NATURE OF PROPOSED WORK:
Construction of a 3 story 15,000+ square foot multi-use building with 12 residential units and approximately 3,000 sf of commercial space.
HARDSHIP:
CONDITION OF APPROVAL:
1)Prior to any site work, the applicant must have all tree protection measures installed and inspected by
the City. Tree protection must conform to ANSI 300 Standards, Part 5.
2). At least 15 days prior to request for a building permit, the applicant shall submit revised final
construction plans, signed and sealed by a Massachusetts registered P.E. on all applicable plan
sheets, to the Department of Public Works (DPW) for review and approval at least 15 days prior to the
issuance of any City building or construction permits. All revised plans shall include test pit results of
soils where the proposed rain garden is located and detail planting medium shall be provided
3). Prior to issuance of a Building Permit, the applicant shall record an executed Stormwater
Operation, Maintenance, and Inspection Agreement that is binding on all subsequent owners of land
served by the private storm water management facility by recording it in the land records of the
Registry of Deeds. This agreement must be approved by the Northampton DPW prior to final
signatures.
4). Prior to issuance of a Building Permit, the applicant shall record an executed Stormwater
Operation, Maintenance, and Inspection Agreement that is binding on all subsequent owners of land
served by the private storm water management facility by recording it in the land records of the
Registry of Deeds. This agreement must be approved by the Northampton DPW prior to final
signatures.
5). All water lines shall meet the Department of Public Works standards for size and connections.

6). Prior to Certificate of Occupancy, all tree replacement requirements shall be completed.
FINDINGS:
The Planning Board approved the application under §350-20.18 Village Hill Sustainable Growth Overlay (MGL Chapter 40R) based on the
following information and plans submitted with the application:
1. Site Plan Application Supplement 40 R Compliance statements Dated December 8, 2017.
2. “Village Hill Site Plan Review”, By the Berkshire Design Group, Dated December 8, 2017 Sheets L3, L4, L5(rev. 12/26/17,. Sheets L6,
L7 Dated 12/26/17.
3. Elevations and Renderings by Davis Square Architects, dated December 8, 2017.
The Planning Board approved the 40R application upon determining that the requirements within §350-20.18 had been met, including
evaluation of uses, density, design, and accessibility and affordability. A total of ~60% of the units will be affordable with the remaining
