Box 25 Leeds, MA. 01053 (413) 586-3769 Julia Clinton Leeds Village Property Manager 5 Gerard Way Holyoke, MA. 01040 08/09/06 Dear Ms. Clinton: I have been having a terrible time with the heat in my new apartment(4A at Leeds Apartment Village.) Besides the hot air rising up from the apartments below me, the sun lights in the roof let in a considerable amount of heat as well. There are only two windows- one in the bathroom, and one in the main room that opens from the side of the roof. If the sun is shining on the roof, hot air actually comes in through the window, so I must keep it closed during a good portion of the day, leaving me with the bathroom window to ventilate the entire apartment. A 9,000 BTU air conditioner has been provided in the apartment, which has been of no help whatsoever. According to the information I have been able to find, an air conditioner of this size is only meant to cool a space of about 350-400 cubic feet, and I have measured my apartment to be over 11,000 cubic feet. I also measured the temperature of the air blowing out of the air conditioner with a digital thermometer, and it is only blowing 68 degree air. Needless to say, I have given up on the air conditioner for now, which seems to put off more heat via the exhaust pipe than it is actually cooling. I have been here for a little over a week now, and it has been consistently 10 to 20 degrees hotter in my apartment at any given time of the day or night, than it is outdoors (not including the loft, which is considerably hotter than the rest of the living space, and is unusable at this time.) I have had five large fans, and up until a couple of days ago, the air conditioner mining as well,24 hours a day, since I have arrived. I consider myself lucky if the temperature inside the apartment does not exceed 90 degrees in the daytime, on a comfortable day. I have found that the heat has been physically draining, and I have been suffering from periodic dizzy spells when I am in the apartment. Although I am not a professional in these matters, my opinion is that there needs to be a vent in the ceiling so that the hot air that is "pooling up"in the apartment has somewhere to go. I looked into the Massachusetts Department of Public Health Housing Codes, and found that in fact, the apartment should have much better ventilation. Here are two excerpts of particular interest from105 CMR 410.000: Minimum Standards of Fitness for Human Habitation (State Sanitary Code, Chapter II): Section:410.280: Natural and Mechanical Ventilation The owner shall provide for each habitable room, and room containing a toilet,bathtub or shower, ventilation to the outdoors consisting of: (A) Windows, skylights, doors or transoms in the exterior walls or roofs that can be easily opened to a minimum of 4%of the floor area of that habitable room or room containing a toilet,bathtub or shower, provided,that a skylight which if open exposes the interior of the dwelling to direct rainfall shall not satisfy this requirement; or (B) Mechanical ventilation capable of exhausting air at the following rates: Occupancy Classification Required Air Changes Per Hour Habitable rooms other than 2 bath, toilet or shower rooms Bath, toilet or shower rooms 5 Section: 410.281: Ventilation Shut-off Each mechanical ventilation system required by 105 CMR 410.280(B) shall be equipped with a readily accessible means for either shut-off or volume reduction, and any other ventilation system shall be equipped with a readily accessible means for shut-off. It would be greatly appreciated if you could help me remedy this situation as soon as possible. Although we are nearing the end of summer, we are probably due for a couple more heat waves before the seasons end. When it is really hot outside, this apartment becomes uninhabitable. The situation is that the lack of ventilation causes my apartment to become, and remain, extremely, (dangerously)hot, to the extent that it is clearly a health hazard. I explained to him my situation, and showed him the above sanitary code, and he said that "It doesn't make any sense."He apparently reported back to you, and recommended replacing my 9,000 btu air conditioner with a 25,000 btu air conditioner. You called me a few days later, and informed me that some people were going to come by and install a 25,000 btu air conditioner, and I told you that I needed ventilation at the rate of 2 air changes per hour, not an air conditioner. You said that you would call me back, and it is now the end of April, and I have not yet heard back from you. I have measured the cubic and square footage of the apartment taking into consideration the slanted roof, excluding the closet which is not considered a habitable room, and the bathroom, which has an adequate window. These are the measurements that I have obtained, which need to be taken into consideration when coming up with a workable solution: Square Feet (floor area): 919 Cubic Feet(volume): 9,913 I can show anyone who is interested, my schematic drawings,measurements and calculations upon request, and someone else can re-measure as well, if you want to be extra sure. According to Section 410.280 of the state sanitary code, I need to be able to open windows, etc. to a minimum of 4%of the floor area. 4%of 919 sq.ft.36.76 sq.ft. I currently have one window that opens to 12.25 ft., and I doubt that this particular standard takes into consideration the 14 ft. ceilings, which are uncommon in most circumstances. Rather than installing more windows, it seems to me, that the option that could actually work the best, as well as be easier and less expensive,would be to have a ventilation system installed in the ceiling that is capable of the minimum standard of 2 air changes an hour,taking into account that the apartment is 9,913 cubic feet. This would mean that the ventilation system would have to be capable of exhausting at least 330 cubic feet per minute. I propose that this could be installed in the loft, where there is already a"hole"(the sky-light). It would be easy to reach for maintenance and installation, and less visible. If you have a better idea, that's great,but it is my understanding that it would be nearly impossible for an air-conditioner