The intent of the original submission was to seek an Order of Conditions (OOC) that would allow a select set of routine and predictable maintenance activities to occur within the water resources associated with the Smith College campus without the need for new individual permitting. GZA received ini- tial comments via email in September 2016 from DEP-WERO (David Foulis) and NHESP (Misty- Anne Marold). A DEP File No. was not issued. Based upon discussions of these comments with DEP-WERO and NHESP, it was agreed that the NOI required significant modification to provide clarifications of excluded work activities and a reduced and refined set of mainte- nance activities seeking to be permitted. This resubmission represents those modifications to satisfy regulatory concerns. The enclosed NOI narrative and documentation replaces the originally-submitted NOI, including all attachments and appendices, for this project. The revised set of maintenance activities requested for approval under this NOI were selected to have de minimis impacts to wetland resources, below any thresholds that would invoke any additional permit review or require separate permits with the Army Corps of Engineers (ACOE), NHESP, and/or DEP. As such, the revised set of activities all qualify for “Self-Verifica- tion” under the ACOE General Permit and are acceptable for a “no effect” determination from NHESP (to be formally received as part of this permit process prior to issuance of any OOC for the revised NOI). During preparation of the revised NOI, GZA had numerous communications with NHESP, including an on-site meeting held on July 13, 2017, to discuss and establish ac- ceptable limitations or conditions on the revised set of maintenance activities that would be necessary in order to avoid a “take” of rare or endangered species or their habitat and those limitations are included herein. The revised set of maintenance activities included within this NOI, as defined and circum- scribed herein, are limited to: (1) Pre-defined, highly-limited drawdown (in duration and degree) of Paradise Pond, for pur- poses of periodic dam maintenance. (2) Definable activities within resource areas that meet performance standards for resource areas, are not considered impact, and/or have no cumulative impacts (i.e., that might trip regulatory thresholds for MEPA or other permits). (3) Activities that are considered “normal maintenance of existing structures” (without ex- pansion of the existing footprint or any requirement to alter resource areas to conduct the needed maintenance work). As detailed in the revised NOI narrative, all maintenance activities will be identified and coor- dinated with the Northampton Conservation Commission prior to implementation to confirm April 27, 2018 File No. 15.0407120.9 Water Resources Maintenance Activities Page | 2 An Equal Opportunity Employer M/F/V/H Proactive by Design that they meet the conditions of the OOC. It was never the intention to seek approval under this NOI for all activities within the comprehensive WRAMP. Therefore, this current resubmittal NOI no longer includes a copy of the WRAMP. (GZA) has prepared this Notice of Intent (NOI) application to provide the Northampton Conservation Commission (NCC) with a proposed plan regarding routine maintenance activities along portions of the Mill River and adjacent jurisdictional areas on campus grounds. The desire is that Smith College will be able to conduct low or no-impact maintenance activities within the Mill River corridor, including Paradise Pond and Lyman Pond under a single Order of Conditions (OOC). Similar activities for Paradise Pond were approved by NCC under a previous OOC issued June 28, 2007 (DEP File # 246-0580; extended by the Permit Extension Acts of 2010 and 2012 and which expires 06-28-18). Due to the nature of the activities, routine maintenance will need to continue past this date. With the addition of the mainte- nance activities at and in the vicinity of Lyman Pond and the Mill River, this current NOI application is meant to replace the previous OOC and will extend permit coverage to include the proposed activities along portions of the Mill River and Lyman Pond. As part of this NOI, the Applicant respectfully requests that the OOC under DEP File # 246-0580 remain in force during the consideration of this current NOI submittal and only be terminated as a valid OOC if and when the new OOC is issued, which incorporates the activities currently authorized under this existing permit. There are no areas of Bordering Vegetated Wetlands (BVW) affected by the activities proposed under this NOI. 2.0 EXISTING CONDITIONS The maintenance areas subject to this NOI submission includes Paradise Pond, Lyman Pond and some jurisdic- tional areas along the margins of these resources and portions of the Mill River (Appendix A). Paradise Pond is a 9.9± acre impoundment of the Mill River located to the west of the Smith College main campus and to the north of the college athletic fields. The Mill River enters Paradise Pond from the west and continues southwest of the dam. Paradise Pond is impounded by a man-made dam and contained by an earthen dike on its southwest side. The