Therefore, the Northampton Conservation Commission hereby finds that the following
conditions are necessary, in accordance with the Performance Standards set forth in the
regulations, to protect those interests checked above. The Conservation Commission orders that
all work shall be performed in accordance with said conditions and with the Notice of Intent
referenced above. To the extent that the following conditions modify or differ from the plans,
specifications or other proposals submitted with the Notice of Intent, the conditions shall control.
General Conditions:
1. Failure to comply with all conditions stated herein, and with all related statutes and other
regulatory measures, shall be deemed cause to revoke or modify this Order.
2. The Order does not grant any property rights or any exclusive privileges; it does not
authorize any injury to private property or invasion of private rights.
3. This Order does not relieve the permittee or any other person of the necessity of
complying with all other applicable federal, state or local statutes, ordinances, by -laws or
regulations.
4. The work authorized hereunder shall be completed within three years from the date of
this Order unless either of the following apply:
(a) the work is a maintenance dredging project as provided for in the Act; or
(b) the time for completion has been extended to a specified date more than three
years, but less than five years, from the date of issuance and both that date and the
special circumstances warranting the extended time period are set forth in this
Order.
5. This Order may be extended by the issuing authority for one or more periods of up to
three years each upon application to the issuing authority at least 30 days prior to the
expiration date of the Order.
6. Any fill used in connection with this project shall be clean fill, containing no trash,
refuse, rubbish or debris, including but not limited to lumber, bricks, plaster, wire, lath,
paper, cardboard, pipe, tires, ashes, refrigerators, motor vehicles or parts of any of the
foregoing. The applicant is prohibited from using demolition materials, asphalt,
large chunks of concrete, tree stumps and limbs, and general refuse;
7. No work shall be undertaken until all administrative appeal periods from this Order have
elapsed or, if such an appeal has been filed, until all proceedings, before the Department
have been completed.
No work shall be undertaken until the Final order has been recorded in the Registry of
Deeds or the Land Court for the district in which the land is located, within the chain of

title of the affected property. In the case of recorded land, the Final Order shall also be
noted in the Registry's Grantor Index under the name of the owner of the land upon which
the proposed work is to be done. In the case of registered land, the Final Order shall also
be noted on the Land Court Certificate of Title of the owner of the land upon which the
proposed work is to be done. The recording information shall be proposed work is to be
done. The recording information shall be submitted to the Commission on the form at the
end of this Order prior to commencement of the work. The Commission usually will
record the Order in the Registry of Deeds. It is the applicant's responsibility to
insure the Order is properly recorded.
9. A sign shall be displayed at the site not less than two square feet or more than three
square feet in size bearing the works, "Massachusetts Department of Environmental
Protection, File Number 246- 444 ."
10. Where the Department of Environmental Protection is requested to make a determination
and to issue a Superseding Order, the Conservation Commission shall be a party to all
agency proceedings and hearings before the Department.
11. Upon completion of the work described herein, the applicant shall forthwith request in
writing that a Certificate of Compliance be issued stating that the work has been
satisfactorily completed.
12. The work shall conform to the following plans and special conditions:

SPECIAL CONDITIONS:
13. The Commission and its agents shall have the right to enter and inspect the property at
any time to monitor for compliance with the conditions of this Order, the Act, and
Wetlands Protection Regulations: 310 CMR 10.00 and Chapter 24 of the City's
Ordinances: "The Wetlands Protection Ordinance ". They shall have the right to request

and receive any data or documentation that is deemed necessary for evaluation of
compliance.
14. This Order of Conditions shall apply to any successor in interest or successor in control;
15. The owner of the property described in this Order, must advise any potential buyer of the
property that any construction or alteration to said property, including brush cutting or
clearance, may require approval by the Northampton Conservation Commission.
Any instrument conveying any or all of the owners' interest in said property or any
portion thereof, shall contain language similar to the following:
"This property is subject to the Northampton Wetlands Protection
Ordinance and/or Wetlands Protection Act. Any construction or
maintenance work performed on this property requires an Order of
Conditions, and/or a Determination of Applicability from the Northampton
Conservation Commission ";
16. The contractor is as responsible as the applicant and property owner for any violations of
the Orders of Condition and penalties under the law, while all activities regulated by this
Order are being performed.
17. A copy of this Order and associated plans shall remain on site during all construction
and/or building activities. The project manager and all equipment operators shall be
familiar with the approved plans, and shall be informed of their location on the site.
This location shall be accessible to all contractors whenever work is occurring on
site.
18. All required permits must be obtained from the Army Corp of Engineers (Section 404,
Water Quality Certification), Planning Board, Zoning Board, Department of Public
Works, or Building Inspector prior to the start of projects involving fill within any
wetland resource area;
19. No disposal of soils or other materials shall be allowed within: a 100 -year floodplain; 40
feet of the 100 -year floodplain elevation; any wetland; or any area within 100 -feet of a
wetland, unless such areas are specifically approved by the Commission, in accordance
with 310 CMR 10. 00, and City of Northampton Ordinances - Chapter 24;
20. Any change or deviation from the Notice of Intent, plans and/or Order of Conditions
approved by the Commission, prior to or during construction, shall require the applicant
to file a request for an amendment with the Conservation Commission. It shall include a
written inquiry as to whether or not the change is substantial enough to require the filing
of a new Notice of Intent.

