Pursuant to regulations, I was not able to identify any type of violations relating to the nature of the complaint. The water pressure from the shower was observed to be sufficient in flow and velocity. The front entry door did have a bottom door-sweep strip attached, but was removed and subsequently a gap does appear to allow air movement. In my assessment,you had indicated that the door-sweep strip was removed because of the door dragging on the floor and not opening easily. I believe the door-sweep strip should be re-attached and possibly cut to align with the floor. Since,you had indicated this door-sweep was directly removed on your own accord, I am not inclined to issue a correction order to the owner of the property for not maintaining the door weather-tight. After speaking with your office staff yesterday I realize overnight maintenance is on call not staffed; my only request is that if possible when maintenance is out for other calls take some after midnight temperature readings at Tobin Manor. Linda moved into Tobin manor a week or more ago and the family has made a number of accommodations at their expense to try to make it livable for her but Linda consistently reports that there is not enough hot water in the night for her to care for herself. The changes the family made go beyond the minimum standards of the housing code which is why they paid for them. At this point I'm thinking that an occupant who can't make an emergency call in a situation which her mother has characterized as, if unchecked, could lead to amputation of limbs; and which the occupant has characterized as life-threatening; if that occupant can't make an emergency call at any time when it's needed she needs accommodations or care that the housing code minimum standards don't cover. We have a hot water tank full of hot water and a heating coil in the tank that keeps it hot, at about 140 degrees. When there is a heavy demand and the tank drains, cold water is added to the tank. That's when the temperature of the water in the tank can drop to 120 degrees, until it is reheated by the coil. The peak use time in in the early morning 6-9 AM. When there is low usage the tank is full, the temperature is the highest. The temperature at the tank last night was 142, and left the system (after a mixing valve reduced the temperature to comply with the Sanitary Code, at 130). As it circulates throughout the building it drops a bit, in last night's case to 123 degrees. These numbers are from my check last night. We will have people check the system if they get calls. The system has 2 boilers. One of the boilers was shut down on Friday afternoon/evening because it was not working properly. The system should provide more than enough hot water with only one boiler working. Once the technician has verified that the hot water system is working properly, he will work on the boiler that was shut down. The technician from Cote will contact our inspector as soon as he has finished his testing. I found out more about what happened on Friday, 6/26. Columbia Gas responded to a complaint from one of the residents about the smell of gas. The first checked their service equipment and found no problems. They then checked the exhaust vents from the boilers and determined that one was not firing properly. That furnace was shut down before Colombia Gas left the building. Colombia Gas returned and found that the furnace was in service again. It was again shut down. It was out of service when our inspector went there this morning. The technician is still working on the furnaces. We will keep you apprised. He hopes for a repair tomorrow and this week for sure. In order to address my emergency medical condition, I have had to lose so much sleep that I cannot drive almost at all and cannot do almost anything. Not only does that mean I have not been able to get the medical care I need because I can't drive to my doctors' offices or have the energy to leave my house to get there, including my chiropractor, which has put me in a state of exponentially increased pain, but I am estimating that—if this really does get resolved this week, this will take AT LEAST three months out of my life to recover enough to start being able to take care of my daily needs. I hope that if I have to call your office again for any reason, it does not take you a full week to address the problem. Again, I urge you to make sure this is addressed as quickly as possible from here on in, particularly because of the lag in your dealing with it and the extreme repercussions it is causing me. (Not to mention my mother—the amount of time and energy she has had to invest in this so far, and she is also in the middle of a huge move--after 35 years living in a house in Chesterfield, they are moving tomorrow to an apartment in Florence. She cannot continue to be called upon to have to deal with this situation.) At the very least, I will be seeking rent reimbursement. The Northampton building department is doing everything we can to ensure that Linda has hot water available at any time, day or night. I'd like to lay out what has been happening at the complex since our department got involved. We've been working closely with the health department during this process. The housing authority has hired Rene Cote and Sons, Inc. to work on the system. That company is one of the best commercial HVAC in the area. Our plumbing inspector has been in touch with their technician on a regular basis. I am confident that the technician is extremely competent. The technician replaced an aqua-stat on Monday and a circulator pump on Tuesday. The housing authority has checked water temperatures on a number of occasions including 10:30 pm on June 25th and 3:35 am on June 27th. Our plumbing inspector has inspected several times. He's met with the housing authority plumber, the technician from Cote and housing authority maintenance people. The housing authority has also arranged to have a technician from the boiler manufacturer check the system tomorrow. We've come to the conclusion that we need access to Linda's apartment if we're going to resolve the problem. We'll need to get in for about 30 minutes during the day, and then again at night when we can be sure we'll be able to see the problem. I think the best time would be between 12:00 and 2:00 am. This is a necessary step if we're going to make sure Linda has adequate hot water. Please let me know if this can be