outflow is controlled by the elevation of the flashboards in place along the top of the dam and a low-level outlet which is normally closed. Paradise Pond is currently utilized for both academic and recreational resources for Smith College students and faculty, as well as local residents and visitors. Recreational uses include walking, jogging, fishing, boating, and wildlife viewing. A walking trail runs adjacent to the Mill River and Paradise Pond. Lyman Pond is a small, man-made ornamental landscape feature located to the south of the Lyman Conservatory building, directly to the east of Paradise Pond. April 27, 2018 Water Resources Maintenance Activities 15.0407120.9 Page | 2 2.1 JURISDICTIONAL AREAS The Site contains both Estimated Habitats of Rare Wildlife and Priority Habitat of Rare Species, and several re- source areas: Bank, Bordering Vegetated Wetlands (BVW), LUWW, BLSF, and RA. The wetland resource areas are regulated under both the WPA and the City of Northampton Wetlands Ordinance. 2.1.1 Estimated Habitats of Rare Wildlife and Priority Habitats of Rare Species Earlier review of the Natural Heritage and Endangered Species Program (NHESP) GIS data layer depicting the 13th Edition of the Massachusetts Natural Heritage Atlas Book (eff. 2008) indicated that the site contains Estimated or Priority Habitat for State-listed species, and no Certified Vernal Pools (Appendix A, Figure 4). A data request was sent to the NHESP on October 2, 2015. The response received from NHESP reports that there are known rare and endangered species habitats within the Site, including mapped Priority Habitat 1337 (PH 1337) and Estimated Habitat 76 (EH 76) (NHESP Tracking No. 06-19302) (Attachment C). The NHESP GIS data layer was updated in August 2017 to depict the 14th Edition of the Massachusetts Natural Heritage Atlas Book. Although the shape of the areas of Estimated and Priority Habitats have been expanded to encompass more area along the Mill River upstream of Paradise Pond, during pre-permitting discussions NHESP confirmed that the change did not result in any additional rare species habitat or species occurrences within the project area, in email correspond- ence with GZA (2/2/2018). April 27, 2018 Water Resources Maintenance Activities 15.0407120.9 Page | 3 In addition, the US Fish and Wildlife Service (USFWS) has issued a Final 4(d) rule, effective February 16, 2016, listing the Northern Long-Eared Bat (Myotis septentrionalis) as Threatened throughout Massachusetts and Connecticut and includes the Mill River/Paradise Pond project area. 2.1.2 Bank Bank is defined in the WPA Regulations as the height of the mean annual flood level or the first observable break in slope, whichever is lower. The lower limit of Bank (not delineated) is defined as the mean annual low water line (MALWL). The upper limits of Bank in the Mill River and Lyman Pond were delineated and demarcated in the field by GZA with sequentially-numbered pink flagging in August 2015. The dominant Bank vegetation includes broadleaf cattail (Typha latifolia), American bur-reed (Sparganium americanum), grape (Vitis spp.), elderberry (Sambucus nigra), and goldenrod (Solidago spp.). The tree canopy contained red maple (Acer rubrum), red oak (Quercus rubra), American beech (Fagus grandifolia), and American elm (Ulmus americana). Invasive, non-native plants that were observed on the site included several extensive stands of Japanese knotweed (Falopia japonica). Within Paradise Pond, Bank was determined by using both field indicators (the observable first break in slope) and by calculating the mean annual flood level, as it was determined not be consistently coincident with the first observable break in slope. The mean annual flood level was calculated using the statistical 1-year peak flow on the Mill River downstream of the Paradise Pond Dam, StreamStats, and NOAA Atlas 14 rainfall data. Given the impoundment of water by the flashboards, we presume that Bank is roughly equivalent to the federally-regulated Ordinary High Water (OHW), which is calculated to be 1.6 foot above the top of the flashboards (EL. 137.6). MALWL was not field-delineated, but is presumed to be at the elevation of the top of the flashboards (EL. 135.7). In the Mill River, MALWL is within the low-flow channel present during the drier times of the year. Within Lyman Pond, the height of the standpipe defines MALWL. 2.1.3 LUWW LUWW begins at the lower limit of Bank- the MALWL. This resource area is found within the Mill River, Paradise Pond and Lyman Pond. Due to the presence of the dam in Paradise Pond, the MALWL in Paradise Pond is defined at the elevation of the flashboards (EL. 135.7). Paradise Pond and Lyman LUWW is comprised of sand and muck/or- ganic materials. As mentioned in Section 2.1.2, in the Mill River, MALWL is within the low-flow channel present during the drier times of the year. Substrates are boulders, gravels, and sands within the Mill River. 2.1.4 BVW The boundaries of BVW were delineated by using the same three-parameter methodology as described by the U.S. Army Corp of Engineers (ACOE) 1987 Wetland Delineation Manual and the 2012 Northcentral and Northeast Regional Supplement for indicators of hydric soil, hydrophytic vegetation, and hydrology. The only BVW encoun- tered within the Site is a very small BVW that exists along the south margin of Lyman Pond, near the ornamental pond’s outlet structure. 