neighborhood, but rather will enhance the community and area by beautifying
the lot.
P. Laband concurred that the addition will not be more detrimental than the
existing situation.
R. Buscher concurred that the addition will not be more detrimental than
the existing structure.
It was moved, seconded and voted unanimously to approve the Finding request
with the following condition imposed:

At their meeting on March 27, 1986, the Northampton Planning Board reviewed
the request of German Automotive, Inc. for a Finding for the purpose of
enlarging a pre- existing nonconforming structure located at 605 North King
Street, Northampton (SR Zone).
After discussing the matter with the applicant and his representative and
hearing the report of the site inspectors, the Planning Board voted 5 -0 to
recommend approval of the Finding request with the following restrictions:
1. That any disabled vehicle on the lot be screened or removed.
2. That the proposed building be designed in such a manner as to be
sensitive to the fact that it will be located in a SR zone.

DECISION OF
NORTHAMPTON ZONING BOARD OF APPEALS
At a meeting held on November 15, 1989, the Zoning Board of
Appeals of the City of Northampton voted UNANIMOUSLY to GRANT
the request of Norbert Schulte for a modification of a
Finding granted by this Board on May 14, 1986, to allow
construction of a 10' x 22' addition to the rear of the
building that the 1986 Finding allowed, all at 605 North King
Street, Northampton. Present and voting were Chairman Robert
C. Buscher, Dr. Peter Laband, and M. Sanford Weil, Jr.
The Findings are as follows:
The Board finds that the criteria which must be met in order
to modify a Finding are the same criteria that had to be met
to receive the original Finding, i. e., the proposed change
will not be substantially more detrimental to the
neighborhood than the existing, nonconforming building.
The building addition is being constructed solely for safety
reasons. The addition will not be visible from the street.
There are no close abutters, and the neighborhood will not
be affected.
The Board finds that the proposed addition will in fact not
be substantially more detrimental to the neighborhood than
the existing structure.

The Northampton Zoning Board of Appeals met at 7:20 p. m. on
Wednesday, November 15, 1989 in Council Chambers, Wallace J.
Puchalski Municipal Building, 212 Main Street, Northampton, to
conduct a Public Hearing on the Application of Norbert Schulte for
permission to modify a Finding granted by this Board on May 14,
1986 to allow construction of a 10' x 22' boiler room at the rear
of the existing structure at 605 North King Street (German
Automotive) . Present and voting were Chairman Robert C. Buscher,
Dr. Peter Laband, and M. Sanford Weil, Jr.
Ch. Buscher opened the Public Hearing by reading the Application,
the Legal Notice, and a memorandum from the Northampton Planning
Board. Norbert Schulte appeared, and said all he was trying to
do was "Keep fire away from fumes - -get the furnace out of the

Ch. Buscher inquired, "The addition will have two rooms - -one for
the furnace and one for storage ?" Mr. Schulte replied, "The whole
thing is safety."
Dr. Laband said, "I looked at it and have no problem" Mr. Weil
agreed.
There being no one present to speak in favor or opposition, Dr.
Laband moved the Public Hearing be closed. Mr. Weil seconded, and
the motion passed unanimously.
Dr. Laband said, "No one will even be aware of the addition. It's
not substantially more detrimental to the neighborhood." Mr. Weil
concurred, and Ch. Buscher said, "I agree. To amend we use the
same standards as to grant. The Applicant has a building with no
close abutters. The neighborhood will not be affected."
Dr. Laband moved the Amendment to the Finding be granted, to allow
construction of the addition. Mr. Weil seconded, and the motion
passed unanimously.

date GRANTING the request to amend the Finding.
