CONDITION OF APPROVAL:
1)Prior to issuance of a building permit, final revised plans as required herein shall be submitted to the
Office of Planning and Sustainability including details for dumpster enclosure and planting plan.
References to alley names and walkways shall be corrected. Existing utilities in the passageway and
Masonic Street as well as proposed locations of the new service lines shall be shown.
2). Prior to construction, tree protection should be installed according to the certified arborist report
for all three trees (including the maple off site). Notice of inspection by the arborist shall be
submitted to Office of Planning and Sustainability.
3). The arborist shall be onsite during demotion of the foundation and excavation of the new
foundation to ensure that proper treatment of the root systems encountered during this process are
followed.
4). If the Silver Maples dies within 3 year from the start of demolition, the applicant and/or property
owner(s) shall remove the tree and replace the fence. Tree replacement for the dead tree shall be will
replace the tree in accordance with 12.3.
5). A copy of or book and page reference to the recorded Condominium Declaration of Covenants,
Conditions and Restrictions shall be provided to the DPW.
FINDINGS:
The Planning Board approved the Site Plan Application for redevelopment of 72 Masonic Street for a new 3 story, 3-unit residential
building based upon the following plans and materials submitted with the application:
1. Review Submittal Set by Berkshire Design, Inc. for SWC Properties, Revised Date 12/21/18.
The Planning Board approved the application upon finding that the criteria in the zoning Chapter 350-11.6 had been met.
1. Specifically, the requested use protects adjoining premises against seriously detrimental uses. Residential uses are allowed by right.
The three-story building will be taller than the existing structure and meet the minimum 30’ height requirements. Surface water drainage
from the new building will drain in the same way as under existing conditions; and
2. The requested use will promote the convenience and safety of vehicular and pedestrian movement within the site and on adjacent
streets, the existing access to the site from Masonic Street will remain via the shared alley,
a. Access by nonmotorized means will be the same as existing however dedicated pedestrian connection to the new structure as well as
bicycle storage will be created.
b. The site will function harmoniously in relation to other structures and open spaces to the natural landscape, existing buildings and
other community assets in the area as it relates to landscaping, drainage, sight lines, building orientation, massing, egress, and

setbacks. All trees will be protected on site.
3. The requested use will not overload, and will mitigate adverse impacts on, the City's resources.
4. The requested use does not trigger any additional compliance requirements.
5. Compliance with the following technical performance standards:
Curb cuts onto streets shall be minimized, using the existing alley access.