2.1.5 BLSF The upper limits of the BLSF are designated by the FEMA National Flood Insurance Program to represent the lateral extent of the Base Flood (the flood magnitude with a 1.0% chance of occurring in any given year). Based upon a review of the FEMA Flood Insurance Rate Maps for the site (Firm Panels 2501670001A, 2501670002A, Effective 4/3/1978), the Smith College parcels include areas delineated by FEMA as being subject to flooding by the Base Flood, associated with the Mill River and Paradise Pond (see Figure 2, Appendix A). April 27, 2018 Water Resources Maintenance Activities 15.0407120.9 Page | 4 2.1.6 RA RA extends 200 feet landward, perpendicular from the upper limits of Bank resource only along the Mill River (Appendix A, Figure 5). The boundary of Bank was used to further delineate the landward jurisdiction of RA. The existing RA along the Mill River immediately upstream and downstream of Paradise Pond is comprised of athletic fields, turf lawn, campus buildings, and walkways as well as some forested areas located mostly on the north side of the Mill River and Paradise Pond. RA does not extend from the Bank associated with Paradise Pond or Lyman Pond because of the lack of riverine characteristics within these waterbodies. 2.1.7 Buffer Zone A 100-foot Buffer Zone regulated by the WPA and the City Wetlands Ordinance (Northampton Chapter 337-2) extends inland from the Bank or BVW resource areas. This zone is regulated under the WPA relative to the po- tential for activities to impact adjacent wetland resources, whereas the City Wetlands Ordinance also manages this area as a resource area. 2.2 ALTERED AREAS & WILDLIFE HABITAT SIGNIFICANCE Many of the resource areas within the Site are within human-altered areas. As per the WPA (310 CMR 10.54 (1), 310 CMR 10.57(1)(a)(3) and 10.58(1)), these altered areas, some of which are comprised of concrete, asphalt, or other artificial impervious materials, do not serve in a significant capacity for the interest of protection of wildlife habitat. Jurisdictional areas that are normally significant to the protection of wildlife habitat but have been so “extensively altered” have been identified in Figure 6 (Appendix A). Altered areas within the Site include the dam and dike facilities, lawns, sports fields, paved and graveled walkways and roadways, and buildings. These de- marked areas do not effectively serve in the interest of protection of wildlife habitat as defined in the WPA. This distinction is important for purposes of this NOI to allow for the identified routine work elements to meet appli- cable performance standards (See Section 3.0 and Tables 1-4). 3.0 PROPOSED ACTIVITIES The Applicant proposes to include the following activities to be permitted under this NOI within the Site (Table 4). All proposed tasks within each activity meet the General Performance Standards of the applicable resource area, as described in the following sections (Tables 1-4). 3.1 ACTIVITY: PARADISE POND DAM & DIKE OPERATIONS AND MANAGEMENT Tasks: o Temporary, Partial Drawdown if required for Dam or Dike Maintenance in the following catego- ries:  Inspections of Paradise Pond Dam and Dike,  Flashboard repair,  Debris removal, and  Operation of the low-level outlet sluice gate o Office of Dam Safety (ODS) Required Maintenance Compliance Activities: April 27, 2018 Water Resources Maintenance Activities 15.0407120.9 Page | 5  Vegetation maintenance on dike and dam  Animal burrow/damage management on dike and dam Paradise Pond dam and dike operations and management, to the extent possible, will be conducted to avoid any discernable drawdown of the water elevation of Paradise Pond. However, depending upon the actual field con- ditions at the time the activity is required to be performed, temporary partial drawdown of Paradise Pond may be required. Under these conditions, any such drawdown will be highly restricted and conducted in a manner to avoid impacts to resources and rare species habitat, as discussed with NHESP in the pre-submission meeting (July 13, 2017), adhering to the description below. Activities may occur within Bank, LUWW, BLSF, and Buffer Zone. These activities will occur on a regular or as- needed basis and are proposed to meet the applicable resource area performance standards. There will be no loss of vegetated surfaces and any vegetative changes will be limited to removal of fallen trees, invasive species control, and lawn/field maintenance. Pre-Activity Submittal: The NCC will be notified a minimum of 48 hours in advance of maintenance activities to be performed at Paradise Pond during the course of the year, with the anticipated timing and frequency of each. Notification will include a locus map and complete description of the activity, the need for or proposed use of any equipment, identification of site access, and other relevant information, including any ODS order or letter identi- fying needed maintenance, if applicable. Limitations: Work within this