(E-filers of Notices of Intent may submit these electronically.) noifeetf.doc • Wetland Fee Transmittal Form • rev. 10/11 Page 2 of 2 Section 2: Project Description 2.1 Project Description The property owner, Prospect Woods Homeowner's Association, is in the process of rehabilitating their failed pavement. The project was built in the 1980s. Since then, very little road maintenance has been performed. Rehabilitation of paved surfaces is sorely needed. The project generally does not expand the footprint of the degraded (paved road and walkway) areas, though a dumpster pad is planned to be relocated and reconfigured. In addition to pavement work, a sub-drain (under the pavement) is installed to alleviate the saturated pavement base. This sub-drain, which does not convey stormwater, discharges in the same location as the existing stormwater outfall. 2.2 Site Description Prospect Woods is an established 34 unit residential development. The homes are served by Warburton Way, a 1200 foot long private road (including the “dog leg” running parallel to Hatfield Street). Municipal water and sewer serve the development. Residential lots are in the 2000 to 3000 square foot range, with impervious area covering roughly half of each private lot. Excluding the privately owned units, the development’s land is known as parcel 18C-051, per the city assessor’s listing. There are no ACECs, Estimated habitat of Rare Wildlife or Areas of Critical Concern in the area. The region is zone URB (Urban Residential B), per map 18C of the city’s zoning maps. Per section 337-10B of the Bylaw, URB areas are not subject to section 337-10 Performance Standards over and above state law, with the exception of setback requirements in the Protected Zone Table (1) and the requirements of section 337-10E(2)(b).1 Since the 1980s, about half of the stormwater departs the site via sheet/surface flow concentrated at the paved and armored outfall located at the southern 90-degree bend in Warburton Way. Stormwater from the remainder of the site, roughly from the northern 90- degree bend in the road, is conveyed by two catch basins located along the eastern 500 feet of Warburton Way and also by sheet flow to Prospect Avenue. The catch basins connect to the municipal storm drain on Prospect Avenue. The existing surface runoff outfall has degraded the downgradient area by depositing sand, salt and debris from decades of winter road maintenance. Riprap and topsoil, if any, in this area have been buried by solids from the road. Original riprap can be seen past the terminus of the new sub-drain. Present construction disturbance is within this degraded area. The wetlands have been mapped and are further described in the attached report from Northeast Land and Water. No potential vernal pools were found by the wetland scientist. 1 The setback is 100 feet. Section 10-E(2)(b) enumerates various exceptions to alteration within resource areas and associated protected zones. The Zengineer 16 of 42 Per the USDA Natural Resources Conservation Service, the underlying soils include (from west to east) Hinckley loamy sand, Amostown fine sandy loam, Enosburg fine sandy loam, and Windsor loamy sand. The Enosburg and Windsor material resides under the newer pavement section, with mostly Amostown and some Hinckley under the western 2/3 of the pavement. Please refer to the attached USDA mapping. A brief synopsis of each soil type follows: •Hinckley has a parent material that is loose sandy and gravelly glaciofluvial deposits, with a water table typically more than 80” deep, and is Hydraulic Soil Group A. •Amostown has a parent material that is friable sandy glaciofluvial deposits over silty glaciolacustrine deposits, with a water table that is typically 18” to 36” deep, and is Hydraulic Soil Group B. •Enosburg has a parent material of loose sandy glaciofluvial deposits over silty glaciolacustrine deposits, with a water table that is typically 0” to 12” deep, and is Hydraulic Soil Group C/D. •Windsor has a parent material of loose sandy glaciofluvial deposits over silty glaciolacustrine deposits, with a water table that is typically more than 80” deep, and is Hydraulic Soil Group A. 2.3 Resource Area Description Since my June 28th submittal, the wetlands have been delineated by Alec MacLeod of Northeast Land and Water, LLC and survey located. A copy of MacLeod’s 7/19/17 report is attached. In summary, there is a Bordering Vegetated Wetland south of the project. This is shown on the plan Notice of Intent Supplement dated 8.1.17. No potential vernal pool was found. Unfortunately, a 3 FT by 11.1 FT area of BVW was excavated to a depth of roughly 4 inches (essentially just the A-horizon of soil). Sediment and excavation deposits have been placed on otherwise undisturbed wetland and buffer zone. Roughly 943 SF of upland in the buffer zone was disturbed (with roughly 303 SF of this area being the original pavement and riprap). Roughly 457 SF of the wetland has been disturbed (with 33.3 SF of this being the shallow trench and an additional 10 SF being original riprap). Most of this 457 SF area retains original soil structure and only has sediment deposits upon it. It is noted that this portion of the Prospect Woods site is a fairly degraded zone, the report stating that the excavation removed “material deposited by the runoff from the road.” 2.4 Summary of Proposed Work To date, the road work is nearly complete, including the installation of the sub-drain. Remaining efforts include replacing the sidewalk behind the Prospect Avenue units, rehabilitating existing downspouts and relocating the existing dumpster pad. The relocated dumpster pad will have an impervious footprint smaller than the existing pad. There is no change to impervious area for the project. Total project disturbance is less than 1 acre. The Zengineer 17 of 42 As there has been confirmed wetland disturbance, the 33.3 SF of disturbed wetland will be backfilled with adjacent material that was excavated from