After making a positive determination, the Commission shall conduct a public hearing to
amend the Order or to issue a new Order, if a new Notice of Intent is required.
21 In accordance with General Condition 8 on page 5 -2 of this Order, this Order shall be
recorded at the Hampshire County Registry of Deeds by the Northampton Conservation
Commission prior to commencement of work on the site.
22. All revised plans, referenced within this Order of Conditions, shall be approved by the
Conservation Commission and incorporated into this Order by reference and shall be
followed during the course of construction.
23. Ongoing conditions that shall not expire with the issuance of a Certificate of Compliance
are as follows:
(None).
PRE - CONSTRUCTION REQUIREMENTS:
24. Prior to the start of any site work, excavation or construction, a preconstruction
conference shall be held on the site, between the contractor conducting the work, the
site /project engineer, the applicant, and a member or agent of the Conservation
Commission, in order to ensure that the requirements of this Order are understood by all
parties. Prior to the pre - construction meeting, all erosion control devices must be
installed, also.
REQUIREMENTS DURING ACTIVE CONSTRUCTION:
EROSION AND SEDMENTATION CONTROL:
25. Areas of construction shall remain in a stable condition at the close of each
work/construction day:
A. Erosion controls shall be inspected at this time, and after each rainstorm.
B. Any entrapped silt shall be removed to an area outside of the buffer zone
and wetland resource areas.
C. Any breaches in the siltation barriers shall be repaired prior to leaving the
site for the day.
D. All erosion controls must be maintained or reinforced to meet
specifications in the plans and this order and shall be replaced as
necessary.
E. An adequate stockpile of erosion control materials shall be on site at all
times for emergency or routine replacement. The stockpiles equipment

shall include materials to repair silt fences, haybales, or any other devices
planned for the control of erosion at the site.
POST CONSTRUCTION SUBMITTALS & WORK IN BUFFER ZONE:
26. Upon completion of the project, the Applicant shall submit a certification that all work
has been done in conformance with the provisions of the Order of Conditions and request
a Certificate of Compliance.

State Police Barracks Sewer Installation

Dear Commission Members:
Please find enclosed nine (9) copies of a Notice of Intent for the installation of a sewer line on
the property of the State Police Barracks at 555 North King Street in Northampton, MA. A
portion of the sewer will be constructed within the riparian zone of an un -named perennial
stream, however all of the work will occur within existing pavement and lawn area, and all
conditions will be restored upon the completion of the project.
This filing is made pursuant to the limited project provisions of the Massachusetts Wetlands
'— Protection Act and the City of Northampton Wetlands Ordinance. Two copies of this application
have been submitted to the Mass. Dept. of Environmental Protection, and the filing fees have
been submitted (including the City Ordinance fee of $35.00). The abutters have been notified as
required by the Act.
There is some urgency to complete this project since there is only a temporary sewer connection
presently serving the barracks. It is requested that, if a site visit is to be conducted, that it occur
prior to the April 26' meeting so that any outstanding issues may be addressed prior to the
hearing. Please contact our office if a site visit can be arranged. Thank you for your attention to
this matter.

ADDENDUM TO NOTICE OF INTENT
State Police Barracks Sewer Line Installation
SSS North King Street

INTRODUCTION
The purpose of this project is to connect the State Police Barracks to the municipal sewer system
within North King Street due to the failure of an existing on -site septic system. A temporary
connection to the sewer is presently in place, however it must be replaced with a permanent
system. This Notice of Intent addresses the design and installation of the permanent system, a
portion of which will be constructed within the inner and outer riparian zone of an un -named
perennial stream.
That portion of the project within jurisdictional areas includes the following features (Please
refer to Plan L -1);
• Installation of approximately 280 linear feet of 6 -inch PVC sewer line within the
riparian zone. This line will extend from a lawn area adjacent to the southwest
side of the main building, southward around the rear of the building (within
pavement), and then northward where it will connect to the proposed pump
station. A pump station is required since the elevation of the property is too low
to allow for gravity feed to the municipal sewer. The pump station is located
outside of any jurisdictional area.
• Removal of an existing septic tank within the riparian zone (adjacent to troop
clerk's office). This tank was part of the former on -site septic system and has no
further use. It will be cleaned of all contents, excavated, and removed. The
excavation will be backfilled with clean material, and all grades shall be restored.
• Installation of an oil/water separator at the vehicle maintenance area. The
discharge from the drains within the maintenance area will be directed into the
sewer system.
• Recondition an existing parking area at the rear of the facility.