category will be performed in a manner to maintain the existing dam, outlet control and dike facility, but not otherwise alter or change the facilities. This work will meet the following conditions: 1. Activities will be limited to those within the existing dam, dike and outlet control facilities; 2. Work will occur within areas determined to not be significant to wildlife habitat; 3. Areas will be maintained with native herbaceous vegetation, appropriate to pre-existing or local vegeta- tive conditions; 4. To the extent practicable, all work under this activity will be performed without additional pond level drawdown; a. If required for safety to conduct the repair and maintenance activity, very limited, temporary par- tial pond drawdowns may be performed in support of repair work, under the limitations as described below. Activities occurring immediately at the dam could require partial drawdown of the pond. Partial pond draw- downs will be limited to three feet (3’) below normal pool elevation of 135.7 NAVD88 for Paradise Pond, and will be subject to the following limitations, as agreed upon at the pre-submission meeting held between NHESP and Smith College on July 13, 2017. Under the following limitations, the partial drawdown will be acceptable for a “no effect” determination from NHESP (anticipated to be formally issued as part of NHESP’s review of this NOI, prior to issuance of any OOC): • Maximum duration of three (3) days, • Typically, will occur once per year during the last two (2) weeks of April, • Flow in the Mill River between 50 and 200 cfs, • During refill, a minimum flow rate of 13.8 cfs will be maintained downstream of the dam1, as monitored by Smith College, • If the drawdown is occurring during the odonate emergence period (May 15 to September 1), the rate of 1 See Appendix D for calculation of minimum bypass flow rate. April 27, 2018 Water Resources Maintenance Activities 15.0407120.9 Page | 6 water level increase during refill of the pond will be limited as follows (based on consultation with NHESP): o May 15 to June 15: maximum refill rate of 0.50 vertical feet per hour o June 15 to September 1: maximum rate rate of 2.07 vertical feet per hour It should be noted that the separately-permitted Paradise Pond Sediment Management Protocol (DEP File # 246- 0680) allows partial drawdowns (to ½ normal pool) for the purpose of sediment redistribution and during low flow periods within the summer months. To the extent practical, Smith College may perform operation and mainte- nance activities at the Paradise Pond Dam and Dike that require drawdown when the pond is already drawn down for sediment redistribution under DEP File # 246-0680 and EOEA 15282, consistent with “no effect” conditions issued by NHESP. Any other drawdown, beyond that requested under this NOI or as per DEP File # 246-0680, will be subject to separate permitting. Outside these areas, as per the pre-per- mitting discussions and agreements with NHESP, work being proposed under this NOI will meet the limitations set by NHESP and to be incorporated into an OOC, to prevent adverse impact to the identified species habitats and is thus presumed to avoid adverse impacts. LUWW 10.56(a) 1. Work shall not impair the water carrying capacity within the de- fined channel √ No changes to the channel are proposed. 2. Work shall not impair the ground and surface water quality √ The appropriate, project-specific sedimentation and erosion controls will be implemented so as to not impair water surface or ground water quality. 3. BLSF 10.57(4)(a) 1. Compensatory storage shall be provided for all flood storage vol- ume lost √ No loss of flood storage volume is proposed under this activity. Any fill within BLSF will only be in response to a damaging event (animal burrow) or erosion, which will restore the area to the conditions existing prior to the dam- aging event. 2. Work shall not restrict flows √ No task proposed under this activity includes changes that will restrict flows as to cause an increase in flood stage or velocity. 3. Work in areas found to be signif- icant to the protection of wildlife habitat…that cumulatively alters up to 10% or 5,000SF, whichever is less. √ Areas within BLSF that are not significant to the protection of wildlife habitat are depicted on Figure 6. As per 10.57(1)(a)(3), these are altered areas including buildings, lawn, garden, roadway, and athletic fields that have lawfully existed since Nov 1, 1987. Altered areas were identified in Figure 6 throughout the ten- year floodplain or within 100 feet of Bank, contained within the 100-year flood- plain. Activities within BLSF will only occur in these altered areas in order to avoid accumulating impacts to wildlife habitat. This performance standard is therefore considered to be met. 3.2 ACTIVITY: EMBANKMENT AND SLOPE MAINTENANCE, EROSION REPAIR, AND STABILIZATION This activity involves minor physical management of the embankments bordering the waterbodies associated with the repair of discrete areas of erosion. All areas to be included as part of this activity will be within areas owned or controlled by the Smith College that are considered to be “altered areas”, judged as non-significant