Because of this, any disturbance within 100' of such areas, including cutting, requires permits from the Northampton Conservation Commission under the Wetlands Protection Act or a forest cutting plan approved from the Massachusetts Department of Environmental Management. He indicated that your property does have extensive wetlands and that cutting did occur within the wetland boundary. He also mentioned that you thought you were exempt from regulations because the area was previously used as an agricultural pasture. Maintenance of Agricultural pastures is allowed for those areas that are currently in agricultural use. Once activities cease for five years, the parcel is no longer considered to be in agriculture unless under a USDA contract that spells out a longer period. This is the Decision of the Board of Appeals of the City of Northampton on a petition filed by Reinhardt Associates, Inc. requesting a variance from the provisions of Chapter 44, Section 1.1, Paragraphs 1, 2 and 3, of the Revised Ordinances of the City of Northampton. The petitioner requests the Board grant a variance to permit the petitioner to construct 219 units of single family condominium houses on a 160 acre parcel of land. The premises affected are situate at the easterly side of North Farms Road, and are designated on the Assessors Map of the City of Northampton as a portion of Parcel 21, Sheet 12. The matter was duly advertised on November 20, 1974 and November 27, 1974, in the Daily Hampshire Gazette, and was heard by the Board on December 11, 1974. Charles W. Dragon, Chairman presided at the hearing and heard the matter with Board members, Edward E. Keefe and Cecil I. Clark. The petitioner was present and was represented by Attorney David Donahue and Attorney Robert Galvin. There were several obj ectors% Charles W. Dragon voted that the petitioner failed to establish the existance of a substantial hardship. Cecil I. Clark and Edward E. Keefe voted that a substantial hardship was established, however, the one vote in the negative prevailed. The Board further voted with Charles W. Dragon and Edward E. Keefe voting in the affirmative and Cecil I. Clark voting in the negative that the granting of the variance would undermine the existing zoning ordinance. The Board further voted with Charles W. Dragon and Cecil I. Clark voting in the affirmative and Edward E. Keefe voting in the negative that the granting of the variance would derogate from the intent and purpose of the zoning ordinance as the present zoning ordinance provides for detached single family dwellings and not for attached dwellings as contemplated by this petition.
