Danial Wasiuk, Health Inspector City of Northampton Health Department Northampton, MA 01060 RE: Apartment SL-236 South Street April 15,2016 Mr.Wasiuk, Since receiving your Correction Order on Saturday—April 9'h,the following(in summary) has been done: Sunday-April 10`h I communicated with tenants from 1R, 2L and 2R to get their subjective feedback regarding the heat. All other tenants in the building were very comfortable. Monday—April 11th Tenant Madeline complained that the temperature in her apartment was not meeting"Sanitary Code" and that the heating system was obviously broken at 7:27 AM. I immediately contacted: Phillips Heating and Plumbing 45 Payson Ave. (Across from Town Hall) Easthampton, MA 01027 (413) 527-0340 I was concerned that the system was broken and asked Phil Hurteau if he could possibly do an emergency assessment of 11 to make certain that the unit was receiving heat. Although he was booked solid, he agreed and would try to assess it for me. I tented all the tenants in 11 that I was attempting to get someone to do a temperature safety check. Phil was able to come to the property around 10 AM. Given that we were both concerned about the tenants safety we agreed that it was imperative to check for heat delivery to the unit. Upon entering apartment 1R, I did not feel as warm as my previous visits. I had been in and out of that apartment in November and December and did a radiator check of Madeline's bedroom on January 6th and 10ih. Phil checked all the radiators in the common areas for heat (we did not enter any of the bedrooms). Of the four radiators he checked, he found the air values on three radiators to be set to ZERO. This included the kitchen,the porch entrance room and the living room. The bathroom radiator was not at ZERO. It was very hot to touch(Phil nearly burnt his hand because he expected it to be cold like the others). Invoice attached. Phil turned the radiators on and I informed the tenants that my plumber would be on site on the following two days and would need access the situation further. Tenant Elliot requested that we use the interior hallway door for access if the plumber needed to get in to the apartment(I think this was due to the cat). Tuesday—April 12`" I asked my plumber: Greg Mongeon Plumbing& Htg 26 Trumbull Road Northampton, MA 01060 Phone: (413) 584-2820 to replace ALL the air valves on the radiators in 2R. (He had evaluated the radiators in the apartment in February when I first heard that 2R was getting too warm due to the manipulation of the thermostat). I also personally evaluated the air valves in 1L. I turned all of the radiators in that apartment ON and called for heat. ALL the radiators got"piping' hot(I did not check the radiator in Aiden's room at her request as she stated that she has not been having any issues with the heat). I demonstrated that the radiators were getting hot to the tenants after they were turned ON. Also the thermostat on the second floor landing was noted to be set at 68° F on numerous random checks. The ambient temperature reading on the thermostat was also 68° F. Wednesday—April 13th I contacted the tenants in 1L to check their comfort level. They claimed it was only 65 degrees in the apartment. I immediately went over and found that the thermostat had been reset to 65 degrees. With this downward adjustment(from 68°F)the furnace did not need to re-fire for much of the morning. I reset the thermostat to 68° F and requested everyone's cooperation until this issue is resolved. Even valves tves were I not clogged,that requested that plumber Greg Mongeon replace rALLL the air valves that the delivered to the air valves were not clogg q Thursday—April 14th I did a spot check of the thermostat at 7:30 AM in anticipation of a temperature survey to be conducted by a licensed contractor. I found the thermostat set to 68° F and it was showing an ambient temperature of 68° F. Interestingly I encountered tenant Madeline in the common area leading to the thermostat at that time She stated she had just woken up and that her apartment was comfortable. I trust she must have been heading to the laundry area and not to the second floor landing. At 10:00 AM I met with Dick Bart an experienced,licensed contractor at the apartment for the purpose of conducting a temperature survey. Please see the attached report. It is not my intent to elaborate on the contentious relationship that has developed between the apartments on 1L and 2R but this heating situation clearly developed after Ja a a port that it was toots 1“when the moved into it Until that time no issues with the heat existed except getting warm. (as I previously mentioned the past 12 years has been very harmonious). Shortly after IL moved in one of my tenants(Matt- IR)complained to me that he was waking up cold on three consecutive days(on January 5th). Matt and his girlfriend had been with me for over four years. Upon his investigation he found that the furnace was being turned OFF at the thermostat each morning. He offered to keep an eye on things to help figure out who was doing this and also put up a sign indicating that the heating system should not be turned OFF. After it happen again on January 6th contacted John this situation whosery serviced / been related boiler last year.the John was boiler to come way, year. John was able to come by on that day(January 6th)and evaluated the heating system. We determined that the boiler was working and the thermostat was cycling on and off appropriately. also evaluated the pipes leading to apartment 1L and found them to be appropriately hot. It was his professional opinion that there was no way the boiler would have the capacity to turn off the thermostat.I additionally called Honeywell who confirmed that this was true.Clearly somebody had been tampering with the thermostat. Invoice attached. On that day(January 6'") I was able to also evaluate the radiator in the Madeline's room to make certain that it was warm and found that it was. Subjectively the apartment was warm. I brought this to the attention of the roommate(Elliott)who was the one who allowed me to enter the apartment at that time. I did notice that there was no bed in Madeline's bedroom and saw a pillow, a blanket and a mat in the corner on the floor. I issued a memo to all tenants on January 6th that turning off the heat places the tenants and building at risk. And stressed that with tenants working together and communicating on this topic a happy medium can be achieved. Since I could not be there all the time, Matt (and his girlfriend Amber)agreed medium to di keep an eye on the situation for me and let me know it the problem re-occurred. They reported no further issues. Of course, no one admitted to tampering with the thermostat and it was not clear what was happening. Madeline firs[admitted to me that she had been turning up the heat when she felt cold (early Feburary) and roughly at that time the 2R apartment was stating that the thermostat was being turned up greater that 66° F (set as high as 72° F). Upon hearing this I requested that plumber Greg Mongeon make contact with the folks in 2R to check radiator problems. Invoice attached. i have tried to be as responsive and accommodating to Madeline's needs especially when it comes to to her heat. Most recently she appears to have become vacate the apartment prematurely and wanted her portion tof the security dep s tsunbundled and with me as she returned to her. After several inquiries about getting her deposit back early, I was firm in asserting that there were no provisions for subleasing in the lease and that I would return the deposit for the apartment within 30 days of the termination of the lease. All tenants in the building were dvised to keep the thermostat set to 68°F the day prior. A spot check of the thermostat was made at 7:30 OM on the morning of the survey and the thermostat vas set to 68o F and the ambient temperature reading Nas noted on the thermostat to be at 68°F. The system Nas observed for 30 minutes until the ambient temp dropped netting a call for heat from the furnace. The furnace fired appropriately. The survey was conducted at 10 AM. The thermostat was set to 68° F and it read 68° F at the beginning of the survey and at the conclusion of the survey. A digital thermometer confirmed the ambient temperature to be 67.5°F proximal to the thermostat at the conclusion of the survey. There was no call for heat during the survey. The roommate Elliot was present during the entire survey.
