NOTICE OF SUBDIVISION AMENDMENT APPROVAL
The Planning Board by 3-0 vote on July 26, 2018 APPROVED with Conditions an Amendment to the Emerson Way (formerly known as “Oaks”) Subdivision

On July 26, 2018, pending termination of the statutory twenty day appeal period.
The Planning Board approved the request to allocate 6 of the required 8 affordable housing units from 3 duplex lots to the Burts Bog development on Burts Pit Road. The 6 units shall
be built either in conjunction with Habitat for Humanity at the Burts Bog Development or be constructed as originally planned on the lots laid out for Emerson Way being 4/5 lot 25/26,
lot 39/40.
As presented in the application to the Planning Board, if Emerson Way LLC for any reason cannot negotiate the construction of the lots at Burts Bog, the affordable housing units shall
be constructed as originally approved at Emerson Way.
The Planning Board granted the amendment with the following condition:
Prior to issuance of any further building permits at Emerson Way, the applicant shall record a lot sale covenant on lots 4/5, 25/26; 39/40 that restricts the sale of these lots until
documentation is provided to the Planning Board that building permits for affordable housing units at Burts Bog have been submitted for approval in order to satisfy the requirement
for building 6 units of affordable housing. For every two units of affordable housing building permit applications submitted to the City of Northampton at Burts Bog, one lot may be
released this covenant.
As agent to the Planning Board I, Carolyn Misch, attest that this is the decision made by the Planning Board at its public hearing July 26, 2018.