to wildlife habitat (see Figure 6). The intent of this work will be to return any damaged areas to original grades and vegetative states, subject to the limitations stated below. The anticipated tasks are as listed below. Tasks: o Embankment slope maintenance o Erosion repair and stabilization (e.g., soil replacement, geotextiles and replanting/seeding for ar- eas of storm damage, tree throws, and slumping),  Stabilization of areas within Buffer Zone, or “altered areas” of BLSF or RA; Pre-Activity Submittal: The NCC will be notified a minimum of 48 hours in advance of activities. Notification will include a description of area and activities to be undertaken with a locus map and photographs of the damage, if appropriate. Limitations: This work will meet the following additional conditions. 1. Activities will be limited to shoreline areas owned or controlled by the Smith College within BLSF, RA and Buffer zone, and/or within altered areas judged as non-significant to wildlife habitat (see Figure 6); typi- cally, within areas that are currently paved, landscaped or covered with existing turf, lawn, or walkways. Any work will return erosion areas to pre-existing grades and have no net fill above pre-damage condi- tions, as determined by the relative elevation of the immediately adjacent undisturbed soils. 3. Areas will be revegetated with native vegetation, appropriate to pre-existing and adjacent vegetative con- ditions. 4. Erosion controls will be employed downgradient of disturbed soils or as otherwise needed to control site erosion. Erosion control fabric and other erosion controls will be installed as recommended by the envi- ronmental scientist to allow for site stabilization, vegetation regrowth, and to limit the potential for future erosion. 5. The removal of fallen trees from within existing turf, lawn, landscaped, paved, and/or walkway areas is exempt under MESA (321 CMR 10.00). Soil replacement will match grades on all edges of the non-eroded perimeter to restore site conditions to ensure that there is no impairment of wildlife habitat function as part of this activity. Soils will be seeded with native seed mix appropriate to the site conditions and the seed mix specifications will be provided to the Commission. Tasks within the RA will involve response to damage events, restoring areas affected by erosion, tree throws, or burrowing within altered areas identified in Figure 6. c. Practicable and substantially equivalent economic alterna- tives √ Commensurate with the type and size of the project and in consideration of the fact that the proposed work is restoration, the only alternative will be to leave the damaged areas and just spread a native seed mix. This is not a preferred al- ternative because it exposes pedestrians to the unsafe conditions in public use areas. d. No significant adverse impact √ Work being proposed is restoration work in response to damaging events and will have no significant adverse impact on the riverfront area. 1.Alteration may be al- lowed, provided that: a. …existing vegeta- tive cover shall be preserved or ex- tended to the maximum extent feasible. √ There are no proposed impacts to the extent of the undisturbed vegetation, which is currently less than 100-feet wide. b. Work shall incor- porate sedimentation and erosion controls √ Proposed tasks will employ sedimentation and erosion controls appropriate to the site and work. 3.3 ACTIVITY: MAINTENANCE OF EXISTING STRUCTURES, STORMWATER OUTLETS, FACILITIES AND EQUIP- MENT, AND LANDSCAPING FEATURES This activity involves routine and minor activities associated with the maintenance of existing structures, College facilities and equipment, trails, landscaping, and stormwater outlets within jurisdictional areas. All areas to be included as part of this work will be within areas owned or controlled by the Smith College and/or within the altered areas judged as non-significant to wildlife habitat (see Figure 6). Tasks approved under this activity will be April 27, 2018 Water Resources Maintenance Activities 15.0407120.9 Page | 10 within Buffer Zone, Bank, LUWW, BLSF, and/or RA. The intent of this work will be to maintain, but not expand, existing developed areas, subject to limitations stated below. Work within this category may include routine maintenance, but not enlargement or full reconstruction of existing facilities, landscaping, trails, buildings, dock, bridge, outlet structures, pump house and appurtenant structures. Typical projects on structures will include replacement of boards, trim or hardware; painting; shoring of founda- tions. There will be no permanent alteration of grades by excavation or placement of fill. Removal of debris trapped by dams, debris boom, stormwater structures, or boat launches is also included as part of this task. The anticipated activities are as listed below. Tasks: o Maintenance of Existing Structures:  Debris Boom  Lamont Bridge  Boat and Crew Houses  Irrigation Pump House + equipment  Stormwater Outlets  Landscaping  Existing walkways and impervious surfaces.  