KNOW ALL MEN BY THESE PRESENTS
THAT MICHAEL GABLE, LAUREE GABLE, DAVID GABLE and VIKI J.
GABLE d /b /a GABLE REALTY COMPANY and ALEXANDER MacPHAIL as individuals
with a usual place of business at Florence Street, Northampton,
Hampshire County, Massachusetts (hereinafter called the Grantor), for
consideration paid
grants to the City of Northampton, a Massachusetts municipal
corporation, its successors, assigns, and agents (hereinafter called
the Grantee),
with warranty covenants the right of easement to lay, construct,
reconstruct, maintain, patrol, operate, repair, and remove storm sewer
pipes and structures, water pipes, water mains and structures and
other utility lines as may be required, through, over and under the
following described real estate:
See Rider A attached hereto and incorporated herein by
reference for a description of the easements herein created.
It is agreed that the pipeline mains and structures shall
remain the property of the Grantee.
Executed as a sealed instrument this b day of 1988.

Beginning at an iron pipe on the easterly end of Bernache Street at
land of Laufman- Randall and Mientka all within the 2.942 acres to be
retained by Grantor running N. 66 56' 27" W. one hundred sixty -four and
three one - hundredths (164.03 1 ) feet to an unmonumented point; thence N. 70
41' 47" W. four hundred forty -eight and two one - hundredths (448.02') feet
to an unmonumented point; thence turning and running S. 15 54' 04" W. fift�
(50.00') feet to an unmonumented point; thence turning and running N. 51
13' 48" W. along land of Grantor one hundred twenty -nine and twenty -four

particularly described on a plan of land entitled "Definitive Subdivision
of Land in Northampton, Massachusetts" prepared for Alexander MacPhail by
Almer Huntley, Jr., & Associates, Inc., Northampton, Massachusetts.
Said easement is described as Water and Drainage Easement I on a
plan entitled "Definitive Subdivision of Land in Northampton,
Massachusetts, prepared for Alexander MacPhail "prepared by Almer Huntley,
Jr. & Assoc., Inc., of Northampton, Massachusetts, to be recorded
contemporaneously herewith and is for the purpose of providing and
maintaining adequate drainage, however denominated, on and through the
surface of the easement area and is for the purpose of construction,
installation, maintenance and repair of water piping, however denominated,
in and under the surface of the easement area provided, however, that anyone
acting pursuant to this Agreement agrees to restore the surface of the land
wherever construction, installation, maintenance or repair occurs
thereon.

thence turning and running S. 15 54' 04" W. fifty -six and sixty -eight one -
hundredths (56.68 feet to an unmonumented point; thence turning and
running N. 70 41' 47" W. twenty (20.00 feet to an unmonumented point;
thence turning and running along Drainage Easement I N. 15 54' 04" E. fifty
(50.00') feet to the place of beginning. Containing 983 square feet, more
or less.
Said easement is described as Water and Drainage Easement IA on a
plan entitled "Definitive Subdivision of Land in Northampton,

on the easterly side of Stage Road; thence turning and running S.
38 16' 41" E. one hundred and seventeen one - hundredths (100.17
feet to an unmonumented point on the northerly line of Florence
Street along land of MacPhail; thence turning and running N. 67
16' 02" W. seventy -two (72.00 feet along land of MacPhail and
Florence Street to the place of beginning.
Said easement is described as Sanitary Sewer Easement 4 on a �.
plan entitled, "Definitive Subdivision of Land in Northampton,
Massachusetts, prepared for Alexander MacPhail" prepared by Almer
Huntley, Jr. & Assoc., Inc., of Northampton, Massachusetts, to be
recorded contemporaneously herewith and is for the purpose of
providing and maintaining adequate drainage, however denominated,
on and through the surface of the easement area and is for the
purpose of construction, installation, maintenance and repair of
sewer piping, however denominated, in and under the surface of the
easement area provided, however, that anyone acting pursuant to
this Agreement agrees to restore the surface of the land wherever
construction, installation, maintenance or repair occurs thereon.