RESOURCE AREAS
An un -named perennial stream exists on the subject property, to the south and west of the work
area. The flow characteristics were determined from the most recent edition of the U.S.
Geological Survey quadrangle map for the site, which depicts the stream as a solid line thus
indicating perennial flow. The stream flows from north to south, extending from a culvert
within North King Street to a culvert within Route 91. It is located within a deep gully with side
slopes in excess of 1:1. The channel is approximately 6 -8 feet in width, however during high
flows the edge of water appears to extend to the toe of the steep side slopes based upon sediment
deposits and scour. The stream is a Class B waterway as listed in the Massachusetts Surface
Water Quality Standards (1990). There is not a 100 -year flood plain associated with the stream
(Figure 2), and no rare /endangered species habitat is shown to exist within the project area
(Figure 3).
The stream corridor was inspected for wetland resource areas by a qualified wetland scientist in
March 1999 pursuant to the resource area definitions contained in the Massachusetts Wetlands
Protection Act Regulations and the City of Northampton Wetlands Ordinance. Pockets of
wetland vegetation were identified on sediment deposits at bends in the channel (Symplocarpus
foetidus and Impatiens capensis), however it was determined that the average high water line
exceeded the limits of the small pockets of bordering vegetated wetland. This high water line
— extended to the toe of the steep slope, which rises from the stream channel at a slope exceeding
1:1. For this reason, the toe of this steep slope was delineated as bank and used to determine the
— extent of the riparian zones. The bank is marked in the field with blue surveyor's flagging, and
numbered as shown on Plan Sheet L -1. These flags were survey located, relative to the site
property boundary. The flags were used to establish the limits of the inner and outer riparian
zones. No bordering vegetated wetland field data forms were completed since the outermost
resource area consisted of bank rather than vegetated wetland.
RESOURCE AREA IMPACTS
The project involves approximately 5,000 square feet of work within the riparian zone, of which
1,800 square feet will occur within the inner riparian zone. The work consists of the excavation
of a trench four feet in width (a ten -foot wide area of disturbance was assumed for the impact
calculations), and the restoration of grades and cover after the utility installation.
This project is classified as a "limited project" in the Massachusetts Wetlands Protection Act
Regulations (3 10 CMR 10.53(3d)) and all three of the criteria established for limited projects
involving utilities have been addressed. A route was selected which avoids direct impacts to
bordering vegetated wetland, land under water, and bank; no changes in grade are proposed, and
all vegetation will be restored upon completion of the project (lawn area).

.. Relative to the riverfront area, the regulations allow for the installation of utilities provided that
the area is restored to its pre - construction condition (3 10 CMR 10.58 (4)(3d)). This restoration is
specified in the plans, thus there will be no significant adverse impact to the brook associated
with this project. The riverfront area performance standards will be met.
MITIGATION MEASURES
Mitigation of potential impacts to the stream corridor involves the use of various erosion control
_ devices as shown on Plan Sheet L -1. The following measures are incorporated into the project
plans:
• Installation of a haybale erosion control barrier where work is proposed within a
lawn area. This barrier will be securely tied into the curb area where the trench
meets the pavement, so that runoff' cannot extend around the barrier.
• Installation of a protective ring of haybales around all catch basins within the
work area. Soil excavated from the trenches within the paved and gravel areas
will be placed along the trench. Runoff from these piles is collected by various
catch basins, and discharged to the stream via existing outfalls. Runoff will be
filtered by the haybale rings prior to entering the catch basins.
• Loam, seed, and hay mulch will be placed on the trench section within the lawn
area upon completion of the backfill.
Existing grades and cover types will be replaced upon the completion of the project, and no long-
- term impacts to any wetland resource areas are anticipated due to this project.
STORMWATER POLICY
— This project consists of the installation of a utility line and will not result in any modification to
the existing drainage conditions of the site. No work on any stormwater outlet or catch basin is
— proposed, and the runoff' curve number for the site will not be modified. Since there is no
increase in impervious area, no detention to address changes in peak flow rates is required.
