At a meeting conducted on December 15, 1994, the Northampton
Planning Board voted 7:0: 1 (with Mark NeJame abstaining from
voting) to GRANT the request of ALFRED MARTINBEAULT for a SITE
PLAN APPROVAL under the provisions of Section 10.11 of the
Northampton Zoning Ordinance, to utilize a building as medical
offices and to construct parking as required under the Zoning
Ordinance at 5 Franklin Street. . .-
Planning Board Members present and voting were: Chairman Andrew
Crystal, Vice Chairman Daniel Yacuzzo, Joseph Beauregard, Jody
Blatt, Nancy Duseau, Kenneth Jodrie, Mark NeJame, and Bob Riddle.
In Granting the Site Plan Approval, the Planning Board found:
A. The requested use protects adjoining premises against
seriously detrimental uses through provisions for
surface water drainage, sound and sight buffers and
preservation of views, light, and aiel .
B. The requested use promotes the convenience and safety
of vehicular and pedestrian movement within the site,
allows access by emergency- vehicles And supplies a
proper arrangement of parking and loading spaces, and
provides for persons with disabilities, as demonstrated
on the approved site plan.
C. The requested use will promote a harmonious
relationship of structures and open spaces to the
- ;tural landscape, existing buildings and other

D. The requested use will not overload the City' s
resources including the effect on the City's water
supply and distribution system, sanitary and storm
sewage collection and treatment systems, fire
protection, streets and schools, beause the size of the
building will be reduced, from what exists on the site
at present.
E. The requested use meets the special regulations set
forth in the Zoning Ordinance.
F. Compliance with the following technical performance
standards:
1. Curb cuts onto streets have been minimized by
using existing access. Businesses will use a
common driveway. Not more than one curb cut has
been requested.
2 . Pedestrian, bicycle and vehicular traffic movement
on site has been separated, as shown on the
approved site plan.
Conditions imposed on the project are as follows :
1. The applicant shall submit a revised site plan showing an
updated engineer's stamp certifying the plans as accurate
and showing an additional entrance in the front of the
building.
2 . A separate and revised planting plan shall be submitted to
and reviewed and__approved by the Office of Planning and
Development staff and one member of the Planning Board.
3 . A Certificate of Occupancy will not be issued until the
installation of the plantings have been completed as shown
on the revised site plan.

11, no Site Plan Approval, or any extension, modification or
renewal thereof, shall take effect until a copy of the decision
bearing the certification of the City Clerk that twenty days have
elapsed after the decision has been filed, or if such an appeal has o
been filed that it has been dismissed or denied, is recorded in the
Hampshire County registry of Deeds or Land Court, as applicable and o
indexed under the name of the owner of record or is recorded and

noted on the owner's certificate of title. The fee for such
recording or registering shall be paid by the owner or applicant.
It is the owner or applicant's responsibility to pick up the a
certified decision from the City Clerk and record it at the
Registry of Deeds. ^�
The Northampton Planning Board hereby certifies that -a--Site Plan o
Approval has been GRANTED and that copies of this decision and all
plans referred to in it have been filed with the Planning Board and
the City Clerk.
Pursuant to Massachusetts General Laws, Chapter 40A, Section 15,
notice is hereby given that this decision is filed with the

If anyone wishes to appeal this action, an appeal must be filed
pursuant to MGL Chapter 40A, Section 17 , with the Hampshire County
Superior Court or the Northampton District Court and notice of said
