The Zoning Board of Appeals granted the the Finding for the change in one non-conforming use to a new non-conforming use in the
Water Supply Protection zone based on the following materials and plans submitted with the application:
1).Site Plan for 1010 Ryan Road Prepared for Just Healthy LLC by The Berkshire Design Group dated July 1, 2018, Revised August 6,
2018. Sheets L1,2; C1-5; Sec 107; A301, A302.
2) Proposed Stormwater Management Plans, Waterstone Engineering, Final Date 7/13/18. Sheets D1-D4; ES1-2; R1, DA1,DA2.
3) Stormwater Management Report 1010 Ryan Rd, by Waterstone Engineering, PLLC.
4) Memorandum from Jonathan Slason, PE/CoreyMack, PE of RSG, Inc. regarding traffic and noise. Dated July 11, 2018.
5) Proposed open space areas sheet R2 The Berkshire Design Group, Inc. July 19, 2018.
The Findings of the Board under Section 9.3 for the change in use were as follows:
1. The Board found that the change to a greenhouse production facility with administrative building would not be substantially more
detrimental to the neighborhood than the existing nonconforming industrial gravel operations. The Board determined that the reduction
in traffic and elimination of the use of heavy equipment, restoration of wetlands, reduction in noise and light pollution as well as
installation of odor monitoring would be an improvement to the neighborhood.
2. The change would not create any new violation of other zoning provisions; and does not involve a sign.
