Dear Mr. Myette:
Recently an ANR plan was submitted to redefine properties, formerly owned by Mary Rose
O'Connell, along Riverbank Road. Under subdivision rules, the Planning Board signed the new
property boundary layout to apparently correct errors at the Registry of Deeds.
It later came to our attention that you obtained some of Ms. O'Connell's property, which abutted
your property, and subsequently sold a portion of it to Cynthia McDonald. Under the
Northampton Zoning Ordinances, the SC zoning district in which your property is located
requires a minimum lot size of 50,000 square feet. Assessor data show that you had less than
5,000 square feet prior to obtaining additional property from Ms. O'Connell and therefore your
lot was non-conforming. Purchasing the property from Ms. O'Connell brought your property
closer to meeting the zoning requirement of 50,000 square feet. Once you add property to a non-
conforming lot, you may not sell property that makes your property more non-conforming than it
was at the time that you held the property(§9.3-3A). ,
Based upon the ANR that was filed, the Office of Planning&Development and the Assessors
office have created a newly merged lot that contains the property that you obtained from Ms.
O'Connell. This new lot excludes the 4,000+square foot piece that you sold to Cynthia
McDonald in violation of the Northampton Zoning Ordinance. You may not sell any more of
this land in a way that reduces your total lot size below your current acreage, or below 50,000
square feet whichever is less.
