An inspection on September 9, 1994 revealed the following: three large ashtrays in the front entrance lobby adjacent to the benches -- there was a lack of signs prohibiting smoking in the common areas several people were observed smoking while passing through the lobby. Please be advised of the following: The Board of Health regulation (copy attached) which prohibits smoking in common areas (lobby, elevators, etc.) of retirement facilities is now in effect. As proprietor of the McDonald House and other Elderly Housing facilities, you are hereby ordered under authority of Chapter 111, Sections 31 & 31C, to remove the ash trays, post "NO SMOKING" signs, and otherwise make a good faith effort to prevent smoking in all common areas of the Housing Authority Building within twenty-four (24) hours of the receipt of this notice. Specifically, it is alledged that, on the afternoon of February 12, 1996, you were observed smoking a cigarette in the McDonald House lobby near the elevator. It is further alledged that you routinely smoke in this public area. As you are aware, the McDonald House is a"public place"according to state law; and lobbies, hallways, elevators, and other common areas are public areas where smoking is prohibited both by State Law and local Board of Health regulation. Ms. Ray notified us of the problem last month and, within days, we installed a Plexiglas covering over the balusters to prevent her 18 month-old from climbing through them and down the stairs to explore the world beyond. While we abide by State Sanitary Code standards, it would be a huge financial burden for property owners across Massachusetts to retrofit all stairs under their control, and I would hope there will be a grandfather clause if a new distance is adopted. If so, we will utilize the new standards, when adopted, for all new construction and modernization related to stairways. Of course, when presented with an issue of safety from a specific resident we will take appropriate action, as in the case of Ms. Ray. This letter will certify that the inspection revealed violation(s) which are listed below, which are or could be serious enough as to endanger or materially impair the health, safety, and well-being of the occupants. ARTICLE H 410.000 VIOLATIONS 410.352, .410.451, &410.602 - The conditions of your apartment were unsanitary with excessive clutter in every room. The clutter was obstructing all passageways and all of egresses.The apartment also has a fowl odor of urine and human feces. There is evidence of very poor housekeeping noted and the foul odor is permeating apartment and into the hallway. Some food spillage noted around the apartment. The couch in the living room is badly deteriorated and stained and appears to be the primary source of the odor problem. The entire apartment is soiled and needs a good cleaning and deodorizing. ORDER: Clean entire apartment including kitchen counters and appliances regularly. Clean or remove and properly dispose of badly deteriorated couch. It appears to be unsalvageable. Clean and deodorize all floors and rugs in an approved manner. Remove all clutter in all rooms. Make free all means of egresses. We checked the building with a four gas meter and and CO present at 27 PPM and rising rapidly. I ordered the building to be evacuated. using personnel started calling residents and alerting them of the evacuation and !ing door to door. All units were called to the scene. Fire personnel along with AMR stair dts evacuated all non ambulatory residents. The residents were evacuated using crews Lairs down the stairwells because the elevators were not working properly. arched all rooms to ensure the all residents were out of the building. Another check I the basement reveled very high levels of CO. Fans were used to push air through the .rst floor and keep the CO from the occupied areasor was shut down. the basement was As soon as all persons were evacuated the ge entilated and fans were uses to clear the CO. the housing authority made arrangements r food and liquids for the residents. When CO levels were back to normal residents ' e allowed into the community room. The Electric company gave an initial estimate of hrs before power would be restored. The power was back on in just over an hour. An ff duty crew was called in for coverage at headquarters. while searching the building crews found that room 604 had a large erc date if with rash. The health agent was at the scene and said that he had a o his resident. Jon Hite was also aware of the situation.