the trench. If sufficient material cannot be translocated without damaging underlying soil structure, a wetland soil mix will be brought in to return the area to original grade. Excess sediment and trench spoils that have contributed to the 457 SF of wetland disturbance will be removed from the BVW. All disturbed wetland areas will be seeded with New England Erosion Control/Restoration Mix For Detention Basins and Moist Sites as provided by New England Wetland Plants, Inc. of Amherst, MA (or other Commission-approved mix). Adjacent upland areas will be restored with the same seed mix. A biodegradable coconut fiber channel liner will be placed over seeded areas which are in the stormwater path. All work in the wetland area will be performed by hand. Only small machines will be allowed to work in the buffer zone beyond the pavement. The remainder of the work within the wetland buffer zone consists of: 1. Establishing additional sediment control barriers around the proposed dumpster relocation and sidewalk repair areas. 2. Removing vegetation in the vicinity of the proposed dumpster pad. 3. Removing bituminous walk behind residences along Prospect Avenue. 4. Installing a concrete dumpster pad and screening fence. 5. Installing bituminous sidewalk. 6. Re-installing downspouts. 7. Re-establishing ground armament (riprap) and vegetation to deter erosion at existing outfall. 8. Re-establishing vegetative ground cover over disturbed areas. 9. Removing sediment control barriers once vegetative cover is established and site is stabilized. 2.5 Variance Request None anticipated at this time. Section 3: Compliance with Performance Standards 3.1 Bordering Vegetated Wetlands – 310 CMR 10.55(4)(b) Inadvertent damage to approximately 33 SF of BVW occurred during construction. In accordance with this performance standard, the Conservation Commission may issue an Order of Conditions permitting work which results in the loss of up to 5000 SF of BVW when meeting the following conditions. 1. The surface of the replacement area to be created ("the replacement area") shall be equal to that of the area that will be lost ("the lost area"); ➢The replacement area will be in the same area and configuration and location as the disturbed area. The Zengineer 18 of 42 2. The ground water and surface elevation of the replacement area shall be approximately equal to that of the lost area; ➢All elevations will be equal. Disturbance is roughly 4” deep. 3. The overall horizontal configuration and location of the replacement area with respect to the bank shall be similar to that of the lost area; ➢All horizontal configurations shall match the original disturbed area. 4. The replacement area shall have an unrestricted hydraulic connection to the same water body or waterway associated with the lost area; ➢No change to the hydraulic connection will be made. 5. The replacement area shall be located within the same general area of the water body or reach of the waterway as the lost area; ➢The replacement area will be in the same area and configuration and location as the disturbed area. 6. At least 75% of the surface of the replacement area shall be reestablished with indigenous wetland plant species within two growing seasons, and prior to said vegetative reestablishment any exposed soil in the replacement area shall be temporarily stabilized to prevent erosion in accordance with standard U.S. Soil Conservation Service methods; and ➢A native wetland replication seed blend is proposed. Soil erosion blankets will be used in areas of concentrated surface runoff. ➢Monitoring: The area will be monitored for at least 2 growing seasons following the seeding of the replacement area to assure establishment of at least 75% cover of wetland species. In the event that 75% wetland cover is not achieved, corrective actions shall be taken and monitoring continued until the 75% criteria is met. Monitoring shall be done by an experienced and qualified wetland scientist, approved by the Conservation Commission. The applicant shall provide annual reports to the Conservation Commission for the first two growing seasons after construction. ➢Corrective Actions: In the event that the required criteria are not met, the monitor shall recommend corrective actions to the applicant. Corrective work within the approved replacement area shall not require prior approval by the Conservation Commission. Work outside the approved replacement area shall first be reviewed and approved by the Conservation Commission. Typical corrective actions may include: •Re-seeding with wetland species. •Removal of invasive exotic species. •Hydrologic modifications (regrading, diversion of surface runoff) 7.The replacement area shall be provided in a manner which is consistent with all other General Performance Standards for each resource area in Part III of 310 CMR 10.00. ➢This project complies with performance standards for Bordering Vegetative Wetlands. Per the DEP’s standards, the Conservation Commission shall consider the magnitude of the alteration and the significance of the project site to the interests identified in MGL c 131, 40 The Zengineer 19 of 42 (The Massachusetts Wetlands Protection Act). The magnitude of the alteration is minimal (33 SF). And as noted in the wetland delineation report by MacLeod, the disturbed area was material deposited by the runoff from the road. We hope that the Commission considers these facts in regards to the anticipated Order of Conditions. 3.2 Northampton Performance Standards – Bylaw Section 337-10 A. All work shall be subject to inspection and require the approval of the Conservation Commission. ➢Work will be made available for inspection. B. To encourage infill development… in the Central Business, General Business, Highway Business, Neighborhood Business, General Industrial, Special Industrial, Planned Village, Medical, Urban Residential-B and Urban Residential-C Zoning Districts… waive Section 337-10 performance standards that are over and above state law, with the exception of the setback requirements of Protected Zone Table (1) and 337-10E(2)(b). ➢The area of interest is zoned Urban Residential-B. The setback requirement shall be 100 feet from a vernal pool. The Prospect Woods development contains developed and degraded areas. C. To encourage infill development… in the Business Park Zoning District for nonresidential use… waive section 337-10 performance standards that are over and above state law…. 