ZONING BOARD OF APPEALS
At a meeting held on December 3, 1986, the Zoning Board of Appeals
of the City of Northampton voted unanimously to grant the Special Permit
request of George M. , Bernice A., George A. and Kenneth W. Childs ,
25 State Street, Northampton, MA for the purpose of reducing the number
of required parking spaces in conjunction with the construction of an
. addition onto an existing structure located at 34 Bridge Street,
Northampton, MA (NB Zone). Present and voting were: Chairman Robert C.
Buscher, Peter Laband and Sanford Weil, Jr.
The findings were as follows:
R. Buscher found that with an addition of 3,075 sq. ft. , 67 parking
spaces are required and a reduction to 56 parking spaces
is justified with the stipulations listed below.
P. Laband concurred.
S. Weil concurred. .

The conditions are as follows:

1. The applicants shall not be able to use more than 3,075 sq.ft.
in aggregate in the addition until such time as additional
parking is provided for.
2. The applicants must reduce their parking at this time from
56 spaces to 53 and reapply to the Board for a Variance from
the open space requirement. In the event that this Variance
. is granted, three parking spaces shall be restored. If the
Variance is not granted, these spaces must remain as open space.

Dear Mr. Childs:
We have received the decision from the Zoning Board of Appeals today;
granting your application. There is now a twenty (20) day appeal period
you must await. After the appeal period is up, you must go to the City
Clerk's office and get a stamped copy from them which will indicate that
there has. been no appeals on the decision you received from the Zoning
Board. Then bring the stamped copy they give you over to the Registry
of Deeds and file it with them, but be sure they give you a copy to give
to us to keep on file in our office. Then you can come to our office to
apply for the building permit, but until all the above listed steps are
complete our office can't issue you the building permit. Be sure to get
the above mentioned copy from the Registry of Deeds, so we can process
the building permit immediately.
For Your Information: Zoning Ordinance Section 10.6 - Permit Time
Limits. A Zoning Board Decision granted under the provisions of Section
10. 10 shall lapse within eighteen ( 18) months (including such time re-
quired to pursue or await the determination of an appeal ) from the grant
thereof has not sooner commenced except for good cause, or if, in the case
of a permit for construction, construction has not begun by such date
except for good cause.

CONTINUATION OF APPLICATION TO
NORTHAMPTON ZONING BOARD OF APPEALS
9. Reasons upon which application is based: Applicants are
under contract to purchase the premises at 34 Bridge Street.
This site was converted in 1985 from its former use as the
Northampton Office of the Division of Employment Security to a
16,878 square foot building suitable for retail stores. The
original developers were not able to rent out the space and
sold the complex to the current owners earlier this year. The
building has been unoccupied for approximately one year. There
are currently 56 parking spaces on the site.
The applicants plan to relocate their existing business,
H.L. Childs & Sons, from 25 State Street to the 34 Bridge
Street site. H.L. Childs & Sons has been in business for
approximately 35 years and its toy shop and paint supply
business will be continued at the new location. A sporting
goods division will be added as well. In addition, the
southern corner (closest to Bridge Street) of the new building
will be occupied by the first Hampshire County branch of
Vanguard Savings Bank if the required approval of the Banking
Commission is obtained.
The applicants propose to build a 1,675 square foot
addition in the northern corner of the site. The addition will
be used solely for storage purposes. As a storage space, it
will not attract any additional business or traffic to the
premises. It will merely be an adjunct to the primary retail
business. The applicants have determined that there is a need
for this additional storage space as the existing square
footage will be entirely filled by the bank and the relocation
and expansion of their business. If they are unable to build
the addition, the applicants would be forced to place a 20
yard-long dumpster at the north end of the building to store
trash. With the addition, all trash storage would be inside.
This site is unique in that nowhere else on Bridge Street
is there a parking lot of this size. With the proposed use of
the premises by only two businesses, H. L. Childs & Sons and
Vanguard Savings Bank, it is the applicants ' position that 50
parking spaces will be adequate. This position is based on the
fact that 5F% of the square footage will be occupied by H.L.
Childs & Sons. For many years, H.L. Childs & Sons has existed

larger parking lot will more than compensate for the expansion
of H.L. Childs & Sons and the addition of the bank. As
mentioned previously, the proposed 1, 675 square foot addition
in and of itself would not attract any additional business or
traffic, as it will be devoted solely to storage. Thus,
conditions unique to the proposed use and the site reasonably
justify the requested reduction.
The proposed use, with 50 rather than 56 parking spaces,
will be in harmony with the general purpose and intent of the
Zoning Ordinance. Sufficient parking will be provided without
any impairment of the integrity or character of the district or
adjoining zones. In fact, the proposed use of the site will
enhance the area and Northampton as a whole by allowing two
reputable businesses to establish themselves in a high
visibility location which is passed each day by a large number
of travellers.
