Conditions imposed on the project are as follows:
1. The applicant shall submit a revised site plan showing an
updated engineer's stamp certifying the plans as accurat

and reviewed and approved by the Office of Planning and
Development staff and one member of the Planning Board.
3 . A Certificate of Occupancy will not be issued until the

Planning Board Meeting Minutes - December 15, 1994
At 5 : 10 P.M. Chair Crystal opened the Continuation of a Public
Hearing on the request of Alfred Martinbeault for Site Plan
Approval to utilize a building as medical offices and to construct
parking as required under the Zoning Ordinance at 5 Franklin
Street.
Mr. Martinbeault and his engineer were present to discuss the
application.
Paulette Kuzdeba reviewed the application and the concerns that
were expressed by the Planning Board at the previous meeting,
including the need for better details such as more defined signage
and landscaping which would shield the parking area. A revised
plan was submitted by the applicant which shows that the parking to .
the rear of the building had been changed to be perpendicular
instead of angular parking. Kuzdeba said the applicant may need to
add another entrance to the building on the plan.
The engineer questioned whether the sidewalk shorn to the side of
the building on the plan could be deleted since a new entrance will
be built in the front of the building. The sidewalk was suggested
by the Planning Board before the additional entrance was added,
because of concern about pedestrian circulation on the property.
Since the majority of the parking will be in the front lot, people
would have to walk around the building to get to the entrance
located in the rear. The applicant has agreed to add an entrance
in the front of the building which would eliminate the need for a
sidewalk. The engineer said that the new front entrance would not
have to be handicapped accessible since the rear entrance would be
accessible. The Planning Board agreed that the applicant could
delete the sidewalk around the building since there would be two
entrances .
Chair Crystal told the applicant that the submitted plans were hard
to follow. He also noted that the plans would need to have an
updated stamp and date by a civil/professional engineer .
Discussion_o. onsoed abhut the planting _ n tobuffer on

the front side of the paking lot plans n s for fencing and details
of plant materials. Kenneth Jodrie suggested that the applicant
needed to present a specific plan which shows where the plantings
will be installed and what type of plants. Paulette Ruzdeba said
that the Board could condition that a revised plan be submitted
which gives greater details on the plantings and the revised plan
could be approved by staff and one Planning -Board member. The
engineer said he could submit at'evised plan within the next week.
- - Nancy Duseau suggested that the Board should place a condition for
a deadline to get the planting completed. Paulette Kuzdeba said
that a Certificate of Occupancy could be contingent upon the .
plantings being completed as .per the plan submitted and approved. ..=
The Board discussed Eight and sound buffers and how much detail was
required by the zoning ordinance and whether it was within the
Board's purview to require more detailed plans from the applicant.
Paulette Kuzdeba reviewed the zoning ordinance on page 10-8 which
outlined the requirements for Site Plan Approval.
The Planning Board agreed that a revised site plan needed to be
submitted for a variety of reasons. Chair Crystal said that the
Board wanted more specific details on the plantings.
Joseph Beauregard moved to close the Public Hearing. Nancy Duseau
seconded the motion which passed 7:0:1 with Daniel Yacuzzo
abstaining from voting.
After reviewing the approval criteria for Site Plan Approval on
page 10-10 and 10-11 of the Zoning Ordinance, Joseph Beauregard
moved to approve the Site Plan contingent upon:
1. The applicant shall submit a revised site plan showing an
updated engineer's stamp certifying the plans as accurate and
showing an additional entrance in the front of the building.
2 . A separate and revised planting plan shall be submitted to and
reviewed and approved by the Office of Planning and
Development staff and one member of the Planning Board.
3. A Certificate of Occupancy will not be- issued until the
installation of the plantings have been completed as shown on
the revised site plan.
Nancy Duseau seconded the motion which passed with a vote of 7:1:0
with Mark Nejane opposing.