Lyman Pond outlet structure  Mill River monitoring equipment Pre-Activity Submittal: The NCC will be notified a minimum of 48 hours in advance of maintenance activities to be performed during the course of the year, with the anticipated timing and frequency of each. Of note, some stormwater maintenance may be exempt as per 310 CMR 10.02(3) for fea- tures installed in accordance with the Stormwater Management Standards after 11-18-1996. Regulatory Compliance: This work will meet the following additional conditions: 1. Activities will be limited to the maintenance of existing structures within altered areas judged as non- significant to the protection of wildlife habitat (see Figure 6), typically within areas that are currently paved, landscaped or covered with existing turf, lawn, or walkways. 2. All work will maintain the general existing conditions of the Smith College lands, with no permanent mod- ification of existing grades within BLSF or significant alteration of vegetative conditions. 3. Areas will be maintained with native vegetation, appropriate to pre-existing vegetative conditions. Any additional impacts or modifications will be subject to new or amended permit application approval(s). COC for (f) and (g) N/A 3.4 INVASIVE VEGETATION MANAGEMENT Smith College is committed to the continuation of the invasive species management plan within resource areas. Areas that have been assessed for invasive species treatment are identified on Figure 6. Depending on the tar- get species for each treatment implementation, options include mowing, mechanical removal, chemical treatment, or a combination of mechanical and chemical. Invasive plant materials will be disposed of properly to avoid further spread. A survey of invasive species present was completed in 2015 to be used as an initial guidance document. Following treatment, restoration plantings and species monitoring will be conducted for reporting to NCC on the status of the treatment program. 3.4.1 INVASIVE VEGETATION MANAGEMENT METHODOLOGIES This activity involves the management of non-native, invasive vegetation using standard methods of mechanical and/or chemical treatment within resource areas. This work includes herbicide spot treatment on shoreline of non-indigenous invasive shrubs and herbaceous plants within the resource areas surrounding the Paradise Pond and the Mill River where dense non-indigenous invasive species are present. Pre-Activity Submittal: Prior to the work to be performed, a survey of the resource area and target invasive species will be performed to confirm the relative density of the vegetation present. A treatment plan will be developed, specifying the methods, site access, equipment to be used, and any mitigation measures to avoid incidental im- pacts to the resources present. This plan will be submitted to the NCC for acceptance under this OOC prior to implementation. In all cases, we anticipate that personnel and equipment access will not require any alteration of shoreline conditions (e.g., vegetation removal or grading); all removed vegetation will be disposed of properly, following the recommended industry methodologies, in upland areas outside of the resource buffer zones; and there is no proposed impairment of wetland resources. If such conditions exist, additional separate permitting may be required. April 27, 2018 Water Resources Maintenance Activities 15.0407120.9 Page | 13 Regulatory Compliance: The work will be performed in a manner to have no physical changes other than invasive species removal and native vegetation restoration. Work will be designed and carried out using the best practical measures (BMPs) to reduce impacts to the surrounding native species. For any plant spot treatment within resource areas, the work will be limited to the target plant or shrubs avoiding all other physical changes to the habitat of the resource or buffer zone. Aerial broadcast spraying is not being proposed. Any work within 25-ft of bank will be limited to treatment of the individual plants only by hand or backpack sprayers with care taken to avoid overspray. The chemical application will need to be performed by a licensed herbicide contractor with additional BRP WM 04 License to Apply permit from MA DEP. This lack of adverse effect will be accomplished by the following activities, which will be detailed in the pre-noti- fication plan to be submitted to the NCC for approval prior to implementation: 1. Map the distribution of the target species and any protected non-target species; 2. Pre-assessment by a biologist will identify any significant habitat components of the which will be avoided in the work to be performed; 3. Areas of habitat sensitivity (see #2 above) must be avoided for direct application; 4. Application must be performed by licensed applicator; 5. Application program must be designed to avoid and minimize effect on native plant species; 6. Application program should target exponential or early season growth phase of plants for maximal effect during lower biomass periods; 7. The biologist will be present during the conduct of the work to help ensure that protected areas were not affected during the conduct of the work; 8. Vehicles and equipment used in the treatment will be thoroughly cleaned and inspected by the environ- mental scientist, or a designee approved