FAILURE TO TAKE ADEQUATE ACTION IN RESPONSE TO THE NOTICE COULD RESULT IN SERIOUS LEGAL CONSEQUENCES. Dear Mr.Timberlake: Department personnel have observed that on May 22 and November 25, 1998 activity occurred at your facility located at 219 Main Street, Northampton, Massachusetts, in noncompliance with one or more laws,regulations, orders, licenses,permits,or approvals enforced by the Department. Specifically, Department personnel observed activities in noncompliance with applicable Hazardous Waste Management and Environmental Results Program Certification regulations. Attached is a written description of(1)each activity referred to above,(2)the requirements violated,(3)the action the Department now wants you to take,and(4)the deadline for taking such action. An administrative penalty may be assessed for every day from now on that you are in noncompliance with the requirements described in this Notice of Noncompliance. Notwithstanding this Notice of Noncompliance,the Department reserves the right to exercise the full extent of its legal authority in order to obtain full compliance with all applicable requirements, including,but not limited to,criminal prosecution,civil action including court-imposed civil penalties, or administrative penalties assessed by the Department,in order to obtain full compliance with all applicable requirements. Noncompliance With the Massachusetts Hazardous Waste Management Act,M.G.L.c.21C, §§I - 14,and the Hazardous Waste Regulations,310 CMR 30.0000 I. Hazardous waste(photographic process wastewater containing silver)has been generated without notification to the Department, in violation of 310 CMR 30.061(1),which states that each generator of hazardous waste must notify the Department of such activity, and must apply to the Department for an identification number. 2. A hazardous waste container was not closed during accumulation, in violation of 310 CMR 30.685(1)and as referred to in 310 CMR 30.353(6)(g),which provides that each container holding hazardous waste shall always be closed during accumulation,except when waste is being added or removed. 3 Hazardous waste was being accumulated in an unlabeled container, in violation of 310 CMR 30.682 and as referred to in 310 CMR 30.353(6)(g), which states that each container in which a very small quantity generator accumulates hazardous waste must be clearly marked and labeled throughout the period of accumulation with the following: a. the words "Hazardous Waste'; b. the hazardous waste(s) identified in words; and c.the type of hazard(s)associated with the waste(s)(for wastewater containing silver, "Toxic'). 4. There was no "HAZARDOUS WASTE" sign in the accumulation area, in violation of 310 CMR 30.340(1)(1),which states that hazardous waste accumulation areas shall have posted at all times a sign with the words "HAZARDOUS WASTE" in capital letters at least one inch high. 5. The accumulation area boundary was not clearly marked, in violation of 310 CMR 30.340(I)(k), which states that hazardous waste accumulation areas shall be clearly marked so that they are distinguishable at all times from other areas at the site of generation. Noncompliance with the Massachusetts Environmental Results Program Certification,310 CMR 70.00 6. Records of maintenance and wastewater flow of the silver recovery system were not being kept on site, in violation of 310 CMR 71.05(4)(a), (b), (d)and(e), which state that each photo processor shall keep the following records on-site for at least three (3)years: (a) sampling dates and results conducted in accordance with 310 CMR 71.05(3); (b) dates of silver recovery cartridge installation and replacement; (d) total amount of wastewater discharged in the past twelve(12)months; and (e) total amount of wastewater passing through the silver recovery system in the past twelve (12) months. 7. The facility's 1997 compliance certification dated September 15, 1997 contained one or more false, inaccurate, incomplete, or misleading statements(question 13 should be checked "No" instead of"Yes" because of the noncompliance in paragraphs A.I.through 5. above), in violation of 310 CMR 70.04(2). ACTION TO BE TAKEN,AND THE DEADLINE FOR TAKING SUCH ACTION: A. Massachusetts Hazardous Waste Management Act,M.G.L.c.21C,§§1 - 14,and the Hazardous Waste Regulations,310 CMR 30.0000 1. Within fourteen (14) days from the date of receipt of this notice, Ritz Camera Center shall forward a completed hazardous waste notification form(copy enclosed)to the Department. 2. Immediately upon receipt of this notice, Ritz Camera Center shall keep all containers of hazardous waste closed except when waste is being added or removed. 3. Within fourteen (14) days from the date of receipt of this notice, Ritz Camera Center shall mark and label all containers of hazardous waste in accordance with 310 CMR 30.682. 4. Within fourteen (14) days from the date of receipt of this notice, Ritz Camera Center shall place a "HAZARDOUS WASTE" sign in the accumulation area, in compliance with 310 CMR 30.340(1)(j). 5. Within fourteen (14) days from the date of receipt of this notice, Ritz Camera Center shall mark the boundary of the hazardous waste accumulation area, in compliance with 310 CMR 30.340(1)(k). B. Massachusetts Environmental Results Program Certification,310 CMR 70.00 6. Immediately upon receipt of this Notice, Ritz Camera Center shall begin keeping records on site of maintenance and wastewater flow of the silver recovery system, in compliance with 310 CMR 71.05(4). I observed a number of code violations and have posted units 302 and 303 as unsafe to occupy in accordance with the Massachusetts State Building ;ode, Ch. 1 s. 116 and Ch. 34, s. 102.2.2.2. -here are a number of conditions that make units 302 and 303 unsafe to occupy: o Neither unit has working smoke or carbon monoxide detectors. o Some portions of the sleeping rooms and hallways in both units are obstructed and do not meet building code requirements for safe means of egress o Both units have violations of the electrical code, including open boxes, exposed wiring, unapproved fixtures, overloaded circuits and extension cords used as permanent wiring. In addition to the immediate threats to life safety that I have detailed above, a number of other code violations exist: o Unit 303 does not appear to have two independent means of egress and one of the bedrooms does not have an emergency escape and rescue opening as required by the building code. o The ceiling in the bathroom of unit 303 has fallen and the roof deck boards are rotted because the roof is leaking. The roof needs to be assessed and repairs made as necessary. o The emergency lights in the stairway are not working. o A number of items are stored in the electrical room on the second floor. o It appears that the rooms in unit 302 and one of the rooms in unit 303 are being operated as a lodging house as defined by GL CH. 140 s. 22. o Unit 302 does not have a working kitchen as required by the plumbing code. o The building has not been inspected and does not have a certificate of occupancy as required by building code 01. 1, s. 110 and 111. o A number of less serious electrical code violations also exist, including unsupported and unprotected wiring, improperly installed low voltage wiring and an insufficient number of receptacles to serve the living spaces. Once the unsafe conditions are corrected, I will allow temporary occupancy of units 302 and . The remaining code violations will need to be corrected as soon as is reasonably possible. I will Jire that there be a plan in place within two weeks to address the remaining issues, and that the k needed to correct the violations be completed in a timely manner. The Northampton Fire ,artment will also likely require that the building fire alarm system be extended to include heat ector and notification devices in each of the residential units.
