The Department of Environmental Protection (Department) has
completed its review of your statement dated June 6 , 1995, as well
as the available information on file.
You have submitted a statement in order to satisfy the requirement
of 310 CMR 40 . 0610 pertaining to the above site which is listed on
the Transition List of Confirmed Disposal Sites and Locations To Be
Investigated (LTBI) (the 1993 , Transition List) as a LTBI . Your
statement certifies the findings of a report entitled
"Environmental Site Assessment, dated December 19, 1988, prepared
by E.J. Flynn Engineers, Inc. This report had concluded that the
above referenced location was not a site and that no releases of
Oil and/or Hazardous Material (OHM) had occurred at this location.
Based upon the available information, the Department is approving
your statement affirming the conclusions of the report, and is
deleting the property from the Transition List, since its inclusion
on this list appears to have been inappropriate.
Please note that if any future reportable releases of OHM occur or
information become available indicating that a reportable release
had occurred, at the above location, the appropriate notification
must be conveyed to the Department in a manner consistent with the
Massachusetts Contingency Plan 310 CMR 40 . 0000 .

On May 30. 1997.the Department of Environmental Protection (the"Department)- promulgated regulations that allow the
Department to exempt certain Locations To Be Investigated (LTB1s I. from "transition' requirements of the Massachusetts
Contingency Plan (the -NKr. 310 CMR 40.0000). This exemption applies to all LTBIs and disposal sites that do not appear to
warrant further investigation or cleanup(refer to enclosure for specific criteria under 310 CMR 40.06371-
Between January 1987 and October 1993, the Department listed the above-referenced location as an LTBI. a location
reasonably likely to be contaminated by a release of oil and'or hazardous material. The Department has reviewed the file for this
location and determined that,based on the information reviewed,this location qualifies for the exemption. Please be advised that the
Department does not anticipate requiring further assessment and/or cleanup at this property.
Our records indicate that you may have a connection to this location as either a landowner,a facility operator. someone who
generates or transports oil or hazardous materials or as a contributor to the contamination.
It is important to note that the Department's review relied only on information in the Departments files. This information is
not sufficient to make a definite determination whether a level of No Significant Risk"under current standards exists at this location.
Should the Department receive new information indicating that further action is necessary,the Department reserves the right to take or
require others to take action to protect public health,safety,welfare and the environment. Please also note that.if you are a potentially
responsible party, you remain legally obligated to notify the Department of any condition or release at this property for which reporting
is required by the MCP.
