13-026A 454 north king streetr� DECISION OF NORTHAMPTON ZONING BOARD OF APPEALS At a meeting held on June 29, 1988, the Zoning Board of Appeals of the City of Northampton voted unanimously to GRANT the request of Frederick J. Fill, Jr. and Dorian B. A. Fill for a Variance from the Provisions of Section 6.2 of the Northampton Zoning Ordinance for the purpose of allowing the converting of a one -car garage to a two -car garage, thereby violating the southerly side setback at their residence at 454 North King Street, Northampton, in a Rural Residential District. Present and voting were Acting Chairman Dr. Peter Laband, Irene David, and M. Sanford Weil, Jr. The Findings were as follows: The Variance is requested for a specific parcel of land and an existing structure. There is a serious soil /topographical condition, a rock ledge, which affects this parcel only and not the rest of the District. Literal enforcement of the Ordinance would result in a serious hardship, since it is virtually impossible, and certainly extremely expensive, to build a garage at the rear of the structure where the rock ledge begins. Granting the Variance would not be a substantial detriment to the public good, and it is noted that the abutter whose side setback will be violated has stated, in writing, that she has no objection to the addition to the garage. �1. a'("_ L'L Dr. Peter Laband, Chairman Irene David M. Officer Date P tolp J Northampton Zoning Boa, )f Appeals Decision on Application of Frederick & Bertha Fill October 15, 1986 The Zoning Board of Appeals of the City of Northampton met on October 15, 1986 at 7:40 p.m. in Council Chambers, Wallace J. Puchalski Municipal Building to render their decision on the application of Frederick and Bertha Fill for a Finding under the provisions of Section 9.3, Paragraph A.1, Page 9.1 of the Zoning Ordinance of the City of Northampton for the purpose of adding a second level onto a pre- existing nonconforming structure at property located at 454 North King Street, Northampton (RR Zone). Present and voting were: Chairman Robert C. Buscher, William Brandt and Kathleen M. Sheehan. It was moved, seconded and voted unanimously to approve the minutes of the public hearing on September 17, 1986 without a public reading. The chairman reviewed Section 9.3 (A.1). W. Brandt found that the proposed addition of a second story would not crate a new violation of the Zoning Ordinance, and thus, would not be substantially more detrimental to the neighborhood. K. Sheehan found that the addition would not be substantially more detrimental to the neighborhood than the existing structure. R. Buscher found that an additional story onto this pre- existing nonconforming single - family dwelling would have a positive effect on the neighborhood.
