Dear Mr. Veleta:
We have reviewed your application to permanently discharge 748 square feet of fill below
the Ordinary High Water (OHW) mark of waters of the United States associated .with slip-lining
and related work at three culverts conveying Burts Pit Road over two unnamed tributaries to
Parsons Brook in Northampton, Massachusetts.· The ·first stream crossing conveys a perennial
stream and involves the lining of the existing 48'' CMP (corrugated metal pipe) with a 42''
circular HDPE (high-density polyethylene) pipe. A beveled inlet will be installed to improve
hydraulic efficiency. The second stream crossing conveys an intermittent stream and involves
the lining of twin 29'' by 41 '' ovalized CMP pipes with 22.5 '' by 36'' ovalized HDPE pipes. A
new concrete headwall will be installed at the inlet. The new pipes will be installed off-center
such that the inverts of the culverts are approximately 1" vertical above the existing invert
elevations. Natural rock ramps are proposed at the outlets to facilitate upstream movements of
aquatic species. The project also includes 3,399 square feet of temporary impacts below OHW
and within vegetated wetlands associated with construction access and dewatering behind control
of water structures. The work is shown on the enclosed plans entitled ''CONTRACTS 2018
BURTS PIT ROAD PAVING AND ROADWAY IMPROVEMENTS U SACE PCN'', on two
sheets (labeled P-1 and P-2) with revision dates of ''10/17 /2018 '', and ''CONTRACTS 2018
BURTS PIT ROAD CULVERT RELINING PROJECT'' on two sheets (labeled D-1 and D-2)
dated ''09 /05 /2018'' (sheet D-1 revised ''10/17./2018'').
Based on the information you have provided, we have determined that the proposed actiyity,
which includes work and/or a discharge of dredged or fill material into waters of the United ·
States, including wetlands, will have only minimal individual or cumulative .environmental
impacts. Therefore, this work is authorized under the enclosed April 2018 Massachusetts
General Permits (MA GPs ), specifically GP 10 , under the pre-construction notification process.
This work must be performed in accordance with the terms and conditions of the GPs.
You are responsible for complying with all of the G:Ps ' requirements. Please review the
enclosed GPs carefully, in particular the general conditions beginning on Page 19 , to be sure tp.at
you understand its requirements. You should ensure that whoever does the work fully
understands the requirements and that a copy of the GPs and this authorization letter are at the
project site throughout the time the work is underway.

This authorization requires you to complete and return the enclosed Work Start Notification
Form to this office at least two weeks before the anticipated starting date . You must also
complete and return the enclosed Compliance Certification Form within one month following the
completion of the authorized work.
This permit does not obviate the need to obtain other Federal, State, or local authorizations
required by law. Performing work not specifically authorized by this determination or failing to
comply with all of the terms and conditions of the GPs may subject you to the enforcement
provisions of our regulations.
This authorization presumes that the work as described above and as shown on your plans
noted above is in waters of the U.S . Please submit a request for an approved jurisdictional
determination to this office in writing if you desire to appeal our jurisdiction.
This authorization expires. on April 5, 2023, unless it is modified, suspended, or revoked
before then. You must commence or have under contract to commence the work authorized
herein by April 5, 2023 and complete the work by April 5, 2024. If not, you must contact this
office to determine the need for further authorization before beginning or continuing the activity.
We recommend that you contact us before this authorization expires to discuss a time extension
or permit reissuance. Please contact us immediately to discuss modification of this authorization
if you change the plans or construction methods for work within our jurisdiction. This ·office
must approve any changes before you undertake them.
