325 Complaints 1982-2010 McKee, Ky. May 19,1982 Peter J.IMcErlain Northampton Board of Health City Hall Northampton, Ma. 01060 aeas.Mr ,,Mar1ain: I have just received your letter about the property I own at 325 N. Main in Florence. I am a long distance truck driver so I only receive my mail once or twice a month, that is the reason for the to I'm arentwere furnished with my address and a phone number were I could be contacted if there was a problem with the apartment. As of this date I have not heard from them concerning the problems you have listed. My family and I moved from the apartment you are writimgpabout two months ago, 3-15-82. We were having no problem with mice or rodents of any kind. I called one of the upstairs tentants, Sandy Costigan, yeaterday. She stated they were not having a problem with mice but if they did she would be glad to place D-Con in their apartment. I don't understand how one apartment could have mice and the other not. The garbage disposal was working fine when we moved. On 4-30-82 I did pay a repair bill to Raymond Cidhy for the repair of the disposal in Mr. and Mrs. Parent's apartment. They had not stated they were having problems again. The bathroom fan was certainly noisy but working fine when we left. I had not received a complaint about the fan. Phere is a light for the outside stairway. It is mounted on a black vood post at the top of the stairway, and the switbhY.totturnlit=on us Located in Mr. and Mrs. Parent's apartment. le bought the house Nov. 1979. We assumed the house had been built ;o comply with the State Housing Code. This is the first we have heard bout the window area. At no time when we were buying the house or ince did anyone tell us it was not built to the State Housing Code pecifications. The apartment was rented when we bought the house nd we just assumed it was habitable. Since adding windows at this ime would be very expensive we no longer plan to rent the apartment. r. and Mrs. Parent have been sent a certified letter expressing ur regrets at their inconvenience and requesting them to vac3.te the partment by July 1, 1982. f you have further questions please contact me. incerely, luglas A. Sincerely, Ernest Mathieu Health Director 413-587-1213 From: melissa hardy [mailto:smiley100480 @yahoo.com] Sent: Monday, December 10, 2007 11:46 AM To: Ernie Mathieu Subject: Question about apartment Hi there- This is Melissa Hardy and my husband Christopher Hardy called you this morning because of an incident that occured in my residence. I reside at 325 North Main St. in Florence,in the basement apartment. I have a couple questions, but first I will describe to you what has happened. Last evening, on Sunday, the 9th, it was around somewhere between 7 12/11/2007 rage Z 01 3 1 7:30 pm when I overheard what sounded to be water running. IT was ming from the bathroom. As soon as I entered the kitchen, I saw water the floor. I ran into the bathroom, where I witness soiled water erflowing from the toilet. I ran and got some bath towels and laid them the floor to prevent the water from spreading. At this point, the iter made its way into part of the kitchen and my son Erik's room and my ughter Briannas room. Brianna was asleep in her crib and erik was fe inthe livingroom. I went upstairs and knocked on my neighbors door Ld asked for the maintenance person's telephone number. I called him tmediately and briefly explained to him what had happened and he said he ould be on his way. Shortly thereafter, i heard more water running. I n into the bathroom again and more was overflowing and this time I jticed it was also escaping from the shower drain. This was raw ;wage. The water contained particles of feces, urine, and lord knows hat else. At this point I was running around frantic because the is Later now spreading even more and I'm running out of towels and paper )wels. By this time, the water started to spead in my son's bedroom even yore. And into the kitchen as well. The maintenance person arrived and rere was some leaves that was blocking the drain that sits in front f our main entrance/exit. When he did that I heard that water level go Lack down in the toilet as I heard the toilet flush itself.I was able o contact my husband(he is not currently living with me as we are toing through a divorce) and my mother and I got the kids d ressed and )nought them over to spend the night with Chris. I spent the night at my nother's. I was told by the maintenance person that the drain person mould be there the next morning to clean it out. I arrived this morning Ind met the maintenance person there. He had said that they cleaned the sewage and the block was about 50 feet out and mentioned that there were a lot of tampons, which I personally do not use. I was then instructed by the maintenance person t ostart cleaning the mess up beacuse he had to go and get some sheetrock and start rebuilding things. I was relieved to see when I went in that the water did not spread anymore. Chris called me and I was in tears, naturally. He told me to take pictures first. So,I grabbed the disposable camera and took some pictures of the mess. I then started to clean up and then Chris called me back and told me to stop and to get out of there. That it wasnt healthy for me to be there, and its not my responsibility to clean it up. Which, brings me to my question... Is this my responsibility to clean it up? My husband and I are on a one year lease, which expires in June. We were behind on rent, but we also were dealing with a mediator to work something out. When I spoke with Chris shortly this morning after he spoke with the landlord,he told me that I have to move. He mentioned somethign about the place being condemned. I did hear that the neighbors upstairs had some kind of crappy water going on in there place as well. I have two children and no income coming in, as I have been a stay at home mom, and the seperation of me and Chris is fairly recent. Chris was also let go from his job. I'm concerned as 1 dont know where I am going to go. By law, is it the landlords responsibility to put me up somewhere? Chris mentioned to me that our landlord told him that he will drop everything, the money we owe 12/11/2007 Page .3 or m and all that, but I have to move. Last evening, on Sunday, the 9th, it was around somewhere between 7 ind 7:30 pm when I overheard what sounded to be water running. IT was :oming from the bathroom. As soon as I entered the kitchen, I saw water