by NCC, upon entry and departure from the project site; and 9. Provide post-treatment analysis report to the NCC at the end of year following treatment and at least 30 days prior to any further planned treatment. Report will prepare a map of the nuisance aquatic plants and/or invasive species similar to the pre-assessment analysis for comparison of pre- and post- conditions. The report will also include an assessment of habitat conditions, any adverse or positive changes, and potential management recommendations for the next growing season. Future or repeated treatments will be subject to continued documentation of no adverse effect wetland resources and no impairment of wildlife habitat function as a result of this activity. (GZA) on Thursday, July 13, 2017 to discuss NHESP permitting considerations for the Smith College’s proposed Water Resources Adaptive Management Plan (WRAMP). (SR; GZA) Background: On behalf of Smith College, in August of 2016, GZA submitted a Notice of Intent (NOI) application under the MA Wetlands Protection Act and City of Northampton Wetlands Or- dinance for permitting of specific portions of the Water Resources Adaptive Management Plan (WRAMP), a management plan describing both routine and special management and maintenance activities relative to the water resources at Smith College (the Project). Because the Project falls within mapped Priority and Estimated Habitat for Rare Species, a copy of the NOI was submitted to NHESP in compliance with the Wetlands Protection Act (WPA). The NOI included the WPA Form-3, a written narrative, and appendices including the detailed draft WRAMP document. The detailed draft WRAMP document is intended to be an update and expansion of the “Paradise Pond Management Plan” (2nd edition, October 14, 2010), and includes a description of routine maintenance and management activities for the water resources within the Smith College campus, including Paradise Pond, the Mill River, and Lyman Pond. Some of the activities would be ex- pected to result in de minimis impacts to wetland resources below thresholds that would invoke Page 2 of 4 any additional permit review or require separate permits with the Army Corps of Engineers, NHESP, and/or DEP; thus, such activities would be suitable for approval under a “bundled” Order of Conditions (OC). The WRAMP also describes other maintenance-of-water-resources activities which would not be suitable for approval under such a mechanism and would require to be per-mitted separately. Notwithstanding, the hope is that the WRAMP will be a compendium of po- tential management activities that Smith could reference to determine a path for regulatory com- pliance (i.e., that the WRAMP will identify a group of management and maintenance activities that are permitted by the “bundled” OC, and a group of such activities that would require specific and individualized permitting efforts prior to commencing). Comments received from DEP and NHESP on the submitted NOI indicated that there was a need to clarify which routine management activities with de minimis impacts were being requested for approval under the “bundled” OC, and remove references to the overall WRAMP document and other activities which would require specific and individualized permitting efforts. The comment-ers suggested that while the WRAMP may serve as a reference document for Smith College, it was not necessary to include it with the NOI. Accordingly, GZA began to prepare a revised NOI. During preparation of the revised NOI, GZA had various communications with NHESP, including the meeting held on July 13, 2017, to discuss and potentially establish limitations or conditions on the routine management activities that would be necessary in order to avoid a “take” of rare and endangered species habitat, and also to ensure that the activities would be compatible with the Order of Conditions for the Paradise Pond Sediment Management Protocol (SMP), a project that is currently ongoing at Smith College. The following topics were discussed by the group of attendees during the meeting on July 13, 2017: 1. GH and BN provided some background description of various items relating to Paradise Pond, including: a) The storm drain that discharges to the Mill River upstream of the Lamont Bridge produces an increase in turbidity during a storm event, which is noticed before any increases in turbidity are observed from the flows coming down the Mill River and over the Paradise Pond dam. b) The trash boom located at the upstream end of Paradise Pond needs cleaning about four times per year, on average. c) The splash pool downstream of Paradise Pond dam is bounded by the armored city sewer line that crosses the Mill River. d) A turbidity meter has been installed upstream of Paradise Pond, but the meter has not yet been incorporated into the web page which presents other flow and turbidity data. e) Smith College measures bathymetry of Paradise Pond once per year, to evaluate sediment accumulation in the pond. 2. NHESP is primarily concerned with activities that require drawdown of Paradise Pond. The Order of Conditions for the SMP allows drawdowns to occur during the summer months, for the purposes of sediment redistribution. NHESP requested that WRAMP-re-lated activities requiring drawdown be performed during drawdowns that are already oc- curring for the SMP. Page 3 of 4 3. Smith and GZA clarified that some WRAMP-related activities which require drawdown can’t be limited to the summer months. These include drawdowns for flashboard repairs, which Smith typically performs in April, prior to Commencement. 