STATEMENT FILED IN CONNECTION WITH
PETITION FOR SPECIAL PERMIT BY
NORTHAMPTON PINE REST, INC.
ATTACHMENT TO NO. 6
Petitioner has been notified by Federal and State authorities that the
building in which it operates a nursing home no longer complies with applicable
safety codes. The anticipated expenditure of a disproportionately large sum of
money and the loss of licensed-bed capacity render the further renovation of
the existing structure as completely unfeasible and unsatisfactory. Therefore,
in order to continue operating the nursing home at all, and at the present quality
and level of service, petitioner has designed this proposed facility to continue
and improve its business and provide the area with a quality long-term health care
facility.
With respect to Article X, Section 10.9(b) , the petitioner makes the follow-
ing representations as to all six conditions being fulfilled.
1. ((b) (1)) The use requested is listed as a special permit in Article
V, Section 5.2 at Page 5-10.
2. ((b) (2)) The requested use bears a positive relationship to the public
convenience and welfare for the reason that a modern and complying long-term health
care facility, has a substantial place in every community as it prepares and provides
for all classes of its residents.
3. ((b) (3)) The requested use will not create any undue traffic congestion,
nor will it unduly impair pedestrian safety. This is due to the fact that there
will be no perceptible increase in the use by either vehicular or pedestrian traffic
of the altered facility. This contention is based in part on the following:
(a) The increased number of pat ents is minimal;
(b) Additional staff required will not exceed five (5) ;
(c) The access to the facility will be, as shown on the site
plans, one way, in and out;
(d) There will be no additional curb cuts;

(e) Visits by friends and relatives has been and is expected
to remain minimal. Nevertheless, most visiting is done at
other than peak traffic hours; and
(f) No additional service traffic (i.e. for supplies, etc.)
will be necessary since the small increase in the number of
patients will only require larger deliveries, not more deliv-
eries.
4. ((b) (4) The requested use will not overload any public water,
drainage or sewer system or any other municipal system, since the small increase
in the number of patients will not have any appreciable affect on the above listed
systems which are already structured to meet the requested use.
5. ((b) (5)The petitioner feels that Article XI is not applicable to its requested
use but guarantees that any applicable regulations will be fulfilled in all respects.
6. ((b)(6) The requested use will not unduly impair the integrity or
character of the neighborhood. This is due to the fact that a nursing home has
been maintained at the same location for the past twenty-five (25) years. Further-
more, a good faith effort has been made to maximize absorption of the proposed
facility into the architectural size and style of the neighborhood. Also, leav-
ing a pre-existing use (a nursing home) in operation while terminating a type of
half-way house and a multi-family dwelling does not seem to be the type of pro-
ject which will impair to any extent, much less "unduly" the integrity or charac-
ter of the neighborhood.
There is nothing detrimental to health, morals or welfare in any respect
in what would be the normal growth of an existing nursing home. In addition,
the proposed use would permit a larger number of senior citizens to be cared for
in a residential setting.
For ALL buildings within Fire District and for other buildings costing $10,000.00 or more, plans
and specifications must be submitted to the Inspector of Buildings for examination and approval.
If building is to be moved give details relative to proposed location as for a new building.
