1)Prior to obtaining a curb cut permit from the DPW, the applicant must show that a deed restriction has
been recorded at the Register of Deeds that states the driveway will be removed and the area loamed
and seeded prior to the sale of the parcel to a new owner.
FINDINGS:
The Planning Board approved the request for a second curb cut based upon the information submitted with the application and at the
public hearing.
The Board determined that a second curb cut to assist with the mobility of the disabled, elderly occupants of the accessory dwelling for
the duration that they occupy the unit would outweigh the impact to traffic safety. The Board approved the second curb cut on the
condition that it be removed at the time of the lot sale, effectively making it a temporary access.
