planning board will not approve the plan showing three parcels on
Florence Street and Warner Row if any of the lots, particularly
lot C, will have access to Warner Row. As the plan submitted

an easement on the boundary between lots A and B. The deed to lot

We, THEODORE D. TOWNE AND EVELYN M. TOWNE, husband and wife,
of Northampton, Hampshire County, Massachusetts, owners of all
that real estate located on the southerly side of Florence Street,
being shown on a plan of rand entitled, "Plan of Land in
Northampton, Massachusetts, prepared for Theodore Towne," by Almer
Huntley, Jr. & Associates, Inc., dated February 9, 1983, and
recorded in Hampshire County Registry of Deeds, Book of Plans 124,
Page 1, do hereby make and declare that lots B and C shown on the
aforementioned plan to which reference is especially made for a
more particular description, are subject to the restriction that
no driveway or other means of access shall be created,
constructed, made or used to provide direct vehicular access onto
Warner Row from said lots.
This covenant runs with the title to the affected parcels and
shall be binding on all parties and all persons claiming
thereunder.
Executed as a sealed instrument this 20th day of June