4. NHESP agreed that the revised NOI can include a request to allow drawdown for flash-board repair, under the following conditions: a. Maximum drawdown of 3 feet; b. Once per year during the last 2 weeks of April; c. Mill River flows are between 50 and 200 cfs; d. Drawdown duration limited to 3 days maximum; e. A minimum bypass flow must be maintained1; f. If the drawdown occurs during the odonate emergence period2, the follow- ing criteria must be met: i. Notify NHESP; and ii. Rate of water level increase in the pond is limited3. g. Other activities that require drawdown may be performed while the pond is drawn down for flashboard repair. Notes: 1The minimum bypass flow shall be 27 cfs, based on guidance in the Final Generic Envi- ronmental Impact Report (GEIR) for Eutrophication and Aquatic Plant Management in Massachusetts (EOEA, 2004) which recommends calculation of minimum outflow during refill based on watershed size or, alternatively, Smith College may calculate a different minimum bypass flow using the more recently-developed Massachusetts Sustainable Wa-ter Management Initiative (SWMI) Framework method. 2NHESP will provide the odonate emergence period to Smith and GZA. 3NHESP will provide the allowable rate of water level increase to Smith and GZA. 5. NHESP stated that exercising the sluice gate may be requested under the revised NOI. 6. NHESP indicated that any work on the natural bank (as determined by the Wetlands Pro-tection Act) of the Mill River can’t be permitted under this revised NOI. 7. The table within the revised NOI which outlines the specific activities that are being re- quested for permitting should be clarified to include only those activities which are being requested for permitting under the WPA. The table should point out activities that are ex- empt under MESA. Also, the table should clearly indicate which activities require draw-down of Paradise Pond. One idea discussed was that color-coding the table may be helpful in graphically illustrating what specific activities are being request for permitting. 8. Notifications to NHESP should be made to both MAM and the “Regional Review Assis- tant” (actual contact person to be determined). 9. Given that certain management activities that require drawdown (e.g., dam inspections, removal of trapped debris) may be completed while the pond is drawn down for SMP operations; and thus, will be tied to the Order of Conditions for the SMP, consultation may be required to continue these activities when the SMP expires. Smith College described an interest in trying to move sediment into the splash pool downstream of Paradise Pond for subse- quent downstream distribution by natural high river flows. NHESP agreed that this idea may be explored during future phases of the SMP, with downstream monitoring and data collection, to be permitted in the future. Smith College will need to request an extension of the SMP, and describe requested activities with conditions. Review of Action Items: 1. NHESP will provide the odonate emergence period to Smith and GZA (ref. Discussion Item #4 above). 2. NHESP will provide the allowable rate of water level increase to Smith and GZA (ref. APPENDIX D Paradise Pond Minimum Bypass Flowrate Calculation GZA utilized the Water Management Act Permitting Tool (WMA Tool), developed by MassDEP, to calculate the “August unaffected streamflow” for the Mill River downstream of the Paradise Pond dam. The “August unaf- fected streamflow” calculated by the WMA Tool is the median August streamflow simulated using USGS records of measured daily streamflow from 1960 to 2004. GZA viewed the Sustainable Water Management Act Initiative (SWMI) interactive map available at the SWMI Technical Resources webpage to determine the Sub Basin ID for the Mill River, required as input to the WMA Tool (http://www.mass.gov/eea/agencies/massdep/water/watersheds/sustainable-water-management-initiative- swmi.html). The Sub Basin ID for the Mill River downstream of Paradise Pond dam is 14066 (see Figure 1 below). The Sub Basin Characteristics Report generated by the WMA Tool indicated that the August unaffected streamflow for the Mill River is 8.944 million gallons per day (mgd), which is equivalent to 13.8 cubic feet per second (cfs). Screen capture from SWMI interactive map For comparison purposes, the 7-day, 2-year low flow computed by USGS StreamStats (https://stream- stats.usgs.gov/ss/) is 10.2 cfs. The 7-day, 2-year low flow is the 7-day minimum mean flow that recurs, on average, once every 2 years. Based on these results, the Proponent (Smith College) proposes a minimum flow rate of 13.8 cfs, as calculated by the WMA Tool, be maintained in the Mill River downstream of Paradise Pond dam during refill of Paradise Pond following a partial drawdown.
