'Fs TEL:(413)586'7525 eanuvl 1.!0645-+255 BRANCH OFFICE 24 NORM STREET PITTSFIELD 01201 TEL;(413143 475 Dear Mr. McErlain: This Department has received a complaint from Elaine Fletcher of the Hampshire Community Action Commission; Housing Services Program regarding 105 CMR 410.000 Minimum Standards of Fitness for Human Habitation. Ms. Fletcher is working with Silvia Johnson of 2 Maple Avenue, Apt. #32 in Northampton in order to resolve a housing complaint that was brought to her attention by Ms. Johnson. Ms. Fletcher stated that Ms. Johnson alleges that the Board of Health failed to issue the required inspection report following an inspection conducted of her apartment on October 12, 1989. This initial complaint involved a cross-metering violation. Statue requires that the Board of Health issue an inspection report following all inspections. This Department requests that you issue the required inspection report regarding your October 12, 1989 inspection of Ms. Johnson's apartment within 48 hours of receipt of this letter. In addition, Ms. Fletcher stated that on December 6, 1989, both she and the tenant Ms. Johnson, notified the Board of Health that the gas stove was malfunctioning and emitting an odor of gas. The tenant alleges that a window dust be left slightly open because she experiences headaches due to this malfunctioning gas stove. Ms. Fletcher stated that the Board of Health informed her that an inspection would be conducted, but to date this inspection has not been performed. It was stated, however, that the Board of Health did call the owner and informed him that repairs to this stove must proceed right away. Ms. Fletcher also stated that the tenant is concerned that a cross-metering violation may still exist concerning the exterior lighting. The tenant believes that the electrictitY used to illuminate the exterior may be wired to her electrical meter. The tenant further stated that shortly after the issue of possible cross-metering regarding the exterior lighting was brought up, the lighting for the exterior was turned off. The tenant stated this possible cross-metering involving the exterior lighting was mentioned in the original complaint.
