ADDING A DETACHED DUPLEX HOUSE ON THE BACK OF LOT. ONE UNIT TO BE OWNER OCCUPIED

CONDITION OF APPROVAL:
1)Prior to construction, the applicant shall install tree protection for the trees in the vicinity of the
parking area. The tree protection shall be inspected by the City prior to start of site work.
2.) Prior to issuance of a building permit, final plans showing water and sewer connections and any
plans for stormwater from the roof shall be submitted to Office of Planning and Sustainability and
Department of Public Works for review and approval.
3.)Prior to issuance of a certificate of occupancy, and as offered by the applicant to address traffic
impacts, payment to address the incremental increase in traffic generated by this site (one time value
of $2,000) shall be made to the City.
4.) A 6’ tall privacy fence shall be installed along the northerly property boundary beginning at the
westerly edge of the parking area back to the rear lot line. This shall be in lieu of the proposed
boxwood shrubs.
FINDINGS:
The Planning Board approved the Site Plan Application for a duplex unt detached from the existing four-family structure at 41/43 North
Main Street based on the plans and information submitted with the application:
The Planning Board approved the application upon finding that the criteria in the zoning Chapter 350, attachment 7 and site plan criteria
in 350-11.6 had been met.
1. Specifically, the requested use protects adjoining premises against seriously detrimental uses. Residential uses are allowed by right.
The 32,000 square foot lot size exceeds the minimum lot size for the additional units (15,000 square foot minimum is required) and
therefore leaves perimeter and rear of the parcel as lawn/landscaped area.
Minimum setbacks of more than 15’ on the side and more than 20 to the rear have been met; and
2. The requested use will promote the convenience and safety of vehicular and pedestrian movement within the site and on adjacent
streets, the existing configuration of the looped driveway will be redefined to prevent parking and use by the adjacent church property,
improving exisitng conditions.
a. Access by nonmotorized means will be the same as existing for the current four family structure.
b. The site will function harmoniously in relation to other structures and open spaces to the natural landscape, existing buildings and
other community assets in the area as it relates to landscaping, drainage, sight lines, building orientation, massing, egress, and
setbacks.
3.. The requested use will not overload, and will mitigate adverse impacts on, the City's resources. The addition of the two two-bedroom
units can be served on existing water and sewer system.

4. The requested use meets special regulations set forth in this chapter- attachment 7 for the addition of a detached unit.