to ventilate this apartment to the extent that it would meet the"Minimum Standards of Fitness for Human Habitation." From the day I signed the lease(August 1, 2006), the temperatures in the apartment have been between brutally hot to just plain uncomfortable. Throughout this past winter, I have had my windows (one in the bathroom, and one in the main room)open 24/7, with fans going when I am home. I have completely shut down the heating fans, and covered the heating vents, and if I am lucky, 1 can get the temperature down to be between 75-80 degrees in the main room under these circumstances, in the winter. It is now getting wanner outdoors, and with this,these temperatures are rising once again in the apartment, and I am dreading the months to come. The fact that I have informed your office of the sanitary code violation, and you have ignored my request to remedy this problem, constitutes a willful violation of Massachusetts State Law, Chapter 93A. Under Chapter93A, it is an unfair and deceptive act to rent an apartment with housing conditions that are in violation of the state sanitary code. If 1 don't hear back from you, and/or nothing seems to be happening regarding this situation by May 1s`, 2007, I am going to be left with no choice but to set up an appointment to have the Health Department inspect the apartment, and we will have to go from there. Your office will be notified so that you may have a representative present at the time of the inspection. I found the ceiling height requirements in Chapter II, 410.401 which states: A) No room shall be considered to be habitable if more than 3/4 of its floor area has a floor-to-ceiling height of less than seven feet. B) In computing tonal floor area for the purpose of determining maximum permissible occupancy, that part of the floor area where the ceiling height is less than five feet shall not be considered. This may sound stupid, but I noticed that the area that is considered the "kitchen" could be disputed, depending on how one has things set up. For instance, if I moved the refrigerator out into the main area, and set up a table nearby, perhaps one could say tha- that is part of the kitchen. There is no wall or door to distinguish where one room ends, and the other begins, so could this be questionable? I am attaching the documents that you asked me to send to you. My father and I measured the apartment twice on two separate occasions in order to be extra sure, and both times we came up with 919 sq.ft of floor area. This is not including the bathroom or closet. I am concerned that there is almost a 200 sq.ft. discrepancy between your measurements, and mine. I know that you were in a big hurry to get back to the office while you were measuring. Could you have overlooked something?I do not remember seeing you measure the loft for instance,which is supposed to be a habitable room (I got 64 sq.fl. there.) Another thing,Leeds Management told me that they cannot install any more windows on the outside of the building. I think that it may have something to do with the fact that this is a historic building. This would mean that their only other option may be mechanical ventilation. In order to provide the mandated two air changes per hour,the cubic footage needs to be taken into consideration. We measured 9,912 cu.fl., again, excluding the bathroom and closet, and taking into consideration the slanted roof. If they decide to install ventilation,the only way to verify that it is "up to code" would be to assess how many cubic feet per minute the fan is capable of exhausting, in relation to the cubic footage of the apartment. I hate to ask, but is there any way that you could come back and remeasure the apartment? Maybe double-check the floor area, and verify the cubic footage? Please let me know. On May 18, 2006, I conducted an inspection of the dwelling unit which was a large loft type apartment pied by you. I was accompanied by two State Inspectors from the MDPH. The floor area of the unit was cured to be 23 feet by 32 feet. This floor space equals 736 sq feet of floor area. There is only one window in dwelling which is approximately 43 inches by 44 inches giving an area of 13 sq. feet. This size room requires a mum of 30 square feet of easily opened window area. The main floor area will require mechanical ventilation as there is an insufficient amount of operable window,skylight,door,or transom area to satisfy the code. The main floor including the bathroom has a calculated gross volume of approximately 16,800 cubic feet. We should deduct from this value,the volume of the bathroom which is 515 cubic feet 8.17 x 7 x 9 the volume of. area includin_the common access which is 960 cubic feet(12'x 10'x 8'),and the volume that is represented by the vaulted ceiling which runs the length of the apartment which is 2,400 cubic feet 10'x 12'x 40'x.5). The net volume of the actual apartment then comes out to approximately 12,925 cubic feet. To calculate the CFM requirements for the fan,we need to multiply the volume by the number of air chan•es and d-vi.e that number 60. Thus. 12925x 2 /60 e.uals 430 CFM We would be happy to supply an exhaust fan that has the capability of moving the required 430 CFM with a static pressure as high as.25"water column. I want to thank you for faxing the information concerning the ventilation issue. I have read the document and looked over the CMR' s relating to this issue. Although not stated, it appeared to me that the ventilation requirements set forth by 105 CMR 410.280 relates to temporary ventilation as to provide air change for cooking and bathroom odors, humidity from a shower, and some level of air exchange for high temperature and high humidity conditions, etc. With that said and doing some simple math to determine air flow volumes verses building volume and air exchange rates, it appears simple kitchen and bathroom ventilation fans would take care of the requirements. I verified this with Paul Haufman, the state inspector you mentioned, and he agreed that the requirements set forth are for the above mentioned purpose. I will notify Francesco Rodriguez of this information, and suggest he purchase appropriate ventilators and arrange for their installation.
