Upon completion of this meeting you verbally agreed to correct all outstanding violations as soon as possible. At this same time, Mr. Kevin Malloy (Room #6) agreed to allow you or your contractor access to his room to effect all necessary repairs (Only on a daily basis and with proper notifi- cation of at least 24 hours) . It should also be noted that the following violations have been corrected: 410.252 (bathroom light) , 410. 501 (3) (storm door windows) , 410. 501 (4) (bathroom ceiling panels) . Said viola- tions were abated as of November 4, 1991 when a reinspection of the premises was made. REGULATION 410.190 VIOLATION REMEDY Hot water temperature to bathrooms is extremely hot temperature fluctuates considerably when turned on. Over a two to three minute period, temperature of water went from 128°F up to 148°F; then down to 126°F; then back up to 164°F. Legal range is between 110°F (minimum) to 130°F (maximum). Take whatever action is necessary to bring hot water temperature range into code compliance for all common bathrooms in the building. 410.351 3'"floor Bathroom wash basin: Cold water will not shut off at the faucet. REMEDIES AND PENALTIES Part of the Inspection Report contains a brief summary of some legal remedies tenants may use in order to get Housing Code violations corrected. Failure to comply with this order also subjects the person ordered to a criminal fine of not less than ten ($10.00) dollars, nor more than five hundred ($500.00) dollars for each day's failure to comply with this order. THE FOLLOWING IS A BRIEF SUMMARY OF SOME OF THE LEGAL REMEDIES TENANTS MAY USE TO GET HOUSING CODE VIOLATIONS CORRECTED: 1. RENT WITHHOLDING(GENERAL LAWS,CHAPTER 239,SECTION 8A) If Code Violations are not being corrected you may be entitled to hold back your rent payments. You can do this without being evicted if: A. You can prove that your dwelling unit or common areas contain code violations which are serious enough to endanger or materially impair your health or safety and that your landlord knew about the violations before you were behind in rent. B. You did not cause the violations and they can be repaired while you continue to live in the building or apartment. C. You are prepared to pay any portion of the rent into court if a judge orders you to pay it. (For this it is best to put rent money aside in a safe place.) 2. REPAIR AND DEDUCT(GENERAL LAWS CHAPTER 111,SECTION 127L) The law sometimes allows you to use your rent money to make the repairs yourself. If your local code enforcement agency certifies that there are code violations which seriously endanger or materially impair your health,safety or well-being and your landlord has received written notice of the violations,you may be able to use this remedy. If the owner fails to begin necessary repairs(or to enter into a written contract to have them made) within five days after notice or to complete repairs within fourteen days after the notice you can use up to four months' rent in any one year to make the repairs. 3. RETALIATORY RENT INCREASES OR EVICTIONS PROHIBITED(GENERAL LAWS CHAPTER 186,SECTION 18 AND CHAPTER 239,SECTION 2A) The owner may not increase your rent or evict you in retaliation for making a complaint to the local enforcement agency about code violations. BREACH OF WARRANTY OR HABITABILITY You may be entitled to sue your landlord to have all or some of your rent returned if your dwelling unit does not meet minimum standards of human habitability. 6.
