The tenant also made a complaint that the heating was inadequate in the front of the
use. Due to the fact that the heat was not on I could not inspect this complaint for accuracy. I
d let the tenant know about the heating code and she will call me back if she thinks there is a
olation.
The Northampton Board of Health is acting under the authority of MASSACHUSETTS
GENERAL LAWS, 105 CMR 410.000: State Sanitary Code Chapter II: Minimum Standards for
uman Habitation. You are hereby ordered to make a good faith effort to comply with the formal
rder issued to you above within the time frame listed. Failure to do so could result in legal action
iken against you to pursue compliance with this order. A re-inspection will take place on or
round October 22, 2010.
Failure to comply with any order issued pursuant to the provisions of 105 CMR 410.000-shall upon
onviction be fined not less than $10 or more than $500. Each day's failure to comply shall constitute

It looks like a retail business is allowed at that location because it is in the Neighborhood Business district. There might
be building code restrictions based on whether the person selling actually fives in the"business'space. The length of
time the resident has lived there is also important.
There is an allowance for tag sales in that district, but there are restriction is the edge of the concrete walk/patio in front
The city right of way is wide at that point and it looks like the property 9
of the house. If it is actually a legitimate business,the goods for sale need to be kept 10' back from the front property
line.
I've attached the table of use for that district. Tag sale rules are on pg. 2 and retail is on pg.5.
Based on your pictures, it doesn't seem to qualify as a tag sale so unless it is a business,we'd write a letter telling the
resident to stop.

when unattended (which was the case today-I knocked on all the front doors-no response-rear 2^d
floor tenant said goods belonged to front tenant).
These items must be removed and disposed of or stored properly within 48 hours.
You are hereby ordered to correct the violations no later than Monday August 3,2015.A re-inspection for
compliance with this order will be conducted at that time. IF THE VIOLATIONS ARE NOT CORRECTED
BY THIS DEADLINE DATE, YOU WILL BE SUBJECT TO RECEIVING A VIOLATION TICKET WITH A
FINE. The fine will not be less than$25.00 and not more than $300.00 per violation,per day. Each day's

I spoke this morning with Marpa Eager, landlord of this property(he had left me a voicemail yesterday 10/6/15 while I
was working in Amherst, and he is copied on this email). Marpa has been in contact with Wayne's mother about
Wayne's belongings and with her knowledge has organized work to begin this afternoon on sorting, storing, and
disposing of items as appropriate. Marpa's trash hauler is contracted to dispose of items deemed trash and will also be
by today to begin that process; the landlord's commitment is to continue until the property is properly maintained and
items kept are safely stored in the commercial space. He will continue to work with Wayne and Wayne's family about
the future clearing of the commercial storefront if/when necessary.

Hi Marpa-
I went by again, today, same mess, but I met a young woman (a tenant of this building)who said that Wayne has
resurfaced and that after she expressed her feelings about the way he left the front of the building looking she had
offered to help him move stuff inside and she was waiting for his arrival. Wayne didn't come back while we talked but
I'll check again on Monday. Some of the glass items have broken and there is glass on the concrete stairs in front;
nothing has been pulled back so far. The condition of the steps is deteriorating, I'd have a mason look at them. I think
they are harder to fix the longer you wait.

Hi Marpa
I went by yesterday after I'd had a fairly long phone conversation with Wayne late last Thursday (he called me). He
said he would pull everything back over the weekend,that he and his neighbor would get it inside or well back from the
property line and when I went by yesterday morning he had. Stairs are clear, nothing on the blacktop -still looks a little
untidy(stuff is right in front of the storefront on the outside)but I don't think we'll get calls about what is left. I told him if
he is opening a business he needs to register his business and he ought to have some insurance (he thought his
renter's insurance would cover his business which 1 told him was most likely not so-which makes me wonder if your
insurance on the property allows tenants business use?).
I'm going to make a point of driving by on a regular basis and hope for the best.

Alisa,
I looked again, and that property (and the one next door) is zoned neighborhood business.The"store can be there
as of right as a regular business, not just as a home business. If you look at the map I sent, you can see that the city
right of way extends right up to the concrete walkway. He can't place anything on the asphalt pavement.
Because the zoning is neighborhood business, a retail or personal service establishment<10,000 sq ft is allowed. I
can't find anything in zoning that prohibits outdoor display of merchandise except for home businesses and in off street
parking areas with more than 5 spaces.
I'll talk to Carolyn Misch tomorrow, but I don't think zoning is going to be able to regulate in this situation. The DPW
would deal with anything displayed or stored on the asphalt paving, and the city clerk may have a way to require a
business license but this may need a different approach; possibly through the landlord. I've included Ed Smith from the
health department on this email.

what constitutes a home business, but there appears to be a lot of questionable activity happening there.A good
number of folks in Leeds are upset by all different aspects of what's happening over there.

I spoke to Pam, our City Council Clerk who, as you know, used to be in the City Clerk's office. Her thought was that we
could try to compel Wayne to get a second hand dealer's license for his business, but that essentially,there is no

Hi all,
I've gotten word from folks who live adjacent to Wayne that he was just arrested and will be serving a six-month
sentence at the Hampshire County jail. The problem herein is that all of his"wares"are out on the sidewalk,winter is
approaching and he won't be out of jail on time to do anything about the mess in front of his apartment on Mulberry
Street in Leeds. Can you please advise regarding what we might do to get all of his things off the sidewalk? I'm
including here Chief Kasper as she may have some insight into how to manage this situation, as well as Ned Huntley in
case this might come down to sidewalk safety issues.
A few thoughts about this:would the jail have any services and jurisdiction to move his stuff while he's incarcerated? Is
his landlord, Marpa Eager, responsible for the stuff on the sidewalk in his tenant's"abandonment"of it, and if so, who
should contact him? Have any of you had contact with Wayne's parents(who purportedly pay his rent on the apartment
and"store"), and if so, should they be contacted to come take care of Wayne's mess?

Alisa,
We would ordinarily direct the property owner to take whatever actions that are necessary. If the wares are on city
property, I think the DPW can simply remove them. If they are on private property and interfere with safe egress from
the building, I can order that the building owner correct the problem. I don't think there is a zoning ordinance that

I would suggest that the owner move the"wares" into the building (as long as that doesn't create a fire hazard)or into
one of the storage buildings at the rear of the property. I don't think that would be very costly.
You can have the building owner call me if she has questions.

Thanks, Meredith. Ned Huntley also emailed me saying he thought the landlord is responsible for Wayne's stuff that's
been left outside. In the past, Ed Smith and/or Louis Hasbrouck were in touch with the landlord, Marpa Eager. Would it
be possible for one of you--Ed or Louis--to contact him again to let him know about this new development and to ask
that he either store or dispose of Wayne's stuff that's out on the sidewalk? Please let me know because if you don't
contact him, I or someone from the Leeds Civic Association will take this on, but it does seem to me like City staff might
want to take the lead here unless I'm mistaken.

I went by yesterday after I'd had a fairly long phone conversation with Wayne late last Thursday (he called me). He
said he would pull everything back over the weekend,that he and his neighbor would get it inside or well back from the
property line and when I went by yesterday morning he had. Stairs are clear, nothing on the blacktop-still looks a little
untidy (stuff is right in front of the storefront on the outside) but I don't think we'll get calls about what is left. I told him if
he is opening a business he needs to register his business and he ought to have some insurance (he thought his
renter's insurance would cover his business which I told him was most likely not so-which makes me wonder if your
insurance on the property allows tenants business use?).
I'm going to make a point of driving by on a regular basis and hope for the best.
