The Department of Environmental Protection has reviewed your
request for a Determination of Beneficial Use. This application
was submitted to the Department under authority of the Solid Waste
Management Facility Regulations 310 CMR 19. 060. This regulation
states that any person who proposes to make beneficial use of a
solid waste material must obtain a prior written determination of
beneficial use from the Department. This application for a
beneficial use determination was also submitted to the Northampton
Board of Health.
The proposal involves the recycling of tree prunings consisting of
branches, limbs, and trunks, which had previously been discarded as
a waste material, into a landscaping cover material. This wood
chip cover material would be used for an inactive wood waste
disposal area at an old gravel pit located at 50 Cooke Avenue in
Northampton. The source of the material is from landscaping
activities in the Hampshire County area. Approximately fifty (50)
cubic yards per year of chipped woodwaste would be used for cover
replacing the need for use of gravel, soil, and grass.
The application stated that the material (woodwaste) to be recycled
is not firewood nor nursery quality due to rotting, moisture and
natural resin content. This material would be handled and stored
in the parking/storage area at 50 Cooke Avenue, Northampton. This
20 foot by 20 foot storage area, which will receive the cover
material, has been reviewed and approved by the Northampton
Conservation Commission in an Order of Conditions.
The regulation 310 CMR 19.060 (3) requires that the Department shall
accept comments from the Northampton Board of Health regarding the
application for a period not less than twenty-one (21) days before
issuing a final determination.

The Department issued the Draft on April 6, 1992 and has received
no comments on the Determination of Beneficial Use.
It is the opinion of the Department that the applicant has
affirmatively demonstrated that:
(a) the material will not be handled or utilized in a manner
which will result in the material becoming a solid waste;
(b) the identified material can be feasibly processed and put
to beneficial use under the proposal set forth in the
application;
(c) the proposed project can be successfully completed in
',compliance with appropriate rules and regulations;
(d) the proposed operation and beneficial use will not cause
or threaten to cause an adverse impact.
This Determination of Beneficial Use is a finding that the proposed
use of the materials does not constitute disposal of a solid waste.
A beneficial use determination shall only apply to declassification
of the discarded materials as solid waste.