115% artificial or replacement wetlands of disturbed areas. ➢The repair of 33 SF of damaged wetlands will be done in place, with additional 300 SF± area being planted with the wetland seed mixture. D. Artificial or replacement wetlands… may be of equal size to wetlands disturbed if replacement wetland is a restoration and of equal or greater value. Replication wetlands must be twice the size as disturbed wetland, per subsections (1)-(8). ➢The wetland repair area will match the disturbed area. The values and functions of the original wetland will be provided by this work. E. Work within upland areas… Work within 100 feet of wetlands should be avoided and reasonable alternatives pursued. (1) 50-100 foot buffer area… may be suitable for temporary, limited or permanent disturbance by demonstrating wetland values are not affected, by means of a plan and assessment. ➢Within 50-100 feet of any wetland, disturbance is generally temporary and only to the extent necessary to rebuild the pre-existing roadway. (a)Commission may allow alteration of 20% (on a lot) or up to 2000 square feet (cluster subdivision) of 50-100 foot buffer area. ➢Less than 2000 square feet of disturbance is anticipated along the edges of the pavement, walkway and dumpster pad at 50-100 feet from the wetland. (2) Alteration within resource area or protected zones is not permitted, except: (a) Projects downgradient of wetlands. The Zengineer 20 of 42 ➢Not applicable. (b) Projects in certain infill areas where development includes mitigation measures that will improve the existing condition. ➢Proposed mitigation measures are planned to match pre-existing measures, with wetland species being seeded over a larger area than actually disturbed. (c) Limited Projects per 310 CMR 10.24(7)(c) and trails. ➢Not applicable. (d) Projects that will improve the natural capacity of a resource area. ➢Not applicable. (e) Agricultural activities per 310 CMR 10.04. ➢Not applicable. (f) Erection of wetland boundary markers. ➢Not applicable. (g) Work involving land under water. ➢Not applicable. (h) Projects in or affecting protected zones or resource areas containing areas already degraded or developed, subject to subsections [1]-[7]. ➢The area of work is already developed and degraded. Proposed work is anticipated to have a similar footprint to existing conditions, though a dumpster pad is being relocated within the project. Repair of damaged areas is proposed. F. Work within vernal pool resource area. (1) Linear systems within the vernal pool resource area, but not within the vernal pool. ➢No vernal pool - not applicable. (2) Driveway crossings within the vernal pool resource area, but not within the vernal pool. ➢No vernal pool - not applicable. (3) Rehabilitation and maintenance of structures and disturbed areas within the vernal pool resource area, but not within the vernal pool. ➢No vernal pool - not applicable. G. Vernal pool habitat is presumed under certain conditions of ponded water in a confined depression, but is rebuttable through specific means described in subsections (1)-(3). ➢No vernal pool - not applicable. 3.3 Massachusetts Stormwater Management Standards This project is a Rehabilitation project, not a New or Redevelopment project. It creates no The Zengineer 21 of 42 new impervious area and changes no stormwater conveyances or point source discharges. As such, the Massachusetts Stormwater Standards apply only to the maximum extent practicable, which require no changes to the existing conditions. A review of standards relative to this project follows. 1. No new stormwater conveyances. ◦Not applicable. None proposed. 2. Post-development peak discharge rates no not exceed pre-development rates. ◦Not applicable. No change to impervious area or discharge rates 3. Loss of annual recharge to groundwater shall be eliminated or minimized. ◦Not applicable. No change to impervious area or recharge. 4. 80% Total Suspended Solids removal. ◦Not applicable. No change to impervious area or stormwater conveyance measures. 5. Land Use with Higher Potential Pollutant Loads. ◦Not applicable. This site is not a land use with HPPL. 6. Discharge to Critical Area. ◦Not applicable. No Critical Areas are present. 7. Redevelopment projects are required to meet the following Stormwater Management Standards only to the maximum extent practicable: Standard 2, Standard 3, and the pre-treatment and structural best management practice requirements of Standards 4, 5, and 6. Existing stormwater discharges shall comply with Standard 1 only to the maximum extent practicable. ◦This Rehabilitation project, at best, qualifies as a Redevelopment project. Since there is no change to impervious area or stormwater conveyances, none of the standards apply. Section 4: Analysis of Alternatives This project replaces existing infrastructure in kind. A dumpster is being relocated and downspouts are being rehabilitated within the project limits. Repair to damaged BVW will be performed. 4.1 Alternative dumpster location? The Prospect Woods Homeowner’s Association has debated the location for one of the dumpsters for months. In addition to the proposed location, it is possible that the dumpster could be located behind the Hatfield Street units, at the end of the dead end “dog leg”. This location is difficult for the garbage truck to navigate (requiring backing up 200 feet) and problematic for several residents to access. Additionally, prevailing winds would carry odor into the residential area – an undesirable circumstance.
