The Board granted the permits based upon information and plans submitted with the application. The Board granted the special permit under 350 9.3(10) for the extension of a deck closer to the rear lot line than the existing non- conforming rear setback. The existing setback is 11' 1" instead of the required 20'. The proposed expansion will be 10' from the rear lot line. The proposed garage, with second floor accessory dwelling, was approved with a 4' rear setback instead of the required 20' rear setback. The side setback for the garage meets the required 10' minimum. In approving the special permit for further encroachment into the rear yard setback, the Zoning Board determined that the encroachment was not substantially more detrimental to the neighborhood than the existing non-conforming rear setback. The rear lot line abuts the parking area and garage building of a mixed commercial/residential property. The second special permit was for the purposes of creating a detached accessory dwelling under 350-10.10. The Zoning Board found that the criteria in 10.10 for accessory dwellings had been satisfied and that the additional small apartment would be consistent with the City's Sustainable Northampton Plan.