arranged. The upcoming weekend is the 4th of July, and we are closed on Friday. We need access to the apartment today and tonight. We will have more information for the factory technician on Thursday and hopefully get to the cause of the problem. We've come to the conclusion that we need access to Linda's apartment if we're going to resolve the problem. We'll need to get in for about 30 minutes during the day, and then again at night when we can be sure we'll be able to see the problem. I think the best time would be between 12:00 and 2:00 am. This is a necessary step if we're going to make sure Linda has adequate hot water. Please let me know if this can be arranged. The upcoming weekend is the 4th of July, and we are closed on Friday. We need access to the apartment today and tonight. We will have more information for the factory technician on Thursday and hopefully get to the cause of the problem. I realize that this is taking a long time, but it is a very unusual problem. Thus far, no one can determine why the water in your apartment isn't as hot in the early hours of the morning as it is at other times. The only difference between your unit and the others we've tested is the washing machine connection. Perhaps you could turn off the washing machine connection valve when the washer is not being used; that could rule out a cross connection in the machine. The building department has done all we can. The plumbing inspector and I have made a number of visits and the hot water system appears to be operating properly. From this point forward, the only thing I can suggest it that you contact the Housing Authority immediately when you don't have hot water. I realize it is difficult. but the way this problem is going to be resolved is for them to check the water in your apartment when it is below temperature and then check the hot water system in the boiler room for problems at that moment. The technician replaced an aqua-stat on Monday and a circulator pump on Tuesday. The housing authority has checked water temperatures on a number of occasions including 10:30 pm on June 25th and 3:35 am on June 27th. Our plumbing inspector has inspected several times. He's met with the housing authority plumber, the technician from Cote and housing authority maintenance people. The housing authority has also arranged to have a technician from the boiler manufacturer check the system tomorrow. We've come to the conclusion that we need access to Linda's apartment if we're going to resolve the problem. We'll need to get in for about 30 minutes during the day, and then again at night when we can be sure we'll be able to see the problem. I think the best time would be between 12:00 and 2:00 am. This is a necessary step if we're going to make sure Linda has adequate hot water. Please let me know if this can be arranged. The upcoming weekend is the 4th of July, and we are closed on Friday. We need access to the apartment today and tonight. We will have more information for the factory technician on Thursday and hopefully get to the cause of the problem. Everything else I have heard second hand from another neighbor, who said that is the same case, or worse, for other tenants here and that it is worse as people get further from the boiler. So, to me, the issue seems to me to have to do with how the water is being distributed to the apartments from the boiler. I am completely uneducated on plumbing, so I am just guessing. I could very well be completely wrong in my diagnosis! (Though on the night you came at midnight, I remember texting you all night that night, and at 7:00 AM, it was still down and it wasn't until 7:30 that I had hot enough water again.) Therefore, I try to go to sleep as late as I can manage and try to stay in bed until after 7:00 AM, but I have excruciating pain in my head when I lie down, and that's not always possible. Last night was an example of that and so then I'm up much of the night. Last night, twice I had to boil water on the stove to soak my feet. (I have a severe vascular condition from brain surgery that causes my feet and hands to turn white from lack of blood flow and I need to get them into warm water to warm them and bring them back to pink. If I don't, I face amputation and possibly the loss of my life.) Again, thank you all for you amazing efforts, concern, and attention to this matter. There must be a solution. All the temperature readings we've taken so far have been above the minimum plumbing code requirements. The hot water temperature reading we took yesterday afternoon in your apartment's bathtub was actually higher than the code allows. The shower valve should be adjusted to reduce the temperature to 112 degrees at that fixture. Thus far, no one can determine why the water in your apartment isn't as hot in the early hours of the morning as it is at other times. The only difference between your unit and the others we've tested is the washing machine connection. Perhaps you could turn off the washing machine connection valve when the washer is not being used; that could rule out a cross connection in the machine. The building department has done all we can. The plumbing inspector and I have made a number of visits and the hot water system appears to be operating properly. From this point forward, the only thing I can suggest it that you contact the Housing Authority immediately when you don't have hot water. I realize it is difficult, but the way this problem is going to be resolved is for them to check the water in your apartment when it is below temperature and then check the hot water system in the boiler room for problems at that moment. During the visit the hot water return line temperature was measured at 125 degrees at its final point of return, 137 degrees to the individual units and 136 degrees in the men's room outside of the boiler room. Mike adjusted the mixing valve to decrease the hot water temp to below 130 degrees as prescribed in 248 CMR. The Massachusetts State Plumbing Code for residential buildings requires hot water temperatures be maintained between 120 degrees and 130 degrees. A shower is required to be regulated for a maximum temp of 112 degrees by use of an anti scald value. Normal practice for measuring hot water temperatures during plumbing inspections for dwelling units is to check temperatures at the shower and at second fixture not equipped with an anti scald mixing valve such as a lavatory or kitchen sink.