m the floor. I ran into the bathroom, where I witness soiled water werflowing from the toilet. I ran and got some bath towels and laid them m the floor to prevent the water from spreading. At this point, the water made its way into part of the kitchen and my son Erik's room and my daughter Briannas room. Brianna was asleep in her crib and erik was safe inthe livingroom. I went upstairs and knocked on my neighbors door and asked for the maintenance person's telephone number. I called him immediately and briefly explained to him what had happened and he said he would be on his way. Shortly thereafter, i heard more water running. I ran into the bathroom again and more was overflowing and this time I 12/11/2007 rage L us ed it was also escaping from the shower drain. This was raw ge. The water contained particles of feces, urine, and lord knows else. At this point I was running around frantic because the is r now spreading even more and I'm running out of towels and paper Is. By this time, the water started to spead in my son's bedroom even And into the kitchen as well. The maintenance person arrived and was some leaves that was blocking the drain that sits in front Jr main entrance/exit. When he did that I heard that water level go down in the toilet as I heard the toilet flush itself. I was able intact my husband(he is not currently living with me as we are fig through a divorce) and my mother and I got the kids d ressed and fight them over to spend the night with Chris. I spent the night at my her's. I was told by the maintenance person that the drain person ild be there the next morning to clean it out. I arrived this morning met the maintenance person there. He had said that they cleaned sewage and the block was about 50 feet out and mentioned that re were a lot of tampons, which I personally do not use. I was then :rutted by the maintenance person t ostart cleaning the mess up beacuse had to go and get some sheetrock and start rebuilding things. I was eyed to see when I went in that the water did not spread anymore. ris called me and I was in tears, naturally. He told me to take tures first. So, I grabbed the disposable camera and took some pictures of mess. [then started to clean up and then Chris called me back and d me to stop and to get out of there. That it wasnt healthy for me be there, and its not my responsibility to clean it up. Which, .ngs me to my question... s this my responsibility to clean it up?My husband and I are on a fie year lease, which expires in June. We were behind on rent, but we so were dealing with a mediator to work something out. When I spoke ith Chris shortly this morning after he spoke with the landlord, he told e that I have to move. He mentioned somethign about the place being indemned. I did hear that the neighbors upstairs had some kind of crappy ater going on in there place as well. I have two children and no icome coming in, as I have been a stay at home mom, and the seperation of fie and Chris is fairly recent. Chris was also let go from his job. I'm oncemed as I dont know where I am going to go. By law, is it the mdlords responsibility to put me up somewhere? Chris s mentioned to me that the landlord told him that he will drop everything, money we d im and all that, but I have to move. I cant even stay there tonight. We am currently leasing apartment one froth you. We regret to inform you that due to conditions of the building,as well as for health and safety reasons,we must relocate as soon as possible.Per our conversation et 2:00 P.M, today,we will continue to pay rent as usual for the apartment through the date we leave, which is April 15,2010. Please consider this our thirty-day notice to leave. We would welcome your personal inspection of the apartment on or before that date, but ask that you call first The problems are as follows: The tenant in the basement apartment smokes indoors at such a rate that the smoke comes up through the carpets into my apartment. This is unacceptable, especially since Doug's young son visits often and we are greatly concerned that this is causing a worsening of his overall health and particularly increased asthmatic reactions An additional and persistent problem has been the noise caused by the same tenant downstairs; we have been forced to contact the police regarding this a number of times, and as we understand it,the Northampton Police Department has already contacted you regarding the noise issue. From what the police have told me during multiple visits to that apartment, they have a strong suspicion that he is violent toward the woman who is living with hint However, this is not the worst of it. This morning,March 15,2010,the selfsame basement tenant left a pot on the stove which led to the entire house being filled with smoke; he then passed out in a drunken stupor. The Northampton Fire and Police Departments responded, first by evacuating the building, and then followed up by using their fans to clear the apartments of smoke. We were extremely fortunate that the ladies in the rear apartment were awake and able to call 911 at six in the morning. Had neither of the street-level apartments been occupied,it is possible that the building would no longer be standing. We are aware that a similar incident occurred approximately one year ago, Frankly,a one-off mistake—an accident—is dangerous, frustrating, but almost understandable.A repeat of the same is no longer an accident but a clear and present danger. It is for These reasons that we must ask you to release us from the lease we signed with you last July. We very much like the apartment, and we truly regret the circumstances of having to move and wish you the best in future. We have enclosed a second copy of this letter and ask that you sign, date, and return it in the provided envelope as acknowledgement of our 30-days' notice for our records. As you may be aware of, the remaining tenants in the building have given their notice to vacate, because of the problems you have caused. I will be taking you into court for property damage and loss of rents because of your behavior. The fire department has had to break down the door because you were "passed out in a drunken stupor", according to the tenants. Police Department records will be supplied to show how many times they have had to respond to calls for various infractions. If you pay the rent due for March, and are out of the building by April 1, 2009, I will refrain from court action.
