Dear Members of the Board:
On behalf of John J. Hanley, applicant and trustee, application is hereby made for approval
of a Preliminary Plan. This application is being made in accordance with Section 5.00 -
Procedure for the Submission of Preliminary Plans of the "Rules and Regulations Governing
the Subdivision of Land in the City of Northampton" as revised and the "Zoning Ordinance",
City of Northampton as revised.
In addition to the eleven (11) prints of the Preliminary Plan, ten (10) copies of Form B and
$1,650.00 ($300.00 + $50.00 x 27 units) filing fee are submitted to the Planning Board as
part of this application.
Waivers:
The following four (4) waivers of compliance of the Rules and Regulations Governing
Subdivision of Land are hereby requested as part of the initial Preliminary Plan as permitted
under §1:02 and §3:02 of said regulations and MGL Ch. 41 §81-R:
1) Waiver of§5:01 - To defer staking of lot corners until road alignment is
finalized, due to the potential for changes based on the three
(3) waivers listed below.

2) Waiver of §7:01(1)c - To delete the requirement for right-of-way access to adjoining
property. The proposed subdivision roadway is expected to be
a private way.
2) Waiver of §7:01(5)a - To allow a dead-end street in excess of 800 feet in length (1400
feet is requested). Almost 600 feet of the roadway is impacted
by wetlands.
4) Waiver of §8:23 - To allow the use of gabion retaining walls (if appropriate) at
the proposed wetland crossings to minimize potential impact to
resource areas,
The applicant respectfully reserves the right to request additional waivers within the
Preliminary Plan review process, as a result of the granting or denial of the above listed
waivers.
