corrected. Failure to comply with this order also subjects the person
ordered to a criminal fine of not less than ten ($10. 00) dollars, nor

ORDER: Owners name, address, and telephone number must be posted and maintained on
dwelling adjacent to the mailboxes for such dwelling or elsewhere in the interior of such
dwelling in a location visible to the residents. It must be constructed on notice of durable
material,not less than 20 square inches in size,bearing his name, address and telephone
number.

On or about January 6, 2004 there was a break in the water pipes in Apt. #2. The break was
not repaired and the water was shut off. These pipes also supply the water to the laundry
room and rear bathroom of Apt. #3. As a result there is no running water in these two rooms
of Apt. #3.
ORDER: Restore water to these to rooms in Apt# 3 within 24 hours (By February 24,
2004).

TSIDE TRASH STORAGE AREA
&602 Several trash containers with no lids. Containers are not watertight receptacles. Garbage,
trash and other debris scattered on ground. This situation is an attractive area for animals and
it is easy for them to get in the trash and scatter it.
ORDER: Provide a sufficient amount of trash cans for tenants. ALL TRASH CANS
MUST HAVE LIDS Clean area around trash storage site. CORRECT VIOLATION
IMMEDIATELYAND NOTIFY THIS OFFICE AT 587-1214 WHEN CORECCED.

1.600: Storage of Garbage and Rubbish
(A) Garbage or mixed garbage and rubbish shall be stored in watertight receptacles with tight-fitting covers. Said receptacles
and covers shall be of metal or other durable, rodent-proof material. Rubbish shall be stored in receptacles of metal or
other durable, rodent-proof material. Garbage and rubbish shall be put out for collection no earlier than the day of
collection.
(B) Plastic bags shall be used to store garbage or nixed rubbish and garbage only if used as a liner in watertight
receptacles with tight-fitting covers as required in 105 CMR 410.600(A),provided that the plastic bags may be put out
for collection except in those places where such practice is prohibited by local rule or ordinance or except in those
cases where the Department of Public Health determines that such practice constitutes a health problem. For purposes
of the preceding sentence, in making its determination the Department shall consider, among other things,evidence of
strewn garbage,tom garbage bags, or evidence of rodents.
(C) The owner of any dwelling that contains three or more dwelling units, the owner of any rooming house, and the
occupant of any other dwelling place shall provide as many receptacles for the storage of garbage and rubbish as are
sufficient to contain the accumulation before final collection or ultimate disposal, and shall locate them so as to be
convenient to the tenant and so that no objectionable odors enter any dwelling.
(D) The occupants of each dwelling unit, and rooming unit shall be responsible for the proper placement of his garbage
and rubbish in the receptacles required in 105 CMR 410.600(C)or at the point of collection by the owner.

602: Maintenance of Area Free from Garbage and Rubbish
(A) Land. The owner of any parcel of land, vacant or otherwise, shall be responsible for maintaining such parcel of land in a
clean and sanitary condition and free from garbage, rubbish or other refuse. The owner of such parcel of land shall
correct any condition caused by or on such parcel or its appurtenance which affects the health or safety, and well-being
of the occupants of any dwelling or of the general public.
(B) Dwelling Units. The occupant of any dwelling unit shall be responsible for maintaining in a clean and sanitary condition
and free of garbage, rubbish, other filth or causes of sickness that part of the dwelling which he exclusively occupies or
controls.
(C) Dwellings Containing Less than Three Dwelling Units. In a dwelling that contains less than three dwelling units, the
occupant shall be responsible for maintaining in a clean and sanitary condition, free of garbage, rubbish, other filth or
causes of sickness the stairs or stairways leading to his dwelling unit and the landing adjacent to his dwelling unit if the
stairs,stairways or landing are not used by another occupant.
(D) Common Areas. In any dwelling,the owner shall be responsible for maintaining in a clean and sanitary condition free of
garbage,rubbish, other filth or causes of sickness that part of the dwelling which is used in common by the occupants and
which is not occupied or controlled by one occupant exclusively. The owner of any dwelling abutting a private
passageway or right-of-way owned or used n common with other dwellings or which the owner or occupants under his
control have the right to use or are in fact using shall be responsible for maintaining in a clean and sanitary condition free

The Northampton Board of Health is acting under the authority of
MASSACHUSETTS GENERAL LAWS, 105 CMR 410.000: State Sanitary
Code Chapter II: Minimum Standards for Human Habitation. You are
hereby ordered to make a good faith effort to comply with the formal
order issued to you above within the time frame listed. Failure to do so
could result in legal action taken against you to pursue compliance with this
order: A-re-inspection will take place on or around September 1, 2009. If
you would like to be present please contact the Health Department to
schedule a time.
Failure to comply with any order issued pursuant to the provisions of 105 CMR
410.000-shall upon conviction be fined not less than $10 or more than $500. Each
day's failure to cornply shall constitute separate violations.
Please be advised that if you are aggrieved with this order you have the right to
request a hearing. You must submit a written petition requesting a hearing within seven
(7) days from the day the order was served

To follow please find a copy of the Tenant Lead Law that Robinson Realty gave to Ursa
Mender on July 22,2009. She took the copy but refused to sign,she wanted to read it in
private.
The pitch light has been repaired and is left on for your inspection It is a sensor light,so
it is sensitive to darkness,you can just put your hand over the sensor to get it to come on.
